HomeMy WebLinkAboutOrdinance 19-038-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington ORDINANCE AMENDING GRANT ORDINANCE No. 19- 03 -CC COUNTY CODE CHAPTER 5.02 TITLED "LICENSE FEES" WHEREAS, the Grant County Board of Commissioners (Board) wishes to support commerce and entrepreneurial activities in Grant County; and WHEREAS, the Board recognizes the value vendors and business bring to the County and events within the County; and WHEREAS, the County is required to regulate in accordance with the Revised Code of Washington; and WHEREAS, RCW Chapter 36.71 requires the County to issue licenses for Peddlers, Hawkers, Auctioneers and Barterers, but only requires a deposit from Peddlers; and WHEREAS, it is the desire of the Board to coincide with the State RCW regarding this deposit requirement. NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Grant County Board of Commissioners, hereby amend Grant County Code Chapter 5.02 titled "License Fees" as attached. DATED this ay of_, 2019. For purposes of this chapter, the following words and phrases used herein shall have the designated meaning unless a different meaning is expressly provided: "Appropriate county official" means the Grant County treasurer. "Auctioneer" means all persons who sells any goods, wares, or merchandise from traveling boats, wagons, carts or vehicles or any kind, or from any pack, basket or other package carried on foot. "Barterer" means all persons who sells any goods, wares, or merchandise from traveling boats, wagons, carts or vehicles or any kind, or from any pack, basket or other package carried on foot. "Hawker" means all persons who sells any goods, wares, or merchandise from traveling boats, wagons, carts or vehicles or any kind, or from any pack, basket or other package carried on foot. "Peddler" means all persons, both principals and agents, who go from place to place and house to house, carrying for sale and offering for sale or exposal for sale, goods, wares, or merchandise except agricultural, horticultural, or farms products, which they may grow or raise, and except vendors of books, periodicals, or newspapers. All other words and phrases used herein will have their commonly accepted meanings. • 5.02.020 - Appropriate county official. The Grant County treasurer is authorized and directed to issue a license to any person to do any business designated in RCW 36.71.070, for the sum set forth herein, or as amended, as appropriate. • 5.02.030 - License fee. Pursuant to the authority of the board of commissioners as set forth in RCW 36.71.020 and RCW 36.32.120(3), the Grant County license fee for peddlers, hawkers, barterers or auctioneers, is set at thirty dollars U.S. Currency. • 5.02.040 - Special deposit. Pursuant to RCW 36.71.020, applicants for a license to be a Peddler do any business , shall make a special deposit in the amount of five hundred dollars to the appropriate county official, in addition payment of other costs, including without limitation, the license fee and all taxes legally chargeable on the special deposit. • 5.02.045 A Peddler's license, includin the he special deposit, shall be required for each individual engaged in Peddling. An Auctioneer's, Barterer's or Hawker's license shall be required for each traveling boat, wagon, cart or vehicle or any kind, or from any pack, basket or other package carried on foot, the aggregate of which can be carried by one individual on foot. • 5.02.050 - Severability. If any provision of this chapter, or its application to any person, party or circumstance is held invalid, the remainder of the chapter or the application of provisions to other persons, parties or circumstances, shall not be affected.
