"OV 2023 7� P� BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON AN ORDINANCE AMENDING THE ORDINANCE No. 23- O�j� -CC GRANT COUNTY UNIFIED DEVELOPMENT CODE CHAPTER 23.08 PERFORMANCE AND USE STANDARDS TRANSIENT RESIDENCE REQUIREMENTS OF SECTION 23.08.220, CHAPTER 25.02 DEFINITIONS AND ALLOWABLE USE TABLES IN CHAPTER 23.04 WHEREAS, the Grant County Board of County Commissioners previously adopted Grant County Ordinance No. 02 -192 -CC Performance and Use Standards — Hospitality Commercial Establishments; and WHEREAS, the RCW 36.70 authorizes the county legislative authority to adopt, by appropriate resolution or ordinance, regulations designed to promote the public health, safety, and general welfare of its citizenry; and WHEREAS, the RCW 64.37.010 defines a short-term rental as a lodging use, that is not a hotel or motel or bed and breakfast, in which a dwelling unit, or portion thereof, that is offered or provided to a guest by a short-term rental operator for a fee for fewer than thirty consecutive nights. The Unified Development Code defines short-term rentals as transient rentals and are considered and regulated the same; and WHEREAS, the RCW 64.37 — Short -Term Rentals contain requirements regarding taxes, consumer safety, rental platforms, and liability insurance requirements and these amendments are necessary to incorporate these requirements as part of Grant County's Development Regulations; and WHEREAS, the Grant County Code, Title 15 — Fire Protection and Administration contains the fire and life safety requirements for transient rentals; and WHEREAS, the Grant County Board of County Commissioners understand that transient residences are used for commercial purposes and are clearly different from permanent accessory dwelling units and require unique requirements due to their transient nature and use; and WHEREAS, the Grant County Planning Commission conducted an open record public hearing regarding the proposed amendments to its Development Regulations sections 23.08.220 (b) and (c), Chapter 25.02 Definitions, and Chapter 23.04 on October 4h, 2023 and provided for public notice and comment and recommended approval to the Board of County Commissioners; and WHEREAS, the Board of County Commissioners for Grant County conducted an open record public hearing regarding the proposed amendments to its Development Regulations, sections 23.08.220 (b) and (c), Chapter 25.02 Definitions, and Chapter 23.04 on November 13th, Transient Residences Ordinance 2023 2023 and provided for public notice and comment to consider the amendments to the Unified Development Code to better regulate transient residences. NOW, THEREFORE, BE IT HEREBY ORDAINED, THAT the Board of County Commissioners for Grant County, Washington hereby adopt by resolution the amendments to the Unified Development Code, Section 23.08.220 and Chapter 25.02 as identified in Attachment A and Chapter 23.04 as identified in Attachment B. A bed and breakfast residence shall not occur in the same building with any other type of transient accommodation; (2) No more than three (3) sleeping rooms shall be available for the accommodation of bed and breakfast residence guests_; Bed and Breakfast Residences that exceed two (2) Ruestrooms shall be equipped with a fire sprinkler system per the WA State Residential Code. Chapter 25.02 DEFINITIONS Battery Exchange Station: a fully automated facility that will enable an electric vehicle with a swappable battery to enter a drive land and exchange the depleted battery with a fully charged battery through a fully automated process, which meets or exceed any standards, codes and regulations set forth by chapter 19.27 RCW and consistent with the rules adopted under 19.27.540. Bed and Breakfast Inn: a hospitality commercial use containing four to fives guest rooms or lodging units without cooking facilities, which provides overnight accommodation and breakfast meals in an owner- or proprietor -occupied existing single-family residence, including additional legal structures that may include facilities for banquets, weddings and similar small parties. Bed and Breakfast Residence: a hospitality commercial use containing one to three guest rooms without cooking facilities, which provides overnight accommodation and breakfast meals in an owner- or proprietor -occupied existing single-family residence. Short Plat: a document consisting of a map of a short subdivision together with written certificates, dedications, and date. Short -Term Rental: means a lodging_use, that is not a hotel or motel or bed and breakfast, in which a dwelling unit, or portion thereof, that is offered or provided to a guest by a short-term rental operator for a fee for fewer than thirty (30), consecutive nights. Side Street: a street, public or private which abuts a property corner in addition to another street and which intersects the other street at a property corner. In determining the front yard and building line, either street abutting the corner property may be considered the flanking street.
