HomeMy WebLinkAboutOrdinance 11-061-CCBOARD OF COUNTY COMMISSIONERS Gran�: County, Washington ORDINANCE Noe 11- (�(� � -CC An ordinance relating to an amendment of the Grant County Zoning Map, changing the zoning of one approximately 0.58-acre parcel owned by Ronald & Bernice Stump from Urban Residential4 to Urban Commercial2. The site address of the subject parcel is 5958 Turnkey Road NE, Moses Lake, WA. It is known as Lot 1 of Turnkey Estates #1, and is located north of the intersection of Patton Blvd. IvTE and 22"� Avenue NE, and an the NW quartex of Section 4, Township 19 leTorth, Range 28 East, WM, Grant County, �VA (Parcel #12-1089-002). Recatals: WHER�AS, in compliance with the Growth Management Act of 1990, Grant County adopted a Comprehensive Plan in September of 1999, and WHEREAS, Grant County adopted the Unified. Development Code (UDC) in October of 2000, establishing official zoning districts in conformance with the Comprehensive Plan, and WHEI�EAS, the Unified Development Code Chapter 25.12 "Legislative Actions" § 030 �stablishes a process for making Amendments to the Comprehensive Plan, and WHEREAS, the Unified Development Code Chapter 23.04 "Zoning Districts" § 150 establishes a process for Minor Zoning Amendments (Minor Rezones) which are consistent wi�h the goals and policies of the Comprehensiv� Plan, and WHEREAS, on May 9, 2006, Resolution 06-158-CC "A Resolution Relating to Comprehensive Planning in Grant County in Accordance with the Washington State Growth Management Act (RCW 36.70 A) and amending the September, 1999 Comprehensive Plan" was signed by the Grant County Board of Commissioners, and WHEREAS, Resolution 06-158-CC included approval of a land use designation change (CPA #OS-4297) from High Density Residential (Urban Residential4) to Urban Commercial, and Ronald & Bernice Stump - Minor Zone Change - BoCC Ordinance - page 1 WHEREAS, an application (#11-5571) for a Minox Zone Change has been processed in accordance with the UDC Chapter 23.04 66Zoning Districts", Chapter 24.04 `<SEPA", and Cha�ter 25.44 "Permit Application Review Procedures,>' and WlEIEREAS, the Grant County Pla�n�ng Commission held an Open Record Public Hearing regarding this proposed Miraor Zone Change, during their regular meeting on Ju1y 6, 2011, after which t11ey voted iu�animously to recornmend appraval of this Mi�or Zone Change, and W�IEREAS, t�e Grant County Board of Commissioners held a Closed Record Public Hearing regarding this praposed Minor Zane Change on August 8, 2Q1 l, and WH��tEAS, after cansider�tioz� o� the Planning Commissian's report and staff comments, the Board af Cpunty Com�nissio�ers voted to approve this Minor Zone Change, and WIEIEY2EAS, the Grant Caunty Soard of Commissioners have established the following ten "Findings of Fact" supporting th.air appraval of this Minar Zone Chat�ge: 1) The proposed rezone will not be contrary to the intent or purpas�s and regulations of the Grant County Cade or tl�e Comprehensive Plan; 2) The prapex-ty in question is suitable for uses allowed under the proposed zaning dist��ict; 3) Uses allawed under the proposed zQl�e change are compatible with neighboring land uses; 4} T1ie proposed rezone ean be served by adequ�te facilities including access, fire protection, water, storm-water control, and sewage disposal facilitics; 5} Substantial changes do ex�si tc� warrant an amendment to t11e current zaning d'zstrict; 6} A public need does eYist for the proposed rezone. Public need sllall mean. that a valid public purpose, for whicl.l the coznpre�.ensive plan and this chapter have been adopted, is served by the praposcd rezone; i) Tl�e praposed rezone will nat result in significant adverse iinpacts on t%e huinan ar natural environments that cannat ba mitigated by conditio�s of approval; 8} The cumulative impact of addiiianai requests fc�r. Lilce actions (the total of the rezones over time ar space) will no� produce significant adverse effects to the environment that cannot be mitigated by conditians af approval; 9} The pedestrian and vehicular traffic associated with the rezone will nat be hazardaus to existing and anticipated traific in the neighborhood; and Ronald & 13ernice Sriiu�p - Minor Zone Changa �� BaCC Qrdinance �� page 2 10) The proposed zoning d.istrzct cloes not include any allowable use or activity that would rasult in the location of an incompatible use adjacent to an airport or airfield (RCW 36.70). NOW, THEREFORE, SE IT ORDAINED, that the Grant County Board of Commissioners hereby rescind the cLirrent zoning designation of Parcel #12-1089-002 on the Official Zoning Map, and BE IT FURTHER ORDAINED, that through the adoption of this Ordinance, the Grant County Board of Commissioners approve a Minor Zone Change for Parcel #12-] 089�002 frorn Urban Residential4 to Urban Commercial2, and BE IT FURTHER.
