RESOLUTION VACATING THE
ENTIRE SUBDIVISION OF THE
FRANZ SHORT PLAT, REPLAT #1,
ASSESSOR PARCEL NOS. 31-2252-0009

AND INCLUDED DEDICATED
ROADWAY AND RIGHTS-OF-WAY
RESOLUTION NO. 22- 1 3 q -CC
WHEREAS, the County has received an application to vacate Grant County Assessor
Parcel Nos. 31-2252-000, 31-2253-000, 31-2254-0001 31-2255-000, and
WHEREAS, RCW 58.17.212 permits the County to vacate a subdivision dedicated to
public use, and
WHEREAS, RCW 58.17.212 allows for the plat vacation together with roads and
dedications, which can be addressed concurrently, and
WHEREAS, Grant County Assessor Parcel Nos. 31-2252-000, 31-2253-0005 31-2254-
0005 31-2255-000 were approved through Resolution No. 2000 -152 -CC for the Franz Short Plat,
Replat #1, and
WHEREAS, the Resolution creates four lots from lots 2 and 3 of the Franz Short Plat,
which is located in a portion of Section 32, Township 19, North, Range 29, and
WHEREAS, the Franz Short Plat, Replat #1 and dedicated unimproved Right -of -Way
(ROW) are requested to be vacated to accommodate a development plan for a new agricultural
equipment sales, parts, and repair business at this location, and
WHEREAS, the Plat Vacation is the only alternative to accommodate the proposed 42,000
square feet building, and
WHEREAS, a new county road will be built and dedicated to the public as part of this new
development and will be located just east of the original easement/proposed dedicated public road,
and
WHEREAS, there are no objections with Development Services for the proposed Plat
Vacation or Grant County Public Works regarding the road vacation, and
WHEREAS, the Board of County Commissioners has determined that the vacation of the
Franz Plat and dedicated public road is not in detriment to public interest, and

O RD OF COMMISSIONERS
WHEREAS, RCW 5 8.17.212 provides that land vacated that was dedicated for public use
shall vest with the persons owing the property on each side thereof, and
WHEREAS, notice to the public was provided pursuant to RCW 58.17.090.
WHEREAS, an open public hearing was held on December 27, 2022, at 4:00 p.m. pursuant
to RCW 58.17.090.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COMMISSIONERS OF GRANT COUNTY AS FOLLOWS:
Grant County Assessor Parcel Nos. 31-2252-000, 31-2253-0009 31-2254-000, 31-2255-
000, are hereby vacated and consolidated into two lots with boundaries as defined by the original
Franz Short Plat Lots 2 and 3, AFN 836, with the North boundary abutting 31-4326-000, the West
boundary abutting 31-1126-000, the East boundary abutting 31-1123-000 and 18-0261-001 and
the South abutting North Frontage Rd E.
