Pursuant to RCW 42.30.110(1)(g) Commissioner Stone called an Executive Session to order at
10:31 a.m. to go until 11:01 a.m. regarding Job Applicant/Evaluation. In attendance were
Commissioners Carter, Stone and Jones, and Suhail Palacios, Juvenile Court and Youth Services
Administrator. Commissioner Stone closed the session at 11:01 a.m.

• Review of Consent Agenda Items
o Year end budget extension request, hearing date of 12/27/22 will be cancelled and
rescheduled to 12/30/22. Katie Smith clarified the budget extensions for the 504
and 508 Funds.
o Item 22, discussion ensued about this request. Are their Health District permits
required?
o Public Defense contracts, are they needing to be reviewed by council? Outside
council?
o Item 28 —Sheriff's Office: withdraw this contract and get a new updated version.
• Mattawa Drop Box —recommend rescinding the decision to close the drop box that was
approved 12/6/22. Conversations continue with the Port of Mattawa and the City of
Mattawa for potential takeover of the drop box. Revisit on the 1/17/23 Consent Agenda
• Commissioner Jones stated that item 5 will need to be held until the 12/20/22 Consent
Agenda.

The Commissioners approved the implementation of retro COLA for command staff at the
Sheriff's Office in the same manner implemented for other non -represented employees.

• Moses Lake Irrigation and Rehabilitation District — request for payback of taxes paid under
protest.

Pursuant to RCW 42.30.110(1)(i), Commissioner Stone called an Executive Session to order at

Consent Agenda — (Items 1 through 30) All items are considered routine and will be enacted by
one motion of the commissioners with no separate discussion. If a separate discussion is
desired, that item may be removed and placed under Board Discussion/Decision. A motion was
made by Commissioner Jones, seconded by Commissioner Carter, to approve Consent Agenda
items 1-4, hold 5 until 12/20/22, approve items 6-20, hold item 21 until 12/20/22, approve
items 22-27, withdraw item 28, approve items 29-31. The motion passed unanimously.

CENTRAL SERVICES
22. Request to allow Ephrata School District to utilize the kitchen at the Grant County Work Release
building while their current kitchen is remodeled. Upon approval, an MOU will be submitted.
FAIRGROUNDS
23. City of Moses Lake Industrial Waste Discharge Permit NO. 25 issued from the City of Moses Lake
to the Grant County Fairgrounds to authorize the discharge of wastewater from the fairgrounds
facility into the City's Publicly Owned Treatment Works (POTW). Term of agreement is February
28, 2023, through February 28, 2028.
24. Request to purchase materials from Platt Electrical in the amount of $9,643.97 to complete the
Harwood Arena at the fairgrounds. This purchase will be made from the approved capital
budget 132.178.00.9112.594186210 from REET 2.

PUBLIC DEFENSE
25. Professional Services Agreement for legal representation of indigent individuals in Grant County
District Court with Patrick Earl for a term of January 1, 2023, through December 31, 2024.
PHRI IC WORKS
26. Authorization request for the Public Works Director to sign Department of Ecology Amendment
No. 1 to agreement No. SWMCLCP-2123-GrCoPW-00044 between the State of Washington
Department of Ecology and Grant County Public Works. Purpose of Amendment No. 1 increases
grant funds from $76,.000.00 to $93,000.00.
RENEW
27. Amendment 05 to the Washington State Health Care Authority, Interagency Contract, for
Community Prevention and Wellness Initiative (CPWI) Prevention Services, Contract No. K3919.
The amendment increases the contract by $125,700.00 to a new total of $1,066,891.00.
SHERIFF'S OFFICE
28. Held from the December 5, 2022, agenda: Amendment to agreement for provision of law
enforcement services between Desert Aire Owners Association and Grant County, previously
signed on June 17, 2021. Amendment will provide Desert Aire with enforcement services at no
cost from October 1, 2022, through January 31, 2023, due to Sheriff's Office providing less than
the mandatory contracted enforcement services, as well as ending the agreement on January
311 2023, due to staffing issues within the Sheriff's Office. (This item is being withdrawn)
TECHNOLOGY SERVICES
29. Purchase order No. 444 in the amount of $13,,878.01 from Granicus for the annual renewal of
the Public Records Program.
30. Purchase order No. 445 in the amount of $39,712.33 from Motorola Solutions for annual license
renewal costs.
31. Purchase order No. 446 in the amount of $14.,477.65 from CivicPlus for annual premium costs.

