MONDAY, NOVEMBER 20, 2023 The Grant County Commissioners session began at 8:30a.m. with all Commissioners in attendance. 8:00 a.m. — 8:30 a.m. C Carter, Insurance Renewal Meeting with Shane Heston 8:30 a.m. — 8:45 a.m. Central Services Weekly Update • New dentist office across from courthouse is telling their patients to park in courthouse parking lot. • Lunch meeting to discuss Jail bond funding Pursuant to RCW 42.30.110(1)(b) Commissioner Jones called an Executive Session to order at 8:37a.m. to go until 8:42 a.m. regarding Real Estate Acquisition. In attendance were Commissioners Carter, Stone and Jones., and Tom Gaines, Central Services Director. Commissioner Jones closed the session at 8:42 a.m. 8:45 a.m. — 9:00 a.m. Development Services Weekly Update • The 2023 Comprehensive Plan Amendments were discussed. 9:00 a.m. — 9:30 a.m. M McKnight, Assessor's Office Levy Rate Discussion • Suspicious package in the Assessor's Office — undetermined substance in envelope. • 2024 Levy Assessment numbers discussed. Veteran and Mental Health numbers need to be determined annually. In attendance were Commissioners Carter, Stone and Jones, Tom Gaines, Central Services Director; Damien Hooper and Sam Dart, PUD of Grant County. Commissioner Jones closed the session at 10:55 a.m. 11:30 a.m. —12:00 p.m. J Kriete, Sheriff's Office Update • The Sheriff discussed dog licenses and RCW 16.10 —they are a requirement and need to be re - implemented. There were such a small amount of license fees being collected. • Animal control areas — potentially increase fees to assist covering of fees. Less than 1% of dog owners license their animals. 12:00 p.m. —1:00 p.m. T Gaines, Jail Update — Bonding Follow-up In attendance: Jim Nelson, DA Davidson; Joe Kriete, Sheriff, Tom Gaines and Kevin Schmidt, Central Services; and Darryl Pheasant, Treasurer. The group discussed the new jail funding and the cost of building it. Also discussed was the new morgue building that needs to be built as well. 12:00 p.m. —1:00 p.m. WSAC Virtual Assembly 1:OO p.m. — 2:00 p.m. Commissioners Round Table — Miscellaneous Discussion • Review of Consent Agenda Items o Auditor Item 2 —Done at the request of the BOCC to utilize current expense funds. o BOCC Item 4 — Clerk of the Board stated this is an annual approval. o Fairgrounds Item 15 — Software sole source purchase, submitted by Director. If approved, PAO will review contract. Where is the verification this is a sole source purchase? o GCSO Item 19 - Withdrawn • Commissioner District Updates o CC District 3 — Royal City is a high fire risk area; road widening; met with Shane Heston this morning and the total due is $4.8 million for 2024. Increase is due to larger usage and a large claim. o DS District 1— WSAC Board Meeting last week, a policy statement was put together to deal with state insurance costs issues including and Joint and Several Liability. Also at the WSAC Conference, the larger counties demanded smaller dues and more "seats at the table" and requested smaller counties pay more in dues. Also to go to "weighted voting". State Council on Aging, he was appointed by Governor Inslee. These meetings are held on Tuesday mornings so it will likely be that he will have to resign, due to BOCC meetings. Sam Castro asked about RV Disposal legislation, DS will bring this forth to the next WSAC LSC meeting. Page 3 of 14 Grant County Commissioners Minutes Week of November 20, 2023 • Travel and Seating Arrangements (Accounting) — Emili Wash discussed the airline policy; the county does not pay for over and above charges (aisle seating). Coach/Basic Economy — allow excess changes but bring any abuse situations to the BOCC attention. • Kevin Schmidt discussed "public parking" lots and signage. Outside businesses are using county parking lots for their customers. The question is being proposed if the county can make signage stating "parking is for county business only" and adding it to the County ordinance. A simple sign change probably won't be enough. Tom Gaines requested Prosecuting Attorney review. Jim Anderson -Cook discussed PUD and Noxious Weed parking on the streets and county parking. 2:00 p.m. — 5:00 p.m. Open Record Public Hearing, 2023 Comprehensive Plan Amendments The Commissioners held an Open Record Public Hearing to consider the 2023 Comprehensive Plan Amendments. All staff in the room introduced themselves. Commissioner Jones asked if any of the commissioners had any personal interest in any of the hearings today. Jim Anderson -Cook, Deputy Director of Development Services discussed the following applications: • Amendment/Rezone) & P 22-0151(SEPA) from Sentinel Shores LLC. The applicant has submitted a Site -Specific Land Use Re -designation application requesting the subject parcels be re- designated from Rural Lands, Rural Residential 1 to LAMIRD -Rural Community along with an application for a rezone from Rural Residential 1 (RR1) to LAMIRD -Rural Community (RC). The proposal site is comprised of two (2) parcels totaling approximately 79.80 acres. The proposal site is located adjacent to the Columbia River, just south of the town site of Beverly, in a portion of S. 341 T. 16 N, R. 23 E, W.M., Grant County, WA (Parcels #15-0289-000 & 15-0284-000). At their regularly scheduled public hearing on August 9, 2023, the Grant County Planning Commission conducted an open record public hearing to consider remanded file P 22-0150 & P 22-0151. The Planning Commission unanimously recommended approval of the proposed comprehensive plan amendment and rezone. Commissioner Carter asked about the 2022 application that was sent back to Planning Commission in hopes that state legislation was going to change regarding LAMIRDS. Staff stated no. Barbara Duerbeck clarified that the state specifically looked at this parcel and decided to not change the legislation. The financial penalties involved if the Commissioners choose to violate the GMA, will impact ORV grants in the approx amount of $262 million, and $24 million of taxes, totaling approx. $24,315,324.00 in potential adverse findings. Anson Bartrand, Sentinel Shores, discussed the rural area and the ability of the BOCC to make this approval. Steve Davenport, Senior Planner with Department of Commerce, recommends denial of the application. Commissioner.Carter recognized the housing shortage in the area, there is a problem that needs to be fixed. Mr. Davenport stated Commerce is looking into more affordable housing answers. Page 4 of 14 Grant County Commissioners Minutes Week of November 20, 2023 Dr. Margaret Bartrand, stated the problem has gotten worse, with kids being transported for over an hour to go to elementary school. Schools are not able to be built in the area due to the zoning issue. Commissioner Jones asked Mr. Davenport about the Logical Boundary definition. Arill Bartrand, voiced his support for the zoning change. He feels the boundary lines were an oversight and they are trying to correct it. He believes this is a timing issue, not a GMA Compliance issue. David Bartrand spoke in favor of the application. The potential is there to make this 1 community and make it better. Jonah Bartrand asked about the revenue impact presented by the Prosecuting Attorney's Office. Benjamin Serr and Heather Carter (Attorney General Office) were in attendance via Webex. A motion was made by Commissioner. Carter, to close the public comment portion of the hearing. Commissioner Stone seconded and the motion passed unanimously. A motion was made by Commissioner Stone to uphold the Planning Commission recommendation and approve the subject re -designation. Commissioner Carter seconded for discussion purposes. Commissioner Stone discussed his motion, making a public statement that change needs to come from the State level. Commissioner Carter agrees with Commissioner Stone, but the financial impact to the County is too great. Discussion ensued. Commissioner Stone voted aye, Commissioners Jones and Carter voted nay, recognizing the nine (9) Findings of Fact in the nay. A motion was made by Commissioner Carter, seconded by Commissioner Jones to veto the Planning Commission recommendation and deny the subject rezone application recognizing the ten (10) Findings of Fact in the negative. Commissioner Stone voted nay. The motion passed with a vote of 2 to 1. The applicant has submitted aSite-Specific Land Use Re -designation application requesting the subject parcel be re -designated from Resource Lands, AG Rangeland to Rural Lands, Rural Residential 1 along with an application for a rezone from AG to Rural Residential 1 (RR1). The proposal site is comprised of one (1) parcel totaling approximately 59.87 acres. The proposal site is located at 19943 Road F.4 NE, Soap Lake, WA 98851 and further described as SENW; NESW LS Tax#'s 30 22 28, Grant County, WA (Parcel #17-1295-003). At their regularly scheduled public hearing on August 9, 2023, the Grant County Planning Commission conducted an open record public hearing to consider file P 23-0079 & P 22-0080. The Planning Commission unanimously recommended approval of the proposed comprehensive plan amendment and rezone. Commissioner Stone asked what the parcel is currently being used for. Staff stated there is a home there, but the rest of the land is not being used for anything. Discussion ensued. Gary Carpenter, neighbor, spoke against the application. He feels the county is "anti -Ag". Greg Minden, proponent, stated he has no intention of creating 5 -acre parcels at this time. His plan is to split the parcel into 2 pieces only. This will not become a housing project. Steve Davenport, Commerce, stated this application is in violation of the Growth Management Act. Greg Minden, proponent, is surprised at the States response. Gary Carpenter stated that it has no water on it because no one has applied