HomeMy WebLinkAboutAgreements/Contracts - BOCCADDENDUM TO CONTRACT FOR PROFESSIONAL SERVICES (Hearing Examiner) THIS ADDENDUM TO CONTRACT FOR PROFESSIONAL SERVICES, by and between Grant County, Washington (the COUNTY), a third class county, duly organized and operated under and by virtue of the Constitution and the laws of the State of Washington, acting by and through its duly authorized officers and, Andrew L. Kottkamp (CONTRACTOR), in his individual capacity. Recitals: WHEREAS, the Grant County Board of County Commissioners (BOCC) created the Office of the Grant County Hearing Examiner (Hearing Examiner) by and through Grant County Ordinance/Resolution No. 01 -17 -CC; and WHEREAS, on September 23, 2013, the BOCC appointed CONTRACTOR as the Grant County Hearing Examiner; and WHEREAS, the original contract for professional services remains in full force and effect; and WHEREAS, BOCC and the CONTRACTOR wish to amend the Contract for Professional Services to encompass additional services by the CONTRACTOR; and WHEREAS, CONTRACTOR has agreed to perform these services, NOW, THEREFORE, that September 23, 2013 Contract for Professional Services is hereby amended as follows: AMENDMENT SECTION 1: PURPOSE is hereby amended as follows: Paragraph "B" is added which will state in its entirety as follows: B. The CONTRACTOR/Hearing Examiner is also granted authority to perform Hearing Examiner services, and render final decisions, related to drug forfeiture hearings, felony forfeiture hearings, dangerous dog adjudication hearings and -any other matter that the BOCC may administratively assign to the Contractor. In this regard, Contractor shall receive and examine all available information, conduct public hearings, record a verbatim record thereof, enter written Findings, Conclusions and Decisions, and on appeals, report his decision to the Grant County Sheriff s Office and the Grant County Prosecutor's Office. SECTION 2: SERVICES is hereby amended as follows: Paragraph "E" is amended as follows: E. Report of Findings, Conclusions and Decisions (1) For cases involving Grant County Ordinance/Resolution No. 01 -17 -CC, one (1) original report of Findings, Conclusions and Decisions (as required by law or ADDENDUM TO CONTRACT FOR PROFESSIONAL SERVICES, HEARING EXAMINER Page 1 regulation) for each case, by delivering same to the Grant county Planning Department and one (1) copy delivered to the BOCC, within the time constraints imposed by law. (2) For cases involving drug forfeitures, felony forfeitures, and dangerous dog adjudications, one (1) original report of Findings, Conclusions and Decisions (oras required by law or regulation) for each case, by delivering same to the Grant County Sheriff's Office and one (1) copy delivered to the Grant County Prosecutor's Office, within any time constraints imposed by law. SECTION 3: COUNTY RESPONSIBILITIES is hereby amended as follows: Paragraph "A" is amended as follows: a (1) For cases involving Grant County Ordinance/Resolution No. 01 -17 -CC, written staff reports to CONTRACTOR five (5) working days prior to hearing, as well as maps and such other exhibits as may be necessary regarding each matter to be heard, and shall be responsible for the scheduling of all the hearings before CONTRACTOR; shall send out notices of hearings and decisions; shall make all the required copies of said decisions and correspondence; and shall keep and maintain all official files and records of the hearings, and do all other things necessary to administratively process said materials. (2) For cases involving drug forfeitures, felony forfeitures, and dangerous dog adjudications, seizure notification letter, claimant's claim letter, hearing notice letter, law enforcement reports and all other exhibits (e.g. pictures, declarations) the County will rely on for a particular forfeiture hearing or dangerous dog determination shall be furnished by the Grant County Sheriffs Office to CONTRACTOR five (5) working days prior to the hearing. All such materials for the hearings may be mailed, faxed or emailed to the CONTRACTOR. The Grant County Sherriff s Office will be responsible for the scheduling of all the hearings before CONTRACTOR; shall send out notices of hearings and decisions; shall make all the required copies of said decisions and correspondence; and shall keep and maintain all official files and records of the hearings, and do all other things necessary to administratively process said materials. The remainder of the Contract for Professional Services dated September 23, 2013 is hereby reinstated and incorporated herein by this reference. IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and year as set forth herein. Grant County has caused this instrument to be executed by its proper officers on the date below.
