It is the intention of Legends Music, LLC to provide a safe and enjoyable experience for guests at the Gorge Amphitheater. As part of that we recognize our responsibility to ensure that alcohol sales, service and consumption are effectively controlled. This operating plan ensures compliance by addressing the following: • Preventing the sale, service & consumption of alcoholic beverages to persons under the age of 21. Please see Section I for details. • Preventing the sale, service & consumption of alcoholic beverages to persons who appear intoxicated. Please see Section II for details. • The ratio of alcohol service staff and security staff to the size of the audience. Please see Section III for details. • Training provided to those involved in the sale & service of alcohol and staffing levels. Please see Section III for details. • Our policy on the number of drinks sold per guest pertransaction. Please see Section IV for details. • Our policy on the alcoholic beverage containers that will be used and how they differ significantly from containers utilized for non-alcoholic beverages. Please see Section V for details. • Our policy on the beginning and ending of alcohol sales at events. Please see Section V for details. • How the lighting requirements in WAC 314-11-055 will be met. This WAC requires that on all portions of the premises where alcohol is sold, served, or consumed, enough lighting must be maintained so that ID can be checked, and patrons observed for the enforcement of liquor laws and rules. Please see Section V for details. • The justification for exception to the normally approved level of service is in Section VIII. • A list of the event categories (in accordance with WAC 314-02-057(2) where alcohol service is planned. Please see Section VII and for details. • An Alcohol Service Matrix showing the levels of service requested. ("LIVE NATION"), Delaware corporation doing business in the state of Washington. The Agreement is submitted to the Washington State Liquor Control Board ("WSLCB") by LEGENDS, in accordance with WAC 314-02-56 through 314-02-059, Sports Entertainment Facility Licenses Operating Plans. RECITALS: WHEREAS, LEGENDS desires to continue to manage the food and beverage business (of which LEGENDS will be the only one receiving profits from such sales), serving patrons at concerts and other events at the Gorge Amphitheatre, in COUNTY ("AMPHITHEATER") owned by is TAR BLUES LLC ("iSTAR") and operated under a lease with LIVE NATION; WHEREAS, COUNTY and SHERIFF desire to continue to protect the safety, health and welfare of those persons affected by such concerts or events, including without limitation, patrons and nearby residents; WHEREAS, LEGENDS desires to continue to serve alcoholic beverages at the General Store, Cliff House, Plaza Lounge, Vista Bar, Box Seat Service, House Right Deck, View Bar and VIP facilities, Tree top Lounge, and Hilltop Lounge as well as beer and wine at concession stands, beer gardens, kiosks and carts. Alcoholic beverages will also be served from staff operating from a dedicated service station to serve adult patrons attending concerts that are seated in luxury boxes at the Gorge Amphitheatre, in Grant County, Washington; WHEREAS, the parties desire to continue to work together to properly regulate consumption of beer and wine by adults seated in AMPHITHEATRE luxury boxes, general admission and reserved seating areas; provided local law enforcement believes that adequate security and conditions are in place to comply with an approved security plan and a SHERIFF -approved Darkened House Plan (see SECTION V(e)). The addendum and plan contain conditions and actions to be taken by LEGENDS to prevent overconsumption of alcohol by adult patrons and prevent minors from obtaining or possessing alcohol by direct purchase or secondary transfer; WHEREAS, LEGENDS, the food and beverage concessionaire at the AMPHITHEATER, must comply with state liquor laws and regulations of the WSLCB as holder of a Sports and Entertainment Liquor License (No.077969-4T) authorizing alcoholic beverages to be sold and consumed at the AMPHITHEATER as well as the holders of separate grocery store licenses at the General Store, Camp Store and Pivot Store; and WHEREAS, the parties desire to record the terms and local conditions that supplement the above referenced liquor license, by setting forth the guidelines for alcoholic beverage sales and consumption. 2023 ALCOHOL OPERATING PL -A, -N (3.O _GE AMP141T JEAT E Page 3 of 19 NOW, THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the parties agree as follows: I. PREVENTING THE SALE, SERVICE & CONSUMPTION OF ALCOHOLIC BEVERAGES TO PERSONS UNDER THE AGE OF 21 a. LEGENDS' policy is to ask for and check all patrons' IDs (regardless of how old they appear) each time that they order an alcoholic beverage (even if the patron possesses a wristband in accordance with Subsection 1. b below. b. For events with a primary demographic of 21 years of age or less ("21 and under events"), patrons must have a wristband to purchase an alcoholic beverage. For 21 and under events, wristbands will only be issued to patrons who provide acceptable identification which verifies they are of legal age to consume alcohol in Washington State. Wristbands