HomeMy WebLinkAboutResolution 22-096-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION ORDERING SALE OF RESOLUTION No. 22-N�1)-CC TAX TITLE PROPERTY WHEREAS, RCW 3 6.3 5.120 allows the County to sell real property acquired by tax foreclosure when it is found to be in the best interest of the County; and WHEREAS, RCW 3 6.3 5.120 requires the County to establish the minimum price for each unit of tax title property and to determine whether the sale will be for cash or whether a contract will be allowed; and WHEREAS, RCW 3635.150 allows the County to sell tax title property by direct negotiations, without a call for bids, under certain circumstances. Direct sale for a price not less than the principal amount of the unpaid taxes is authorized when no acceptable bids were received at the attempted public auction of the property for any of the following cases (a) when the sale is to any governmental agency and for public purposes; (b) when the county legislative authority determines that it is not practical to build on the property due to the physical characteristics of the property or legal restrictions on construction activities on the property; (c) when the property has an assessed value of less than five hundred dollars and the property is sold to an adjoining landowner; or (d) when no acceptable bids were received at the attempted public auction of the property, if the sale is made within twelve months from the date of the attempted public auction; and WHEREAS, Parcel 14-1739-001 was acquired through a tax foreclosure auction held on November 17, 2017; and WHEREAS, The County Treasurer has informed the Board of County Commissioners that there were no bids for the property identified as Parcel 14-1739-001 at the tax foreclosure sale held on November 17, 2017; and WHEREAS, An Application for Re -Sale of Tax Title Property and an email request has been received by the County Treasurer from Chad/Michell Barrett; and WHEREAS, Parcel 14-1739-001 is being sold "as is" / "buyer beware" with no warranties by the County; and WHEREAS, this parcel meets the requirements for a negotiated sale due to (b) when the county legislative authority determines that it is not practical to build on the property due to the physical characteristics of the property or legal restrictions on construction activities on the property. The Board finds it is in the best interest of the County to sell the following real property: Parcel 14-1739-001 located in Grant County, and further described in attached Exhibit A. 2. The Grant County Treasurer is authorized to sell Parcel 14-1739-001 by direct negotiation to Chad/Michell Barrett for a minimum price of $1,500.00 which is over the minimum bid required on the date of the November 17, 2017 tax foreclosure sale. September 9, 2022 14 Grant County Commissioners RE: Tax Title Application for Parcel 14-1739-001 Enclosed are Application for Resale of Tax Title Property for parcel 14-1739-001. The offer was for a starting bid of 900.00 but in further discussion with the applicant the minimum bid was increased to 1,500.00. In talking to Community Development, the county would have preferred to require this parcel to go through the process of Lot Consolidation as a condition of sale but the costs of a survey right now would be not possible. The applicant will do this in future years. The Assessed Value of this parcel totals $5,800 which is debatable since this .16 acre parcel is just a private road entrance into the applicant's property and house. This parcel was in our 2017 sale and the applicant was going to buy it then but did not have the money to do so. Since the applicant owns the adjacent parcel next to this parcel. RCW 36.35.150 (1)(b) allows us to do a direct negotiation with the applicant for not less than the principal amount of the unpaid taxes when the county legislative authority determines that it is not practical to build on 1 _ II I� I ■ the property due to the physical characteristics of the property or legal restrictions on construction activities on the property. This parcel qualifies for such option. We would not be required to have a public auction on this and process the deed upon payment of the offer. My recommendation is for you to approve this offer using the private negotiation allowance so we can get this parcel back on the tax roll.
