HomeMy WebLinkAboutResolution 89-038-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION NO. 89 -38 -CC RESOLUTION ADOPTING RULE AND PROCEDURES FOR THE GRANT COUNTY PLANNING COMMISSION WHEREAS, Rules and Procedures appropriate for the Grant County Planning Commission have been prepared, and WHEREAS, the Grant County Planning Director has submitted these Rules and Procedures for approval, and WHEREAS, a public hearing was conducted on February 1, 1989 and continued to April 5, 1989, and WHEREAS, there exists a need to address Rules and Procedures to be followed by Planning Commission members, and WHEREAS, by adopting the Rules and Procedures as proposed it appears to be in the best interest of the citizens of Grant County to carry out their necessary functions and duties as Planning Commission members appointed by the Board of County Commissioners, NOW, THEREFORE BE IT RESOLVED, that the Grant County Board of County Commissioners concurs with and endorses the Rules and Procedures as recommended for approval by a majority vote of the Planning Commission members, constituting a quorum vote. DONE THIS 250 DAY OF April ATTEST: C f the Board wmnnamone� Constituting the Board of County Commissioners of Grant County, Washington RULES OF PROCEDURE OF THE PLANNING COMMISSION OF GRANT COUNTY, WASHINGTON We, the members of the Planning Commission of Grant County, Washington, authorized by RCW 36.70, Laws of Washington and duly appointed by the Board of County Commissioners for Grant County, do hereby adopt, publish, and declare the following rules of procedure: 1. The Official name shall be, "The Grant County Planning Commission". 2. The official seat of the Planning Commission shall be the County Courthouse in Ephrata, Washington , and meetings shall be held there on the first.,_,_ Wednesday of every month except on such occasion, and at such times as the Planning Commission may by a majority vote otherwise direct. 3. The Officers of the Planning Commission shall consist of a Chairman, Vice Chairman and Secretary and such other officers as the Planning Commission may by majority vote, approve and appoint. 4. The Chairman shall preside over the meetings of the Planning Commission and exercise all the powers usually incident of the office; retaining, however, to himself as a member of the Planning Commission, the full right to have his own vote recorded in all deliberations of the Planning Commission. 5. The Vice -Chairman shall, in the absence of the Chairman from any meeting, perform all the duties incumbent upon the Chairman. The Chairman and Vice -Chairman, both being absent, the members present may elect for the meeting a temporary Chairman who shall have full powers of the Chairman during the absence of the Chairman and Vice -Chairman. 6. The Secretary may be a member of the Planning Commission or otherwise, as the Planning Commission may determine.. The secretary shall keep the seal of the Planning Commission, if one is adopted, and shall cause it to be affixed to the instruments under the direction of the Planning Commission. The Secretary shall keep a record of all meetings and its committees when requested to do so and these records shall remain the property of the Planning Commission and may be retained at such office as the Planning Commission may direct. In the absence of the Secretary from any meeting, a secretary pro -tem shall be appointed. 7. The officers shall serve for a period of one year, serving until a successor has been elected. S. In the event of a member being absent for three (3) consecutive regular meetings, or being absent from 25% of the meetin without being excused by the Commission, the Chairman shall, at tie discretion of the Commission, request that the Chairman of the Board of County Commissioners ask for his resignation. 9. The recommendation to the Board of any official control or amendments thereto by the planning agency shall be by the affirmative vote of not less than a majority of the total members of the commission. 10. The members of the Planning Commission, shall consist of nine members, % three appointed from each of the three Commissioner Districts and while acting as members of the Planning Commission shall serve without compensation. 11. The sessions of the Planning Commission shall be open to the public, except during executive sessions. All decisions of the Planning Commission shall be made during public sessions. No member of the Planning Commission shall make any statement to the public tending to indicate his opinion or that of any other, member of the Planning Commission on any subject that has not been formally decided upon. 12. Upon the filing of an application for a zone change or preliminary plat, it shall be placed on the agenda for the next regularly scheduled meeting of the Planning Commission. Provided, however, that no application shall be placed on the agenda until the requirements of the State Environmental Policy Act (SEPA) have complied with. Notices of hearing shall be placed in the newspaper of general circulation in the area where the application is proposed as well as the legal newspaper of the county, stating the time, place_ and purpose of the hearing. Applications may be postponed by the Planning Commission or with -drawn by the applicant at any time before a decision has been reached. 13. After an application has been acted upon, it shall not again be considered on the same grounds within a period of one (1) year from the date of the Planning Commission decision. However, should the Planning Commission decide by a majority vote that there exists sufficient new evidence or change of circumstances which could not reasonably have been presented at previous hearings, and application may again be considered within said period of one year. If such application is to be reconsidered, a new application and an additional filing fee, when applicable, shall be submitted. Official notice of such public hearing shall be given as with the original case. 14. The Planning Commission shall include Findings of Fact supporting any action upon which it is authorized to act. A clear description of conditions necessary to carry out the spirit and intent of the Comprehensive Plan, the Grant County Platting and Subdivision ordinances, and the Zoning Ordinance for Grant County, shall be included with all approved zone changes, and preliminary plats. The Secretary shall notify the applicant by mail of the result of the Planning Commission's actions. 15. Any person aggrieved by tho decision of the Planning Commission may appeal such decision to the Board of County Commissioners by filing r notice in writing- within ten (10) days of the date of the action being appealed. At least a ten (10) day notice shall be given by the Secretary to the Planning Commission and to the adverse party of record in the case, setting forth the time and place at which the appeal will be considered. 16. These Rules of Procedure may be amended or modified by a majority vote of the entire membership, provided that such amendment be presented in writing at any regular meeting, or a special meeting called for this particular purpose, and action taken thereon at a subsequent regular meeting of the Planning Commission.