will be affixed by LEGENDS staff to ensure they cannot be transferred in any way. The color/design of said wristbands will vary across these younger demographic events to avoid duplication. All patrons entering all alcoholic beverage pouring lines will be checked by servers to determine whether they possess "drinking age verified" wristbands. The wristbands will aid venue staff in identifying patrons that are consuming alcohol within the confines of the AMPHITHEATRE. Providers of age verification wristbands and security staff are centrally located throughout the venue to facilitate access for patrons wanting to purchase alcohol. Staff over the age of 21, who have had server education and, at a minimum MAST training, will adequately staff each of these stations. C. If staff observes a guest who appears to be of questionable age that is in possession of or is consuming an alcoholic beverage, staff will request identification from that guest. If the guest is unable to produce an acceptable form of identification verifying their age, the guest will be turned over to security and security will contact the local police department for resolution. d. Alcohol servers, monitors, spotters, and security staff will be instructed to watch for the transfer of alcohol from one patron to another. Any person furnishing alcohol to a minor and any minor in possession of alcohol will be removed from the show, the guest will be turned over to security and security will contact the local police department for resolution. B. Staff will accept only the below forms of current identification which have been identified as "acceptable" by the Washington State Liquor and Cannabis Board. If the identification document has an expiration date, a person may not use the document after the expiration date to verify his or her age. i. Driver's license, instruction permit, or identification card of any state, or province of Canada, from a U.S. territory or the District of Columbia, or "identicard" issued by the Washington State Department of Licensing per RCW 46.20.117; ii. United States Armed Forces identification card issued to active duty, reserve, and retired personnel and the personnel's dependents, which may include an embedded, digital signature in lieu of a visible signature; iii. Passport, passport card or NEXUS card; iv. Merchant Marine identification card issued by the United States Coast Guard; and V. . Enrollment card issued by the governing authority of a federally recognized Indian tribe located in Washington, if the enrollment card incorporates security features comparable to those implemented by the department of licensing for Washington driver's licenses. GORCIE AMP = IT11EAT:i .E Page 4 of 1 II. PREVENTING THE SALE TO, CONSUMPTION OR POSSESSION OF ALCHOLIC BEVERAGES BY ANY PERSON WHO APPEARS TO BE INTOXICATED a. Staff will refuse to sell an alcoholic beverage to any person who appears to be intoxicated. b. If any guest who appears to be intoxicated is seen in the possession of an alcoholic beverage, staff will take the appropriate measures to remove the alcoholic beverage from the guest and notify security who will contact the local police for resolution. C. Guests who appear intoxicated and do not cooperate with staff will be escorted from the Gorge. Unless the guest is with another person who is not intoxicated and is able to drive, staff will make sure the guest leaves in a taxi or will contact security, who will contact the local police department for resolution. III. TRAINING PROVIDED TO STAFF WHO SERVE, REGULATE, OR SUPERVISE THE SERVICE OF ALCOHOL AND EVENT STAFFING a. The Gorge has 4 staff persons who are full-time employees who will be directly involved in the sale, service, and supervision of alcoholic beverages. These employees all go through TEAM/TIPS, Washington State Alcohol service training programs as well as Mandatory Alcohol Server Training (MAST) and hold valid server permits. b. In addition, the Gorge will employ up to 300 part-time or seasonal persons who will have direct, face-to-face contact with the guests at the Gorge facility, and who will be MAST trained, if any of their responsibilities include the sale and service of alcohol or if they have access to the concession operations. Also, the Gorge employs security staff and utilizes non-profit groups to supplement alcohol service staff, all of which go through TEAM/TIPS, Washington State alcohol service training programs, MAST Training and hold valid server permits. C. The Gorge currently h'as seating for approximately 27,500 guests. d. The ratio of alcoholic service staff and security staff to guest/audience will be no less than 1 to 50. Staffing may be adjusted upward based on type of event and expected demographic (example younger versus older crowd) based on Live Nation, Sheriff and Legends experience and expertise. As with the staff, the POS numbers also vary per event. The ratio of POS to guest/audience members is 1:65 for single night events (max capacity: 22,000) and 1:80 for festivals (max capacity: 27,500). At a sold -out single night concert or cultural event with 22,000 people, there would be 338 POS open with a corresponding minimum staff of 440 persons. At a sold -out festival with 27,500 people, there would be 343 POS open