MONDAY, NOVEMBER 13, 2023 The Grant County Commissioners session began at 9:00 a.m. with all Commissioners in attendance. 8:00 a.m. 8:30 a.m. S Castro (A Booth), Public Works Update Pursuant to RCW 42.30.110(1)(g) Commissioner Jones called an Executive Session to order at 8:01 a.m. to go until 8:11 a.m. regarding Job Applicant/Evaluation. In attendance were Commissioners Carter, Stone and Jones, Sam Castro and Andy Booth, Public Works and Decorah Anderson -Cook, Human Resources Director. Commissioner Jones closed the session at 8:11 a.m. 8:30 a.m. — 8:45 a.m. Central Services Weekly Update • There was a bid protest against their recent bid opening. 8:45 a.m. — 9:00 a.m. Development Services Weekly Update 9:00 a.m. —10:00 a.m. Open Record Public Hearing, Unified Development Code Amendments The Commissioners held an Open Record Public Hearing to consider four applications for amendments to the Unified Development Code. Jim Anderson -Cook, Deputy Director of Development Services, went through the applications. File #P 23-0093 (UDC Amendment) & P 23-0097 (SEPA) from the County of Grant, Washington. The applicant has applied requesting a Unified Development Code amendment repealing Chapter 24.16 — Flood Damage Prevention. The proposed changes are Countywide. At their regularly scheduled public hearing on October 4, 2023, the Grant County Planning Commission conducted an open record public hearing to consider files P 23-0093 & P 23-0097. The Planning Commission unanimously recommended approval of the proposed Unified Development Code amendment. Mr. Anderson -Cook stated this is a repeal of Ch. 24.16 out of the flood damage prevention of the UDC to Title 14 of the Grant County Code. A motion was made by Commissioner Stone, seconded by Commissioner Carter, to close the public comment portion of the hearing. The motion passed unanimously. A motion was made by Commissioner Stone, seconded by Commissioner Carter to uphold the Planning Commission recommendation and approve the UDC Amendment recognizing the six (6) Findings of Fact in the affirmative. The motion passed unanimously. File #P 23-0094 (UDC Amendment) & P 23-0097 (SEPA) from the County of Grant, Washington. The applicant has applied requesting various amendments to sections of the Unified Development Code correcting inconsistencies with State Statute, typographical errors, and changes in policy. The proposed changes are Countywide. At their regularly scheduled public hearing on October 4, 2023, the Grant County Planning Commission conducted an open record public hearing to consider files P 23-0094 & P 23-0097. The Planning Commission unanimously recommended approval of the proposed Unified Development Code amendment. This also recognizes certified park model RVs per WA State L&I as permitted to be used as permanent dwelling units in allowable zoning districts if permanently connected to foundation systems and utilities. This was not defined previously and is now being added (Crescent Bar RV Park, Blue Lake RV Park). Discussion ensued. This also cleans up exemptions for SEPA (what is exempt and non-exempt). And filler excavation of 500 cy is SEPA exempt. Change of proposed docketing cycle for UDC changes, Comp Plan Changes and Zoning Changes. They are proposing changes beginning January 1 to June 30 each year. After June 30t", docket cycle is closed and will be proposed to the Board of County Commissioners and to be adopted by December 31 each year. A motion was made by Commissioner Carter, seconded by Commissioner Stone, to close the public comment portion of the hearing. The motion passed unanimously. A motion was made by Commissioner Carter, seconded by Commissioner Stone to uphold the Planning Commission recommendation and approve the UDC Amendment recognizing the six (6) Findings of Fact in the affirmative. The motion passed unanimously. • File #P 23-0096 (UDC Amendment) & P 23-0097 (SEPA) from the County of Grant, Washington. The applicant has applied requesting an amendment of the Unified Development Code Chapter 23.08.020 to allow Accessory Dwelling Units (ADUs) in certain residential zoning districts within Grant County. The proposed changes are Countywide. At their regularly scheduled public hearing on October 4, 2023, the Grant County Planning Commission conducted an open record public hearing to consider files P 23-0096 & P 23-0097. The Planning Commission recommended approval of the proposed Unified Development Code amendment with one member voting against the proposed amendment. They are proposing to allow accessory dwelling units in certain residential zoning districts and remove the guest house provision in the code and remove the extended family living provisions within the code. The areas include unincorporated GC and those areas underneath a City UGA. Discussion ensued. A motion was made by Commissioner Stone, seconded by Commissioner Carter, to