The Commissioners approved a technology Expense request (which replaces the BOCC previous dated 8/22/22) for qty 3-ThinkStation P720 Workstations. Personnel Action Request (PAR) for the salary, wage and/or position change for Kathleen Holden, Public Defense. HUB attended the meeting with HR to explain Self Insurance that Grant County participates in (Dan Fisher and Kathy) TUESDAY, OCTOBER 11, 20-22— The 022 The session was continued to 8:30 a.m. with all Commissioners in attendance. In attendance were Commissioners Carter, Stone and Kevin McCrae and Rebekah Kaylor, Prosecuting Attorney's Office. Commissioner Stone closed the session at 8:49 a.m. Pursuant to RCW 42.30.110(1)(1) Commissioner Stone called an Executive Session to order at 8:50 a.m. to go until 9:00 a.m. regarding Litigation. The Board approved the signing of the Personnel Action Request (PAR) for Ron Teal. • Solid Waste (15 min.) --After the last Solid Waste Advisory Committee meeting, they will recommend closure of the Mattawa Drop Box. • Public Works General Update (15 min.) • Public Works Engineering/Roads (15 min.) • Castlewood Drive Petition Discussion • DRAFT 2023 ACP/STIP Discussion —to schedule a workshop to discuss. • Drumheller Trail, Road, and Roundabout Discussion — Bridge across the lake • Port Community Grant Matching Funds Discussion — Old Larson Air Base Area: For sidewalks and school areas, ADA ramps and chip sealing. • Equipment Repair and Replacement (15 min.) 2:00 p.m. — 3:00 p.m. Commissioner's Meeting (Commissioner Carter attended via Webex) • Call to order • Open Forum for Citizen Input (3 minutes per person, 15 -minute time limit) Chris Peele of Warden discussed a road that has much farm traffic and there's lack of enforcement by the city. She has sent in numerous emails to the County with pictures and videos. Commissioner Carter stated the Board would look into it and try to schedule a meeting. • Approval of Agenda A motion was made by Commissioner Jones, seconded by Commissioner Carter to approve the agenda as presented. The motion passed unanimously. • Correspondence (ie. Emails that have come in that need response, letters of support etc.) None Page 4 of 10 Grant County Commissioners Minutes Week of October 10, 2022 • Commissioners Roundtable — Miscellaneous Discussion o Item 6 will move forward o Item 7 — Hold for HR Discussion o Janice Flynn, Administrative Services Coordinator discussed the SIP tax and that its only approved for 25 years. It will expire in 2032 as it was implemented on 8/1/2007. Consent Agenda — (Items 1 through 20) All items are considered routine and will be enacted by one motion of the commissioners with no separate discussion. If a separate discussion is desired, that item may be removed and placed under Board Discussion/Decision. A motion was made by Commissioner Jones, seconded by Commissioner Carter to approve the consent agenda, holding item 7 again. The motion passed unanimously. AUDITOR'S OFFICE 1. Payment of vouchers certified by the auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the auditing officer as required by RCW 42.24.090, as recorded on a listing and made available to the Board. (Approved in the amount of $1,410,621.33) 2. Approval request for the placement of a ballot box at Grant County Road District No. 1(Wilson Creek) on parcel No. 121364000. 3. Request to close the 2007 Bond Construction Fund (303.101) due to the bonds being used in full. (Resolution No. 22 -101 -CC) 4. Request to create a new fund, Lodging Tax Fund (134.185) for lodging tax revenues. (Resolution No. 22 -100 -CC) COMMISSIONER'S OFFICE 5. Invoices 6. Held from the October 4, 2022 Consent Agenda: Master Services Agreement and Statement of Work with Moss Adams LLP, for the strategic planning as well as grant administration and compliance with American Rescue Plan Act (ARPA) funds. Term of agreement is upon signature until terminated by either party. 7. Held from the October 4, 2022 Consent Agenda: Reappointment letter for Lorna Callahan to the Fair Advisory Committee for another 3 -year term effective October 1, 2022 through September 30, 2025. (Held until the 10/18/22 Consent Agenda) 8. Letter to the Legislative Delegates of the 7t", 13th, and 15t" Legislative Districts in regard to the state crime labs and mental health evaluation and treatment facilities. 9. Request for letter of support from the Connell Rail Interchange Coalition to the Washington State Department of Transportation on their budget submission to the Washington State Office of Financial Management in the 2023-25 biennium for $15 million for the Connell Rail Interchange Project. 