with a corresponding minimum staffing number of 550 people. The minimum for a main concert event is 60 POS. IV. POLICY IN LIMITING ALCOHOL SALES AND SERVICE PER PERSON PER TRANSACTION a. To ensure alcoholic beverages are served in a safe, responsible, and controlled manner. It is the policy of the Gorge to limit the sale and service of alcoholic beverages to two servings per person per transaction. b. If the guest is accompanied by another guest who wants to pay for both person's drinks, they may do so, provided that both guests are of legal age to purchase, have proper identification and are not displaying signs of intoxication. All beer, wine and liquor will be served in different sized and colored containers from those that contain non-alcoholic beverages. Beer, wine, liquor and non-alcoholic beverages will be served in the following types of cups: i. Beer cups: 1. 24oz. eco -friendly greenware cup (22oz. of Draft Beer 2. 32oz. Clear Pour Over Cup (Used for Shows requiring beverages to be poured from Cans or Bottles) ii. Wine cups: 1. 7-9 oz. eco -friendly pour over,cup (provide to guest for purchase of 1St_ 3rd tier bottle of wine) 2. 10 oz. eco -friendly greenware cup with 6 oz. pour line (6 oz. of 1St or 2nd tier wine glass) 3. 12 oz. Security functions are handled by both LEGENDS in-house staff and venue security. Security staff receives annual TIPS or TEAM and MAST training. Security staff receives daily briefings on the activities for the day. Security staff is responsible for patrolling the parking area, AMPHITHEATRE perimeter, beer gardens, concessions areas and all seating areas. Roving security patrols shall enforce the AMPHITHEATRE'S alcohol policies to assure compliance with state liquor laws and regulations. C. The gates will open 120 minutes or up to two (2) hours before the start of the event. Alcoholic sales for events will begin 120 minutes or up to two (2) hours prior to the start of the event and cease one hour before the projected conclusion of any show event. d. In accordance with WAC 314-11-055, on all portions of the premises where alcohol is sold, served or consumed, enough lighting will be maintained so that ID can be checked, and patrons observed for the enforcement of liquor laws and rules. e. There will be darkened house events conducted at the facility. The SHERIFF reserves the right to order LEGENDS to suspend alcohol sales or darkened house seating area consumption at any time if lighting is still a concern at any location. Adult patrons may transport their purchased beverages to their seats in accordance with the darkened house provisions of the operating plan and as agreed upon with the WSLCB local liquor officers and the SHERIFF'S Office. As the local law enforcement agency with jurisdiction for the unincorporated area of the COUNTY in which AMPHITHEATRE is located, the SHERIFF is primarily responsible for public safety of the AMPHITHEATRE during daylight and evening hours, including but not limited to darkened seating areas. To operate a darkened house, LEGENDS, as licensee, will ensure to the satisfaction of the SHERIFF, for each AMPHITHEATRE event, that alcohol possession and consumption is effectively controlled at all times, including when there is no longer daylight and alcoholic beverages are being consumed in darkened house seating areas. LEGENDS understands that it is responsible for the conduct of patrons consuming alcoholic beverages and servers as it relates to state laws and regulations within the darkened seating areas. LEGENDS always agrees to provide a level of security adequate to ensure legal compliance with state liquor laws and the safety of patrons . The SHERIFF reserves the right to order LEGENDS to suspend alcohol sales or darkened house seating area consumption at any time the SHERIFF'S on-site representative believes such a suspension or curtailment or restriction is warranted. VI. FACILITY ACTIVITIES AND EVENTS The Gorge facility operates numerous adults and kids' events throughout the year with an emphasis on live music shows. Additionally, the Gorge hosts other cultural entertainment events. Live Nation's GM meets weekly with local law enforcement to discuss the events and address any concerns. Further at the beginning of each month, the Live Nation Manager will provide an updated schedule of public events booked at the facility to our assigned Enforcement Officer and the SHERIFF. VII. JUSTIFICATION FOR EXCEPTION TO NORMALLY APPROVED LEVEL OF SERVICE LEGENDS is applying for an exception to alcohol service procedures at Entertainment and Special Events to allow for beer and wine to be consumed throughout the club and general seating areas of the Gorge Amphitheatre during scheduled activities and events which would include Concerts and Cultural Events. Justification for the exceptions includes the following: a. Alcohol service is limited to the controlled access, adult -only areas and the illuminated pouring and serving stations. There will be no hawking. b. All beer and wine will be served in different sized and colored containers from those that contain non-alcoholic beverages. For those events where the primary demographic is 21 years of age or less ("21 and under events) wristbands will be provided from alcohol compliance officers or point of sale staff. Wristbands will be affixed by a staff member to prevent transfer. Patrons bearing a wristband will still be required to present identification at the point of sale during every transaction, every time. e. Spirituous liquor will only be sold in the confines of access -controlled locations, which have been limited to include the General Store, Cliff House, Plaza Lounge, Vista Bar, Box Seat Service House Right Deck, View Bar and VIP facilities. 