close the public comment portion of the hearing. The motion passed unanimously. A motion was made by Commissioner Stone, seconded by Commissioner Carter to uphold the Planning Commission recommendation and approve the UDC Amendment recognizing the six (6) Findings of Fact in the affirmative. Discussion ensued. The motion passed unanimously. • File #P 23-0092 (UDC Amendment) & P 23-0097 (SEPA) from the County of Grant, Washington. The applicant has applied requesting an amendment of the Unified Development Code Chapter 23.08.220 - Commercial Hospitality Establishments - to further define the difference between an Accessory Dwelling Unit and Transient Residences, Transient Guest Homes, and Bed & Breakfast Residences. The proposed changes are Countywide. At their regularly scheduled public hearing on October 4, 2023, the Grant County Planning Commission conducted an open record public hearing to consider files P 23-0092 & P 23-0097. The Planning Commission unanimously recommended approval of the proposed Unified Development Code amendment. A motion was made by Commissioner Carter, seconded by Commissioner Stone, to close the public comment portion of the hearing. The motion passed unanimously. A motion was made by Commissioner Stone, seconded by Commissioner Carter to uphold the Planning Commission recommendation and approve the UDC Amendment recognizing the six (6) Findings of Fact in the affirmative. The motion passed unanimously. 10:00 a.m. —10:30 a.m. Commissioners Roundtable -Miscellaneous Discussion • Review of Consent Agenda Items o Renew Item 11- out of state travel for Judge Gwinn o Treasurer Item 15 —Assessor is in favor of it. • Commissioner District Updates o DS updated everyone on ARPA requests. He notified all approved applicants that reimbursements will be delayed due to employee changes within our office. MACC funding, they will put forth 50% of the request, ARPA will fund the other half. Constituent contacted him about fireworks who wanted to start the discussion now. The Constituent feels fireworks should be tied to the county burn ban. Health District request to increase funding — the state increased their funding. They mentioned an RCW that the county should be taking care of their funding. The county must fund everything related to TB. Meeting with Health District scheduled for December 4, 2023 at 11:30 a.m. o CC stated Bonnie Helvey with ARFS came in to discuss issues related to unwanted and abandoned animals. She also visited a new steel manufacturing plant in Quincy • Tom Gaines stated that the Fairgrounds fence was hit yesterday (purple gate area), this is the fourth time in 2 months. • Commissioner Stone discussed his calls to the Department of Revenue and the RCW stating taxing districts must share their cash balances each year during levy time. Melissa McKnight will send the email to the taxing districts with this notice. In the future, she will send this notice out each September with this requirement. This is a commissioner/RCW requirement, not Assessor. • Commissioner Stone asked about the progress on the email retention policy. Rebekah Kaylor will follow up with Kevin McCrae. • Commissioner Stone asked for update on the morgue (none) and for the Animal Outreach building. Commissioner Jones is still working on this. 10:30 a.m. —11:30 a.m. Sister City Exchange Meeting In attendance: Bonnie Valentine via webex (Port of Royal) was instrumental in the program and thought the program was great; Rachelle Lange via Webex (Grant County Economic Development Council) Pat Boss representing Ports of Mattawa, Coulee City, Warden, Royal City and Quincy. He likes the program for the students but wants to make sure the ports and businesses are having business to business interactions. The Grant County Economic Development Council has a big part also. Rachelle stated Alan Peterson (EDC) could participate again as he is part of the Small Business Administration for our area. The Japanese Consulate General was instrumental in the past youth exchange. Commissioner Stone asked for the connection between the business component and the youth exchange. Commissioner Carter believes if we don't host their youth, the sister city relationship could dwindle. If Grant County hosts students, will businesses have a better connection? Follow up meeting was scheduled for 11/28/23 at 4pm. 11:30 a.m. —12:00 p.m. M McKnight, Assessor's Office Update Melissa McKnight discussed the 2024 levy rates. Darryl Pheasant discussed mental health and veterans fund rates. Another meeting has been scheduled for 11/20/23 at 9:00 a.m. Quincy Metropolitan Park District — This passed the recent election. Commissioner Carter will be the commissioner to sit on this board as it is in her district. Tom Gaines will discuss this topic with him afterwards. Public Works Engineer hires, he knows they are in need of people and recommends allow them to