Vasquez, Clerk of the Board Tyler Lawrence, Associate Planner Public: See sign in sheet 1:00 p.m. The Commissioners held an Open Record Public Hearing to consider the recommendations from the Planning Commission to either approve or deny the 2019 Comprehensive Plan Amendment applications. Tyler Lawrence, Senior Planner for Development Services, stated they received 13 applications for this cycle. These applications were heard by the Planning Commission and these recommendations are being forwarded to the County Commissioners. 1:02 p.m. Willson Harwood File# P 19-0001 and P 19-0002 The applicant has submitted a Site Specific Land Use Re -Designation application requesting approximately 2.8 acres of the subject property be re -designated from Urban Commercial to Suburban Residential along with an application for a rezone from Urban Commercial 2 to Urban Residential 1. The subject site is located at 525 Beverly Burke Rd. SW, just north of I-90 in a portion of Section 6, Township 18 North, Range 24 East, W.M., Grant County, WA. The site is the NW corner of Parcel #20-1542-000. Commissioner Carter moved to close the public comment portion of the hearing. Commissioner Stevens seconded and the motion passed unanimously. The parcel has a current land use designation of Irrigated Agriculture. Y g Commissioner Stevens seconded and the motion passed unanimously. 1:11 p.m. James Forrest and George Waltho Dba FW Development File# P 19-0050 and P 19-0051 The applicant has submitted a Site Specific Land Use Re -Designation application requesting approximately 26 acres of the subject property be re -designated from Rural Residential I to Residential Low Density along with an application for a rezone from Rural Residential I to "Urban Residential 2. The proposal also seeks to expand the Urban Growth Area for the City of Ephrata. The subject site is situated at the end of Maringo Rd. in Ephrata, Washington. The property is located in the SW 1/4of Section 9, Township 21 North, Range 26 East, W.M., Grant County, WA. Parcel #20-1542-000. Commissioner Carter seconded and the motion passed unanimously. 1:13 p.m. Port of Moses Lake File# P 19-0060 and P 19-0061 The applicant has submitted a Site Specific Land Use Re -Designation application requesting approximately 634 acres be re -designated from Rural Remote to Urban Industrial as well as an expansion of the Urban Growth Area for Moses Lake to include the subject parcel. The applicant also proposes to rezone the property from Rural Remote to Urban Heavy Industrial. The applicant has also proposed to remove certain areas of the Grant County International Airport from the Urban Growth Area but still maintain its current land use designation and zoning designation. The subject site is located on the west side of the Grant County International Airport. The property is Section 19, Township 20 North, Range 28 East, W.M., Grant County, WA. Parcel #17-0983-000. The portions of parcels being petitioned for removal from the UGA. are from Parcel #s 17-1020-000, 17-0931-000 & 17-0991-000. Commissioner Stevens noted that the Planning Staff recommended denial of the project based on the number of acres involved. Kevin Richards, Western Pacific Engineering representing the Port of Moses Lake gave to the Board a packet with maps and analysis on the project and gave a PowerPoint presentation. He believes expansion of the UGA in this case is a good idea. Commissioner Carter clarified that the Planning Department recommended denial and the PlanningCommission recommended approval. Mr. Richards stated that they now have more pp information that the Staff wasn't privy to. Com just missioner Stevens mentioned the Board denied Quincy application. What makes Moses Lake different? Mr. Richards said they are not removing farm capacity and they are putting industry next to industry at the airport. Commissioner Taylor clarified that all of the property in the application are owned by the Port of Moses Lake. Commissioner Carter clarified also that the Port is no longer asking for property to be removed from the UGA. Commissioner Carter moved to close the public comment portion of the hearing. Commissioner Stevens seconded and the motion passed unanimously. 