2023ALCOHOL OPERATINGL A -N. Security staffing and operating plans shall be tailored to each event based on the type and size of crowd expected. LEGENDS, LIVE NATION and CMS representatives will meet within 7-10 days Y prior to each event, with the WSLCB local liquor officers and SHERIFF to mutually agree on operating and security plans and to review the experience from previous events. The ratio of alcohol trained staff to audience will be a minimum of 1:50. h. Security functions shall be handled by a combination of LEGENDS in-house staff and venue security. Security staff receive annual TIPS or TEAM and MAST training. Security staff receives daily briefings. Security staff shall be responsible for patrolling the parking area,. GORGE FACILITY SITE PLAN Background: The AMPHITHEATRE first opened in 1984 as part of a nearby winery. It is now a major, world class outdoor entertainment facility that accommodates up to a maximum of 25,000 patrons for evening concerts and 27,500 for all day festivals at an entertainment event. Within this world class outdoor entertainment facility are different controlled -access, adults -only areas, where spirits are served to adult patrons and beer and wine illuminated pouring and service stations are located at concessions throughout the facility. The following is a narrative description of locations where alcoholic beverages are sold and or consumed: 1. General Store: The General Store is separated from the parking lot by two 42" tall fences and a 6ft wide dead zone. It can accommodate approximately 200 adult patrons, is open prior to the Amphitheatre doors opening, and closes at approximately 1:30am. The General Store is closely monitored by servers, supervisors, and security staff who check IDs to assure proper age for alcoholic beverage service or consumption. Unopened spirits, packaged beer and wine will be available along with food, pre-packaged snacks, candy, ice cream, etc. for campground consumption. 2. Camp Store: The Camp Store is separated by a 20ft grassy area and the camping areas by Eft fences. It can accommodate approximately 200 adult patrons, is open prior to the Amphitheatre doors opening, and closes at approximately 1:30am. The Camp Store is closely monitored by servers, supervisors, and security staff who check IDs to assure proper age for alcoholic beverage service or consumption. Unopened packaged beer and wine will be available along with food, pre-packaged snacks, candy, Ice cream, etc. for campground consumption. 3. Pivot Kiosk: The Pivot Kiosk is a beer and wine kiosk that is centrally located in the campground. It is an illuminated area surrounded by food vendors, is open prior to the Amphitheatre doors opening, and closes at approximately 1:30am. The Pivot Store is closely monitored by servers, supervisors, and security staff who check IDs to assure proper age for alcoholic beverage service or consumption. Pivot Craft Beer Kiosk: The Pivot Craft Beer Kiosk is a beer and wine kiosk that is centrally located in the campground. It is an illuminated area surrounded by food vendors, is open prior to the Amphitheatre doors opening, and closes at approximately 1:30am. The Pivot- Wine Kiosk is closely monitored by servers, supervisors, and security staff who check IDs to assure proper age for alcoholic beverage service or consumption. Unopened packaged beer and wine will be available along with pre- packaged snacks for campground consumption. a. Cliff House Lounge: The Cliff House is a fully fence -enclosed, fully illuminated lounge located at the southwest corner of the AMPHITHEATRE complex, open to holders of luxury box seat tickets. Lounge capacity is limited to approximately 300 people. Roving security and trained wait staff monitor patrons to prevent over -service of alcohol. Spirits, beer and wine, as well as food service from a LEGENDS menu are available to Cliff House patrons. The entrance to the area is through a gated security checkpoint where appropriate admission credentials must be shown for each person and screening is conducted to prevent alcoholic beverages leaving the area. This facility may admit minors provided minors are restricted to an area that is separated physically from any service bar. This fully illuminated facility remains open during the concert event and closes approximately one hour after the final act leaves the stage. b. Concession Stand "B" & Courtyard: Beer and Wine may be purchased at concession stand "B" which is located to the left of the AMPHITHEATRE bowl. Spotters and security will watch each point- of-sale and the seats for intoxicated patrons and to help ensure minors do not obtain alcohol by purchase or transfer. Adults may consume beer and wine in reserved seats in accordance with the provisions of Section V e . C. View Bar: The