10. OMB Approved No. 1505-0276 U.S. Department of the Treasury Local Assistance and Tribal Consistency Fund Award Terms and Conditions for Eligible Revenue Sharing County Governments (PICT) in the amount of $1.,846.,449.34. Expiration date is March 31, 2023. (Assistance Listing No. 21.032). Washington State Department of Commerce Federal Interagency Grant Agreement with Grant County through Community Development Block Grant (CDBG) Program Public Services Grant, Contract No. 22-62210-005 for Public Services through Opportunities Industrialization Center (OIC) to low and moderate -income persons in Adams and Grant counties. Term of agreement is July 1, 2022 through June 30, 2023, in the amount of $128,000.00. 12. Agreement amending Washington State Department of Commerce Community Services and Housing Division Emergency Solutions Grant (ESG) Subrecipient Agreement between Grant County and the City of Moses Lake signed the 16th day of November 2020, and amended the 211t day of September 2021, the 18th day of January 2022 and the 28th day of June 2022. Duration of the agreement was amended to terminate September 30, 2023 as well as adds an acknowledgment of federal funds and adds requirement to report fraud or other loss. 13. Appointment letter for David Prchal to the Grant County Water Conservancy Board for a 6 -year term from October 11, 2022 through October 10, 2028. 14. Reimbursement request #12 from the Housing Authority of Grant County on Department of Commerce Eviction Rent Assistance Program (ERAP 2.0) contract No. 21-4619C-108, in the amount of $488,159.40 for September 2022 expenses. 15. Reimbursement #33, request #22 from the City of Moses Lake on Department of Commerce Emergency Solutions Grant No. 20-4613C-100 in the amount of $64,309.26 for August 2022 expenses. DEVELOPMENT SERVICES 16. Public Participation Plan from White Bluffs Consulting for the Grant County Coalition Shoreline Master Program Periodic Review. This assists Grant County and the cities of Soap Lake, Electric City, and Grand Coulee. DISTRICT COURT 17. Request to purchase two Lenovo Thinkpad laptops from CDW in the amount of $5,088.34 for the Community Court Coordinator and Community Justice Counselor positions. These will be paid for using Community Court grant funds (001.102). FAIRGRnt1NnS 18. Resolution No. 22 -099 -CC Notice of Hearing for vacating a portion of unbuilt E.1 north of E.3, Cayuse Plat S 25, T 20N, R 27E WM. Hearing is scheduled for November 8th, 2022 at 3:15 p.m. in the Commissioners Hearing Room. Petition was received from Robert Grutko and Angela Grutko, and Graciela Ortiz-Melby and Douglas Melby. Out of state travel request for John Wallace to attend advanced polygraph training in Boise, ID., November 6, 2022 through November 10, 2022. • Board Discussion/Decisions Items (Items to discuss and items that were removed from Consent Agenda. These items will be acted upon together) A motion was made by Commissioner Jones, seconded by Commissioner Carter to approve the walk-on items as presented. The motion passed unanimously. o Fairgrounds request for letter of authorization to enter into a binding contract for Lodging Tax Advisory Committee (LTAC) funding for the 2023 funding term. o Juvenile Court and Youth Services request for out of state travel for Rachel Grigg to visit a dependency youth in Lewiston ID on October 19, 2022. o Parametric Scope of Work for Amendment Eight Change No. 6, Ephrata Landfill RI/FS Engineering Services. This is under the Consulting Services Agreement with Nossaman LLP for well installation, testing, and survey; groundwater sampling and testing, hydraulic testing; multi -phase extraction pilot testing; and feasibility study completion. • Adjournment 3:00 p.m. -5:00 p.m. CCarter, Out 3:15 p.m. — 3:30 p.m. Open Record Public Hearing, Surplus of County Property located in the Royal Slope Area (Parcel Nos. 15-1556-000 and 15-0797-001) The Commissioners held an Open Record Public Hearing to consider the surplus and sale of real property located in the Royal Slope Area of Grant County (S 18 and 13, T 17, R 24 and 25) Parcel Nos. 15-1556-000 and 15-0979-001. Commissioner Stone stated that one of the parcel nos. was advertised incorrectly: 15-0797-001 which should have been 15-0979-001. Due to this error by Commissioners Office staff, this public hearing will be re -advertised correctly and set for a new date. Jeff Foster asked when the parcel would be up for sale. Darryl Pheasant stated the sale