1:33 p.m. Row Crop LLC File# P 19-0065 and P 19-0066 The applicant has submitted a Site Specific Land Use Re -Designation application requesting approximately 61 acres be re -designated from Rural Urban Reserve to Urban Commercial as well as an expansion of the Urban Growth Area for Moses Lake to include the subject parcel. The applicant also proposes to rezone the property from Rural Urban Reserve to Urban Commercial. The subject site is located at 12115 Wheeler Rd. NE, on the south side of Wheeler Rd. NE approximately one (1) mile east of SR 17 N. The property is located in a portion of the NW 1/ of pp Y Section 19, Township 19 North, Range 29 East, W.M., Grant County, WA. Parcel #31-3169- 000. Planning Commission recommends approval and Development Services Staff recommends denial of the application. The land is currently being farmed. Jerry Benson, Row Crop LLC discussed his application and submitted maps and information for the Board. He said there is a railroad being proposed for the property and the usability is better for commercial than agriculture. Commissioner Carter moved to close the public comment portion of the hearing. The proposal site is comprised, of one parcel approximately 154.2 acres in size. The proposal site is located on the east side of Dodson Road, approximately 1/10 of a mile north of SR 26 W. The site is located the SW 1/ of S. 10, T. 16 N, R. 26 E, W.M., Grant County, WA (Parcel #21-1912-000). Anthony Jenks, proponent, discussed his project. Lakewood Enterprises, LLC File# P 19-0024 and P 19-0025 The applicant has submitted a Site Specific Land Use Re -Designation application requesting an approximately 8 acre parcel be re -designated from Rural Residential 1 to Irrigated Agriculture along with an application for a rezone from Rural Residential 1 to Agriculture. The subject site is located at 1209 Hwy 281 Spur, Quincy, WA, just north of I-90 in a portion of Section 29, Township 19 North, Range 24 East, W.M., Grant County, WA. #20-1358-008. Commissioner Carter seconded and then asked about the marihuana growing operation in the area. She asked if this was going to be an issue. Staff mentioned that this would remedy the current issues. The motion passed unanimously. Herring Farm NWQ, LLC File# P 19-0029 and P 19-0030 The applicant has submitted a Site Specific Land Use Re -designation application requesting the subject property be re -designated to Residential Low Density from Rural Residential 1 along with an application for a rezone from Rural Residential 1 to Urban Residential 2. The application also requests the Moses Lake Urban Growth Area be expanded to include this parcel. pp The proposal site is comprised of one parcel approximately 19.34 acres in size. The proposal site is located on the south side of Mae Valley Road, approximately 2/3 of a mile west of Westshore Drive NE. The site is located in a portion of the NW 1/ of S. 30, T. 19 N, R. 28 E, W.M., Grant County, WA (Parcel #17-0845-000). Danielle Escamilla, Western Pacific Engineering, passed out maps and information on the application. She stated that they had only received the _Land Use Capacity Analysis hours prior to the Planning Commission hearing so they were not able to provide it before the hearing. She provided a Sewer Reimbursement Agreement with Aho Construction in which the Herring Property is included. Commissioner Carter clarified that neither the Planning Department nor Planning Commission had the new information -until the Planning Commission hearing. 2:05 p.m. Staff answered the question about available buildable land and acres are in the UGA of Moses Lake and according to their land use analysis completed for the 2018 Comprehensive Plan Update, it has 5358 buildable acres. Required land to accommodate the 20year projected growth is 1979 acres. 2:07 p.m. Dan Herring discussed his project saying he believes his property -would be more suitable for a housing development. Commissioner Taylor stated the county is not in the business of straightening boundary lines. There is so much property on the inside of the UGA and people want to build outside. Kevin Richards 'questioned how much usable ground is available in the City? Utilities available, zoned properly, etc. Commissioner Carter moved to close the public comment portion of the hearing. The applicant also proposes to rezone the property from Agriculture to Urban Heavy Industrial. The proposal site is located on the south side of Rd. 11 NW approximately a quarter mile east of Rd. S NW. The Property is located in the NW 1/4of Section 12, Township 20 North, Range 23 East, W.M., Grant County, WA. Parcel #31-3263-000. Commissioner Stevens seconded and the motion passed unanimously. 