illuminated View Bar is a completely fence -enclosed facility that serves spirits, beer and wine. It accommodates up to 300 adults. Entry is limited to guests 21 years or older and who enter via a checked gate where their ID and wristband is examined prior to entry. Patrons may purchase a maximum of two (2) alcoholic beverages at a time. Alcoholic beverages may not be removed from this lounge area by patrons. This illuminated facility may remain open during the concert performance. d. Switchback: Beer and wine may be purchased from this illuminated stationary kiosk which is located outside the main entrance of the Cliffhouse and across from the "B" Concession stand. Spotters and security will watch each point of sale and the seats for intoxicated patrons and to help ensure minors do not obtain alcohol by purchase or transfer. Adults may consume beer and wine in reserved seats in accordance with the provisions of Section e. Portable Stationary Beer Carts: These stationary portable carts are located from the entrance of the AMPHITHEATRE and down into the venue to the main stage area. The number of portable carts stationed will vary depending on the projected attendance. These portable carts sell beer, wine and water. Beer and wine may be transported to seating areas in accordance with Section f. Box Suites: There are 54 boxes, with 266 seats. The luxury boxes are located behind reserved seats. Spirits, beer and wine service is made from a beverage station to the luxury box adult patrons by trained and qualified wait staff in the box seats. Food service from a LEGENDS menu is available to box suites patrons as well as liquor bottle service provided and monitored by Legends staff. Service and consumption in this area is in accordance to provisions of Section V e). Staff will monitor patrons' alcohol consumption to ensure that only adults obtain or consume alcohol in the luxury box seating area. This facility may permit minors provided that minors are restricted to an area that is physically separated from any service bar. Box Suites remains open during the event and closes approximately one hour after the final act leaves the stage. g. Stage Left: Beer and wine may be purchased from this illuminated stationary kiosk which is located stage left of the main stage. Spotters and security will watch each point of sale and the seats for intoxicated patrons and to help ensure minors do not obtain alcohol by purchase or transfer. Adults may consume beer and wine in reserved seats in accordance with the provisions of Section h. Hangout: The illuminated Hangout is a completely fence -enclosed facility that is used as a flex space depending on the show. It serves spirits, beer and wine and accommodates up to 300 adults. Entry is limited to guests 21 years or older for those shows where liquor is served and all ages when liquor is not served. For the shows that liquor is served, guests are required to show their ID and their wristband is examined prior to entry. Patrons may purchase a maximum of two (2) alcoholic beverages at a time. Alcoholic beverages may not be removed from this lounge area by patrons. This illuminated facility may remain open during the concert performance. i. VIP Platform & Cabanas: The illuminated VIP Platform & Cabanas are a show -specific, completely fence -enclosed facility that serves spirits, beer and wine. It accommodates up to 600 adults. This facility may permit minors provided that minors are restricted to an area physically separated from any service bar. Patrons may purchase a maximum of two (2) alcoholic beverages at a time. Alcoholic beverages may not be removed from this lounge area by patrons. This illuminated facility may remain open during the concert performance. Food service from a LEGENDS menu is available to VIP patrons as well as liquor bottle service provided and monitored by Legends staff. Service and consumption in this area is in accordance to provisions of Section V(e). Staff will monitor patrons' alcohol consumption to ensure that only adults obtain or consume alcohol in the luxury box seating area. j. A Beverage Express: Beer and wine may be purchased from this illuminated stationary kiosk which is located mid lawn stage left. Spotters and security will watch each point of sale and the seats for intoxicated patrons and to help ensure minors do not obtain alcohol by purchase or transfer. Adults may consume beer and wine in reserved seats in accordance with the provisions of Section V(e). k. Vista: The illuminated Vista Bar is a completely fence -enclosed facility that is used as a flex space depending on the show. It serves spirits, beer and wine and accommodates up to 400 adults. Entry is limited to guests 21 years or older for those shows where liquor is served and all ages when liquor is not served. For the shows that liquor is served, guests are required to show their ID and their wristband is examined prior to entry. Patrons may purchase a maximum of two (2) alcoholic beverages at a time. Westside Beer: The illuminated stationary kiosk is located across from Plaza Central Pizza near the center of the venue and serves beer and wine. Plaza Central Pizza: The illuminated stationary kiosk located near the center portion of the venue serves beer, wine and food.
