HomeMy WebLinkAboutResolution 23-121-CC0 October 6, 2023 Grant County Commissioners RE: Sale of Tax Title parcel through Private Negotiation 01-0776-000 and 06-1167-000 I received Tax Title applications for an offer to purchase parcels 01-0776-000 and 06-1167-000 for $1,200.00 and $300.00. 1 did negotiate for a higher bid to 700.00 on parcel 06-1167-000. Parcel 06- 1167-00 was in last year's Foreclosure Sale where the starting bid was around l,O43.55but did not get bid on. Parcel 01-0776-000 became a tax title parcel in 1976. The applicant is not an adjacent property owner for either. Asallowed under R[VV3G.35.l5O(l)(b),|would like bodispose ofParcel O1-O77G-UOO for being next to the canal and not practical to build due to its physical characteristics and I would like to dispose of Parcel 06-1167-000 per (1)(d) where no acceptable bids were received at the attempted auction that was held less than ayear ago. | would like sellthese two parcels for $1,9OO.00plus the cost of deed, affidavit fees and recording fees and with this offer through private negotiation instead of going through the public auction process toget these parcels back onthe tax rolls. RCW 36.35.120 allows the County to sell real property acquired by tax foreclosure when it is found to be in the best interest of the County. B. RCW 36.35.120 requires the County to establish the minimum price for each unit of tax title property and to determine whether the sale will be for cash or whether a contract will be allowed. C. RCW 36.35.150 allows the County to sell tax title property by direct negotiations, without a call for bids, under certain circumstances. Direct sale for a price not less than the principal amount of the unpaid taxes is authorized when no acceptable bids were received at the attempted public auction of the property for any of the following cases (a) when the sale is to any governmental agency and for public purposes; (b) when the county ledslative authori determines that it is not practical to build on the P roperdue to the physical characteristics of the property or lemal restrictions on construction activities on the proper (c) when the property has an assessed value of less than five hundred dollars and the property is sold to an adjoining landowner; or (d) when no acceptable bids were received at the attempted public auction of the property, if the sale is made within twelve months from the date of the attempted public auction. D. Parcel 01-0776-000 was acquired through a tax foreclosure auction held in 1976. E. The County Treasurer has informed the Board of County Commissioners that there were no bids for the property identified as Parcel 01-0776-000 at the tax foreclosure sale held in 1976 (no further details available on this sale) F. An Application for Re -Sale of Tax Title Property and an email request has been received by the County Treasurer from Brent Barclay. G. Parcel 01-0776-000 is being sold "as is" "buyer beware" with no warranties by the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Grant County, Washington, as follows: 1. The Board finds it is in the best interest of the County to sell the following real property: Parcel 01-0776-000 located in Grant County, and further described in attached Exhibit A.
