A "Company" becomes a "Training Agent" of the INLAND NORTHWEST CHAPTER
ASSOCIATED GENERAL CONTRACTORS HEAVY EQUIPMENT OPERATORS APPRENTICESHIP
COMMITTEE when approved as such by the Committee. Training agents may participate in the
training services administered by the Associated General Contractors Open Shop Apprenticeship
and Journeyman Training Trust Fund by being signatory to this agreement and contributing
annually to the Trust as described below.
The Trust was established in 1996 as a non -vesting welfare and benefit trust fund for the
primary purpose of funding open shop craft apprenticeship programs. Funds over and above
those directed to apprenticeship are made available for journey -level upgrade training in
accordance with policies adopted by the Trustees for the distribution of such funds if they exist.
The Fund is provided for the "exclusive benefit participants" and is intended to meet all applicable
requirements (if any) of Section S01 (a) of the Internal Revenue Code and the Employee
Retirement Security Act of 1974 ("ERISA"), as amended.
A. CONTRIBUTION AGREEMENT:
The employer/training agent agrees to pay an annual fee based upon the maximum number of
journeyman operators employed at any one time during the year, excluding supervisory personnel,
according to the following schedule:
Level 1
1-5 journeyman
$3,500/yr.
Level 2
6-10 journeyman
$7,000/yr.
Level 3
11-25 journeyman
$11,000/yr.
Level 4
26-50 journeyman
$18,000/yr.
Level 5
51-75 journeyman
$24,000/yr.
Level 6
76-100 journeyman
$30,000/yr.
1. The agreement applies to all work, both public and private, performed by members
of the Inland Northwest Associated General Contractors. Fees are due and payable
by the first of the year/no later than the end of the first quarter unless other
payment arrangements are made.
2. Either party may cancel this agreement upon written notice to the other and such
cancellation shall be effective 30 days after receipt of said notice. In the event of a
cancellation by one of the parties, hereto, the obligation for payments under this
agreement shall continue through the effective date of cancellation.

3. This exhibit is a part of the Joinder Agreement currently in force between the parties
and supersedes any previously signed Joinder Agreement.
4. Training agents whose Joinder Agreement has been cancelled by the Trust for non-
payment are not eligible to enter into a new Joinder Agreement with the Trust for
six (6) months after the effective cancellation date of the old Joinder Agreement.
B. CONTRIBUTION POLICIES
1. CONTRIBUTION REPORTING FORMS: The Trustees shall create and make available,
at the expense of the Trust Fund, contribution reporting forms for the use of
participating employers in making their contributions.
2. CONTRIBUTION DUE DATE: All contributions shall be due by January 1St and no later
than the end of the first quarter of the year unless other arrangements have been made.
3. DELINQUENT CONTRIBUTIONS: A participating employer shall be considered to be
delinquent in the payment of contributions if he fails to submit a contribution reporting
form, and the contributions detailed therein, by the close of the business day on the due
date.
The Trustees shall undertake reasonable efforts, at the expense of the Trust Fund, to
collect know delinquent contributions and related claims.
4. LIQUIDATED DAMAGES AND INTEREST: It is recognized and acknowledged by all
parties, including the participating employers, that the prompt and accurate reporting
of eligibility and payment of contributions is essential to the maintenance of an
employee benefit trust fund and the benefit plans and that it would be extremely
difficult, if not impossible, to fix actual expense and damage to the Trust Fund that
would result from the failure of a participating employer to submit necessary reports or
to pay the required contributions within the time provided. Therefore, if any.
participating employer shall be delinquent in the payment of contributions, such
employer shall be liable, in addition, for liquidated damages of ten percent (10%) of the
amount of the contributions which are owed or fifty dollars ($50.00), whichever is
greater, providing payment of all amounts owing the Trust as the result of the
delinquency will be assessed. Additionally, if an employer is found not to be delinquent,
but has failed to timely file the contribution reporting form required by the Trustees,
such employer shall be liable for liquidated damages of one hundred dollars ($100.00).
The delinquent contribution shall bear interest at the rate of twelve percent (12%) per
annum from the date due until paid. The Trustees shall have the authority, however, to
waive all or part of the liquidated damages or interest for good cause shown.
S. ATTORNEY FEES AND COURT COSTS: Further, in the event the Trustees place the
account in the hands of legal counsel for collection, the delinquent employer shall be
liable for reasonable attorney fees (with a minimum of $100.00), and for all reasonable

costs incurred in the collection process, including court fees, audit fees, etc.. The
Trustees shall have the authority, however, to waive all or part of the attorney fees or
collection costs for good cause shown.
6. VENUE OF COLLECTION ACTIONS: In the event a collection suit is initiated, venue of
such suit may be laid in a court of competent jurisdiction (federal or state) in the
county, district, or borough in which the Trust Fund has an office, at the option of the
Trustees.
7. PROTECTION OF EMPLOYEES IN CASES OF DELINQUENCY: To protect participating
employees and beneficiaries in situations where participating employees may be
denied eligibility credits or benefits because their employer is delinquent in the
payment of contributions, the Trustees shall have the authority to extend eligibility
credits to such employees or to direct the payment of benefits to them, or to their
beneficiaries, in whole or in part, as they may determine. The extension of eligibility
credits or the payments of benefits shall not, however, release the delinquent employer
from the responsibility for payment of the contributions owed.

Alternate Selection Process
The following training agent subscribes and agrees to comply with the requirements in
the apprenticeship program standards registered as Inland Northwest Associated
General Contractors Heavy Equipment Operators Apprenticeship #560 with the
Washington State Apprenticeship and Training Council (WSATC), hereby agrees, in
consideration of their participation in the registered program:
1. To comply with the Equal Employment Opportunity (EEO) requirements of the
WSATC; the U.S. Department of Labor's Equal Opportunity regulation 29 CFR
Part 30; and the pledge, EEO plan and selection method filed by the name
Apprenticeship Committee and approved by the WSATC and the Office of
Apprenticeship, Training, Employer and Labor Services (OATELS), as being in
conformity with the requirements of the EEO Plan of the WSATC, WAC 296-05,
RCW 49.04, and 29 CFR Part 30; and
2. To have their name removed as a training agent from the above named program
after a WSATC and/or OATELS finding of failure to adhere to the above EEO
requirements, and
3. Notification of removal of as a training agent from participation in the above
named apprenticeship program to be furnished to the Apprenticeship Section,
Department of Labor and Industries, by the Apprenticeship Committee.

contractors or construction employers and -who do not employ on-site labor. Associate

Visiting Contractors
Visiting Contractor firms are defined as contractors from out of the area who have
won or are bidding on work within our chapter's territory. This membership is limited
to a 3 -year contract. First year's dues are $1,500.00, second year is $1,750.00 and the
final year is $2,000.00. If your scope of work exceeds 3 years, then your firm can join
the Inland Northwest AGC.
Small Business Introductory Rate
The AGC is pleased to offer a Small Business Introductory Rate of $450.00 for new DBE
firms. This is designed for those smaller companies that have not been a part of the
AGC in the past but would benefit by having access to our resources for training, safety
and networking.
To qualify for the Introductory Rate, all the following must apply:
• The company must be certified through the Office of Minority & Women -
Owned Business Enterprises or have submitted an application for
approval.
• The company is not, nor has been during the previous three years, a
member of any AGC Chapter.
