HomeMy WebLinkAboutAgreements/Contracts - Sheriff & JailK19-088 —44 HARTLINE POLICE PROTECTION AND LAW ENFORCEMENT SERVICES AGREEMENT THIS AGREEMENT ("Agreement") is made and entered into by and between the following: GRANT COUNTY, WASHINGTON (the "COUNTY"), a legal subdivision of the State of Washington, by and through the GRANT COUNTY SHERIFF'S OFFICE, and the TOWN OF HARTLINE (the "TOWN"), a municipal corporation of the State of Washington. WHEREAS, the TOWN is desirous of contracting with the COUNTY for the performance of the hereinafter described law enforcement function within its boundaries of the County of Grant through the Sheriff thereof; and WHEREAS, the COUNTY is agreeable to rendering such service on the terms and conditions hereinafter set forth; and WHEREAS, such contract is authorized and provided for by the provisions of Chapter 39.34, Revised Code of Washington, Interlocal Cooperation Act of 1967, as amended; NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. The COUNTY agrees, by and through its Sheriff, to provide police protection and law enforcement within the corporate limits of the TOWN. Such services shall encompass the duties and functions of the type coming within the jurisdiction of and customarily rendered by the Sheriff of the COUNTY under the laws of the State of Washington. Such services shall include the enforcement of statutes of the State of Washington and the municipal ordinances of the TOWN, EXCEPT the enforcement of all dog control laws. Ordinances and regulations of the Town are hereby excluded and not part of this agreement. 2. The rendition of such services, the standards of performances, and the discipline of officers and other matters incident to the performance of such services and the control of personnel employed shall remain with the COUNTY. All persons employed in the performance of such services and functions pursuant to this Agreement for said TOWN shall be County employees, and no TOWN employee, as such, shall be taken over by said COUNTY. 3. The COUNTY indemnifies the TOWN against any loss of expense by reason of injury or sickness, compensation or indemnity arising out of employment of any County personnel serving the TOWN hereunder. 4. All traffic infractions and misdemeanor offenses covered by TOWN ordinances with the TOWN limits of the Town of Hartline should be filed in the municipal court of the TOWN; such revenues and fines would go to the TOWN unless such cases would warrant the filing in District Court; then offenders would be charged in District Court. 5. Term. The term of this Agreement shall be for a period of one (1) year, expiring on August 31, 2020. 6. Termination. This Agreement may be terminated by either party on giving forty-eight (48) hours advance written notice of its intention to do so. 7. Compensation. The Town of Hartline agrees to pay Grant County the annual sum of Three thousand, three hundred dollars and 00/100's ($3,300.00). 8. Billing. The TOWN shall compensate the COUNTY in quarterly installments on October 1, 2019, January 1, 2020, April 1, 2020 and July 1, 2020, in the sum of Eight hundred twenty-five dollars and 00/100's ($825.00). 9 Future terms. The terms and conditions of this agreement shall be negotiated on an annual basis.