o Commissioner Jones moved to rescind the Boards decision from 12/6/22, to close
the Mattawa Drop Box. This will be brought forth the Board again in 2023 by
Public Works. Commissioner Carter seconded and the motion passed
unanimously.
Walk-on item: A motion was made by Commissioner Jones, seconded by Commissioner Stone,
to approve the walk on items as presented: (Commissioner Carter left the virtual meeting at
this point and did not participate in the vote)

o Central Services budget transfer request in the amount of $354,000.00. The
transfer will be from the Capital Expenditure Funding that was budgeted for the
Tree Removal Project ($150.,000.00) and the North Perimeter Fence line project
($204,,000.00) and move this funding for the 4H Bathroom project.
o Auditor's Office budget extension request for the Fairgrounds in amount of
$134,000.00 as a supplement to the year-end budget extension request (item 2 on
the consent agenda). This is for expenses incurred but not budgeted.

3:15 p.m. — 3:25 p.m. Open Record Public Hearing, Franz Short Plan Vacation (Continued from
11/22/2022)
The Commissioners held an Open Record Public Hearing to consider vacating the entire
subdivision of the Franz Short Plat, Replat #1 (AFN 1099748), further identified as Assessor
Parcel Numbers 31-2252-000,.31-2253-000,.31-2254-0001 31-2255-000 and the included
dedicated roadway and associated road Right of Way pursuant to Grant County Code 22.04.490
and RCW 58.17.212, as petitioned by Vic Jansen and Dave McKinnon of Terteling Properties LLC
(agent Gil Alvarado, GAJ Planning LLC). This includes Lots 1 thru 4, Franz Short Plat, Replat #1
and included dedicated Road,. Lot 2 and 3, Franz Short Plat, in the South half of the Northwest
quarter of Section 32, Township 19 North, Range 29 East, W.M. This hearing is being continued
from 11/22/22.
Commissioner Stone stated the Board hasn't received the sale and closure documents that are
required to approve this vacation. The Board will need to continue this hearing once again.
Gil Alvarado, GAJ Planning stated he spoke with the Terteling Group / Dave McKinnon that the
documents have been signed and funds transferred. What is occurring is the titles cannot
transfer because the Title Company does not have a legal segregation to attach the segregation
to. Mr. Alvarado will meet with Frontier Title, and they can record the sale but once it gets to
the Assessor's Office, they will see there is no segregation that follows the sale.
Discussion ensued.
Jim Cook, Assistant Development Services Director stated in order to complete this transaction,
the county can perform a Boundary Line Adjustment, a recorded document with a legal
description, to allow the vacation to happen with whatever documentation the applicant has
provided that says this sale is in motion until which time we can create that boundary, they can
place the easement though.
Gil Alvarado stated they have a meets and bound description from a surveying company. They
have this in place currently. Could they record the meets and bounds description so the title
company can see it and process the sale?
Jim Cook stated he believed this could work.

Gil Alvarado stated in the interim, he will send Jim Cook a copy of the Meets and Bounds
description between now and the next hearing. The deliverables to the County will be the M&B
Description attached to the sale documents that are going to be submitted to the Assessor's
Office, so the sale can go through.
A motion was made by Commissioner Jones to continue the hearing to 12/27/22 at 4:00 p.m.
Commissioner Stone seconded and the motion passed with 2 Commissioners in attendance.