hire. • Approval of Agenda A motion was made by Commissioner Carter, seconded by Commissioner Stone, to approve the agenda as presented. The motion passed unanimously. • Correspondence (i.e. Emails that have come in that need response, letters of support etc.) o DS: Special Events ordinance email from Barbara Duerbeck. He's requesting the BOCC read her email. o CC: Animal control discussion with Bonnie Helvey — meeting scheduled for 11/20 during the Sheriff's Update o Email from Clear Risk re: Situational Training. There are 4 more spots that can be opened. The Board requested the Clerk to staff to fill those spots. • Commissioners Roundtable — Miscellaneous Discussion o Cell Service at the Gorge Amphitheater. Look for federal funding. Tom Gaines believes the 3 major cell companies are utilizing the same cell towers. Emergency services need to have uninterrupted service. • Consent Agenda — (Items 1 through 15) All items are considered routine and will be enacted by one motion of the commissioners with no separate discussion. If a separate discussion is desired, that item may be removed and placed under Board Discussion/Decision. A motion was made by Commissioner Stone, seconded by Commissioner Jones, to approve the agenda as presented. The motion passed unanimously. AUDITOR'S OFFICE 1. Payment of vouchers certified by the auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the auditing officer as required by RCW 42.24.090, as recorded on a listing, and made available to the Board. (In the amount of $569,,423.75) COMMISSIONER'S OFFICE 2. Approval of October 23, 2023, Minutes. 3. Special occasion liquor license applications for the Columbia Basin Cancer Foundation and their event being held February 02, 2024, at the Grant County Fairgrounds 4-H building from the Washington State Liquor and Cannabis Board. DISTRICT COURT 4. Request to amend previously approved purchase of Sharp Printer from Kelly Connect. The previously approved amount did not include taxes. The new total to be approved is $6,906.00. FACILITIES AND MAINTENANCE 5. Request to proceed with Convergint Technologies for the door badge system software upgrade for the Elections Department in the amount of $7,107.79. Out-of-state travel request for Suzi Fode to attend the Federal Grant Orientation in Washington, D.C., January 28, 2024, through February 1, 2024. The total cost of travel is $1,916.00. PUBLIC DEFENSE 7. Contract with West Law (Thomson Reuters) to provide patron access for computer research for (1) terminal, per RCW 27.24 the law library must be maintained. The term of agreement is ongoing over 3 years with the cost as follows: Year 1- $1,,008.00 monthly, Year 2- $1058.40 monthly, Year 3- $1.,111.32 monthly. 8. Washington State Office of Public Defense (OPD) Agreement No. ICA24014 for the distribution of grant funds in the amount of $92.,818.00 for the purpose of improving the quality of public defense services in Washington State counties. The total cost of travel is $3,055.00 and will be funded from 108.150. 11. Out-of-state travel request for Brian Gwinn to attend the National Drug Court Institute (NDCI) Training in Oklahoma City, OK., November 27, 2023, through December 2, 2023. Pursuant to RCW 42.30.140(4)(a) Commissioner Jones called an Executive Session to order at 2:00 p.m. to go until 2:30 p.m. regarding Negotiations. In attendance were Commissioners Carter, Stone and Jones, Desiree Ochocinski, District Court and Decorah Anderson -Cook and Gina Saldana, Human Resources Director. Ms. Ochocinski left the meeting at 2:15 p.m. The session was continued to 3:00 p.m. and then again until 3:15 p.m. Commissioner Jones closed the session at 3:15 p.m. 3:30 p.m. — 4:00 p.m. Commissioners Work Session (Anticipated Executive Session) • DS: Meals /Per Diem rules —Development Services sent email about Christmas event for Planning Commission. How does this compare to the Fair Appreciation Dinner? The Board requested the Chair speak with Chris Young to include a training at this dinner. • DS: HR to form questions to bring forth to Elected Officials regarding salary survey. BOCC has not seen them yet. 4:00 p.m. -5:00 p.m. TGaines, Jail Update Meeting In attendance: Marc Seeberger, Vince Campanella, Will Rutherford, Tom Gaines, Joe Kriete and Phil Coates. The original cost presented was $160 million. Proposed cuts were discussed. Sheriff Kriete stated he has been approached by 3 counties who are interested in purchasing "bed spaces". Commissioner Jones requested Darryl Pheasant, Treasurer, to look into Bond numbers. Potentially build in phases? Begin only with the jail portion, not the admin staff, courts, etc. Sheriff Kriete is in favor of making the jail the priority and moving the rest at a later date. Pursuant to RCW 42.30.110(1)(c) Commissioner Jones called an Executive Session to order at 4:59 p.m. to go until 5:05 p.m. regarding Real Estate Sale.