2:15 p.m. Hintz Land LLC File# P 19-0055 and P 19-0056 The pp a licant has submitted a Site Specific Land Use Re -designation application requesting the subject ect p roperty be re -designated from Rural Residential 1 to GMA Irrigated Agriculture along with an application for a rezone from Rural Residential 1 to Agriculture. The proposal site is comprised of a parcel totaling approximately 152.94 acres. The proposal site is located on Beverly Burke Rd. NW just west of Rd. 1 NW. The site is located in the W V2 of Section 31, Township 19 North, Range 24 East, W.M., Grant County, WA. Parcel #15-1107-000. Larry Angel, Columbia Northwest Engineering, discussed the application. Martell Palmer File# P 19-0063 and P 19-0064 The applicant has submitted a Site Specific Land Use Re -Designation application requesting an approximately 28. 10 acre parcel be re -designated from Rural Urban Reserve to Rural Commercial along with an application for a rezone from Rural Urban Reserve to Rural Freeway Commercial. The subject site is located near the intersection of Rd. O NE and North Frontage Road E, just north of I-90 in a portion of Section. 33, Township 19 North, Range 29 East, W.M., Grant County, WA. Parcel #19-0568-001. Kevin Richards, Western Pacific Engineering, discussed the plethora of businesses on the I-90 corridor in the state of Washington and agrees with the applicants request to expand the LAMIRD (Limited Areas of More Intense Rural Development) to encompass their property, which is on the outer boundary of the current LAMIRD on that intersection. 2:24 p.m. Travis Palmer discussed the application stating that currently there is corn and wheat which has rural irrigation on it. The land is designated as #6, the lowest, due to the soil that is wet and has drainage canals which will not allow for irrigation circles. Mr. Palmer discussed what he believes were 2 exceptions to the LAMIRD rule that were granted to Rural Commercial and zone change to Rural Freeway Commercial, done in 2008 and 2013. 2:31 p.m. Commissioner Taylor asked staff about these two previous exceptions that were granted. Tyler Lawrence explained that for the 2013 change, the Planning Commission and County Commissioners determined that there was commercial development in existence on the land prior to July 1, 1991 which is why they approved the zone change. Damien Hooper, Director of Development Services, spoke on the 2008 exception saying the Rural Freeway Commercial site has been a LAMIRD since 1999. The initial adoption of the Comp Plan, it was designated as a LAMIRD. From 1999/2000 to 2008, the county limped along with interim zoning controls because they had not reconciled all of the zoning for all LAMIRDS. The LAMIRDS were challenged for over designating those areas. They had to establish interim zoning controls for a long time this property limped along with the rural freeway comm land use disgnation but with an intermin zoning designation. On a zone map it would look like RUR, but in fact the interim zoning control had it consistant with rural freeway commercial. The County reconciled all of the zones in 2008 and that's the rezone application that took place then. IT reconciled the hearings board decision for the designation of LAMIRDS and established Rural Freeway Commercial as an official zone on the zoning map. This was the nature of the zoning in 2008. 2:42 p.m. Martel Palmer discussed his application. He stated that Flying J is very interested in purchasing the land due to the location. The motion passed two votes to one. 2:53 p.m. Airport Mini -Storage LLC File# P 19-0067 and P 19-0068 An amendment to Unified Development Code Chapter 23.04, to allow the location of a moving equipment rental facilities accessory to a mini -storage facility. Moving Equipment Rental Facilities will allowed in al'1 zones in which ministorage facilities are allowed subject to the same permit type. This would be county -wide. This is a UDC Amendment, not a Comp Plan Amendment. Danielle Escamilla, Western Pacific Engineering, was there to answer any questions. Kevin Richards, Western Pacific Engineering, explained this is a U -Haul or Ryder Truck type rental. place that has mini -storage.