water. He feels it can be done. Barbara Duerbeck also discussed the county -wide analysis. The last analysis was completed in 2018 and the next is due 2027. At their regularly scheduled public hearing on August 9, 2023, the Grant County Planning Commission conducted an open record public hearing to consider file P 23-0090 & P 22-0091. The Planning Commission unanimously recommended approval of the proposed comprehensive plan amendment and rezone. Steve Davenport, Commerce, reiterated his comments from the last hearing, that this application is in violation of the Growth Management Act. A motion was made by Commissioner Carter, to close the public comment portion of the hearing. Commissioner Stone seconded and the motion passed unanimously. A motion was made by Commissioner Carter, seconded by Commissioner Stone to uphold the Planning Commission recommendation and approve the subject re -designation recognizing the nine (9) Findings of Fact in the affirmative. Commissioner Stone thanked the Prosecuting Attorney's Office for their hard work. Commissioner Jones would like to seethe future analysis done. The motion passed unanimously. The applicant has submitted an application requesting to update Chapter 7 — Transportation Element, Appendix E and Chapter 8 —_Capital Facilities Element, Appendix F, of the Grant County Comprehensive Plan The purpose of this update is to provide necessary changes to Appendix E, Transportation Plan and Appendix F, Capital Facilities Plan of the Comprehensive Plan. Pursuant to the Growth Management Act, Cities and Counties Comprehensive Plans are required to contain at least six-year Traffic Improvement Plan (TIP) and Capital Facilities Plan (CFP) that identifies proposed projects and funding sources during the six-year period. This proposed update is for the time period of 2023-2028 and will be updated annually to reflect changes, if any, to projects added or completed during that plan year. The proposal site is located Countywide. At their regularly scheduled public hearing on August 9, 2023, the Grant County Planning Commission conducted an open record public hearing to consider file P 23- 0098 & P 22-0095. The Planning Commission recommended approval of the proposed comprehensive plan amendment with one member abstaining from vote. A motion was made by Commissioner Stone, to close the public comment portion of the hearing. Commissioner Carter seconded and the motion passed unanimously. A motion was made by Commissioner Stone, seconded by Commissioner Carter to uphold the Planning Commission recommendation and approve the subject six-year mandatory update recognizing the nine (9) Findings of Fact in the affirmative. The motion passed unanimously. • File #P 23-0099 (Comp. Plan Amendment) & P 23-0116 (SEPA) from County of Grant, Washington. The applicant has submitted an application requesting to update Chapter 5 — Economic Development Element, Appendix J, of the Grant County Comprehensive Plan. The purpose of this update is to include projects that have been submitted to and approved by the Grant County Economic Development Council to be included in the listing of Strategic Infrastructure Program Eligible Projects. At their regularly scheduled public hearing on August 9, 2023, the Grant County Planning Commission conducted an open record public hearing to consider file P 23-0099 & P 22-0116. The Planning Commission recommended approval of the proposed comprehensive plan amendment with one member abstaining from vote. A motion was made by Commissioner Carter, to close the public comment portion of the hearing. Commissioner Stone seconded and the motion passed unanimously. A motion was made by Commissioner Carter, seconded by Commissioner Stone to uphold the Planning Commission recommendation and approve the annual update recognizing the nine (9) Findings of Fact in the affirmative. There was an approximate 86% increase. The "Joint and Several" liability law was a factor in the increase. • Deductible options were discussed. • WLAD: Washington Law against Discrimination 8:30 a.m. — 9:00 a.m. K McCrae, Prosecuting Attorney's Office Update Pursuant to RCW 42.30.110(1)(i), Commissioner Jones called an Executive Session to order at 8:30 a.m. to go until 8:40 a.m. regarding Litigation. In attendance were Commissioners Carter, Stone and Jones, Shane Heston, Trask Insurance, Rebekah Kaylor and Barbara Duerbeck, Prosecuting Attorney's Office. Commissioner Jones closed the session at 8:40 a.m. Email retention policy draft was presented and discussed. They request the BOCC review the draft and bring back comments and questions to a future meeting. They will then send it out to departments/offices for review. Rebekah Kaylor discussed the Comprehensive Plan Amendment hearings. (To be brought back to the BOCC at a later meeting) • Giving the proponent time to discuss their application. More than 3 minutes could be allowed.