would be included in the Tax Foreclosure Sale which will be November 14, 2022. A motion was made by Commissioner Jones, seconded by Commissioner Stone, to close the public comment portion of the hearing. The motion passed with 2 Commissioners in attendance. Page 7 of 10 Grant County Commissioners Minutes Week of October 10, 2022 3:30 p.m. — 3:40 p.m. Open Record Public Hearing, Franz Short Plat Vacation (Cont -d from 10422) The Commissioners held an Open Record Public Hearing to consider vacating the entire subdivision of the Franz Short Plat, Replat #1 (AFN 1099748), further identified as Assessor Parcel Numbers 31-2252-000, 31-2253-000, 31-2254-000.,31-2255-000 and the included dedicated roadway and associated road Right of Way pursuant to Grant County Code 22.04.490 and RCW 58.17.212, as petitioned by Vic Jansen and Dave McKinnon of Terteling Properties LLC (agent Gil Alvarado, GAJ Planning LLC). This includes Lots 1 thru 4, Franz Short Plat, Replat #1 and included dedicated Road, Lot 2 and 3, Franz Short Plat, in the South half of the Northwest quarter of Section 32, Township 19 North, Range 29 East, W.M. This hearing is being continued from October 4, 2022. Chris Young, Development Services Director, discussed the vacation of the entire plat and the inclusion of the road and road right of way. Connectivity for the area parcels is important. Kevin McCrae, Prosecuting Attorney stated that in protecting the interest of the county and maintaining the connection, needed is any new dedication to be done prior to or simultaneously with the vacation of the old connection. Dave McKinnon, Terteling Group (via Webex) deferred to Gil Alvarado as their agent. Gil Alvarado, GAJ Planning Group (via Webex) clarified that the property to the north, Central Terminals, are his clients as well. He is brokering between them and the Terteling Group. He asked for clarification of the connectivity issues in question. Discussion ensued about the ingress/egress to the parcels within the plat and connectivity to Road M.2. Would the owner to the north, Mr. Maiers, want connectivity from the new ROW to the cul-de-sac at M.2 from the east to the west. The Board thought they would need that Mr. Maiers would tell us that he doesn't want or need that. The Board would like that assurance. Pamp Maiers, stated they agreed to add ROW to the east of the property, he will connect it into his property. Commissioner Stone clarified that the new ROW that is proposed abruptly ends at Maiers property. Mr. Maiers stated this is fine that it ends at his property. Gil Alvarado stated this falls in line with the agreement that was recorded exhibit B shows the new private drive. Dave McKinnon discussed the Bogaard parcel and the purchase of their property. The Bogaard's didn't have a computer to attend this meeting. He is working on a new updated Vacant Land Purchase and Sale Agreement and will have that signed between Terteling Properties and Bogaard Enterprises. After so many extensions, the agreement was placed on hold until this week. Page 8 of 10 Grant County Commissioners Minutes Week of October 10, 2022 Commissioner Stone is excited about the proposal. It behooves us to protect the interest of the county and the area landowners. Sam Dart, Assistant Public Works Director echoes the Prosecutor's and Development Services concerns. Need to make sure the County doesn't eliminate existing ROW without obtaining new ROW. Once it is eliminated, there's no mechanism to get it back. Even though its being proposed, there's nothing recorded or in writing. 3:53 pm Gil Alvarado discussed a Boundary Line Adjustment (BLA) that will need to be done in the future. Aland use action is tied into the dedication of ROW. Commissioner Stone asked if the County could vacate the plat now and wait on the vacation of the ROW until a BLA is completed. Gil Alvarado stated that when the plat is vacated, it goes back to the original plat. Property lines are not the same once this plat is vacated. Jim Cook, Assistant Development Director discussed the vacation of the new plat and how the process is once its vacated and goes back to the original plat. The unknown is if the Bogaards decide not to sell to Terteling Properties, then the ROW cannot be established and there is no access to the northern properties. What is needed: Current Purchase and Sale Agreement between Bogaards and Terteling AND a notarized Affidavit of Legal Interest from the Bogaards. This says Terteling has the right to submit an application on the behalf of the property owner.
