HomeMy WebLinkAboutAgreements/Contracts - Prosecuting Attorney (004)TK -22-242 APPOINTMENT AND OATH OF OFFICE OF SPECIAL DEPUTY PROSECUTING ATTORNEY COMES NOW Kevin J. McCrae, the Prosecuting Attorney for Grant County, Washington, and pursuant to the authority of RCW 36.27.040, hereby appoints Anthony Menke of Menke Jackson Beyer, LLP, of Yakima, Washington, to serve as a Special Deputy Prosecuting Attorney pursuant to the terms below; Section 1: PURPOSE The Prosecuting Attorney appoints a SPECIAL DEPUTY PROSECUTING ATTORNEY (S.D.) to perform and render legal assistance and counsel regarding labor law, employment law and personnel matters, and such other matters and proceedings as required by the Prosecuting Attorney or designee. Section 2: SERVICES The S.D.'s duties shall include, when necessary, the preparation of all legal documents for the proper conduct of proceedings pertaining to labor law, employment and personnel matters, and legal guidance, counsel and assistance, supervision and consultation including, but not limited to, hiring and discipline processes, negotiations, mediations and arbitrations, PERC proceedings, grievances, and any other matters as required by the Prosecuting Attorney and/or Human Resources Director or designee. Section 3: COMPENSATION AND STATUS The S.D. shall be paid Two Hundred Ten and no/100 Dollars ($210.00) per hour for negotiations and mediation services performed by partner attorneys; Two Hundred Twenty - Five and no/100 Dollars ($225.00) per hour for arbitrations, administrative law matters, and litigation services performed by partner attorneys; Two Hundred and no/100 Dollars ($200.00) per hour for all work performed by associate attorneys; and One Hundred and 1 Menke SPECIAL DEPUTY PROSECUTING ATTORNEY no/100 Dollars ($100.00) per hour for all work performed by legal assistants. Fees charged will be based on aone-quarter hour minimum. Travel time will be billed at the hourly rate. Monthly bills and a case status update shall be submitted to the Civil Deputy Prosecuting Attorney for tracking and payment by Grant County. Section 4: TERM This Agreement shall be in full force and from appointment through December 31 2023 unless otherwise terminated or extended by the parties. This Agreement may be terminated at any time by either party upon written notice. Section 5: CONFLICTS OF INTEREST Notwithstanding anything to the contrary contained herein, S.D. shall not and shall have no obligation to provide legal services under this Agreement where to do so would or could reasonably be construed to rise to a conflict of interest under the Washington Rules of Professional Conduct (RPC). In any instance in which S.D. is prohibited fromrovidin legal P g g services under this Agreement by reason of an actual or potential conflict of interest, S.D. shall have no duty or obligation to provide the Prosecuting Attorney for Grant Count Washington, County, g ' Grant County or any other party or third -party with conflict counsel.
