ADDENDUM TO PROFESSIONAL SERVICES AGREEMENT
FOR LEGAL REPRESENTATION OF INDIGENT INDIVIDUALS
IN THE GRANT COUNTY DISTRICT COURT
WHEREAS, Grant County (hereinafter "COUNTY") and Michael Glen Earl (hereinafter
"DEFENDER") entered into a professional services agreement; (hereinafter "AGREEMENT") effective
January 1, 2019; and
WHEREAS it has been brought to the attention of the parties that the paragraph titled
COMPENSATION contains monthly installments that do not add up to the total annual compensation,
and;
WHEREAS the parties wish to correct the mistake;
NOW, THEREFORE, the parties enter into this Addendum to the aforementioned agreement to
change the paragraph titled "COMPENSATION" as follows:
COMPENSATION. The Public Defender base rate of compensation shall be
Ninety Thousand, Three Hundred Sixty Three and 02/100 Dollars ($90,363.02)
in twelve (12) monthly installments as follows: Eleven installments of Seven
Thousand Five Hundred Thirty and 25/100 Dollars ($7,530.25) and one (1)
installment of Seven Thousand Five Hundred Thirty and 27/100 Dollars
($7,530.27) to handle 350 cases per year during the contract term. In addition to
the yearly compensation, Grant County shall pay the Public Defender One
Hundred Fifty and No/100 Dollars ($150.00) per diem for each day or portion
thereof in actual trial. The Director of Public Defense shall distribute the cases
to the Public Defender at his/her discretion. Except for genuine conflicts of interest,
the Public Defender will be required to accept all cases assigned up to the maximum
number of cases provided in this agreement, not to exceed 350 annualized cases.
In the event this contract is terminated by either party prior to the end of its term,
the County shall pay the pro -rata amount based on the total months worked in the
year of the termination. The worksite is Grant County District Court in Moses Lake
and Ephrata, Washington, and the office of the Department of Public Defense. The
Public Defender will not be compensated for travel to and from the worksite for
any reason. The Public Defender is further responsible for all costs and fees
incurred in maintaining a law office including, but not limited to, rent, phones,
copying, faxes, secretarial support, and all other costs and fees in maintaining a law
office.

This addendum does not alter any of the other contractual provisions of the above -referenced
AGREEMENT; it is entered into solely to address the aforementioned issue. All other terms and
conditions of the AGREEMENT remain in full force and effect.
