Ordinance amending Ch. 6.42 of the Grant County Code titled "Nitrous Oxide" and amending Ch. 1.32 of
the Grant County Code titled "Code Enforcement and Penalty"

3:17 p.m. The Commissioners held an Open Record Public Hearing to consider an Ordinance amending
Ch. 6.42 of the Grant County Code titled "Nitrous Oxide" and amending Ch. 1.32 of the Grant County
Code titled "Code Enforcement and Penalty".
Commissioner Carter gave a synopsis of the changes being proposed:
• Ch. 6.42.050 Violation — Penalties: removes language regarding violation being a gross
misdemeanor.
• Ch. 1.32.020 Code Enforcement and Penalties: adds the sentence "nothing in this chapter is
intended to restrict the authority of law enforcement officers from any jurisdiction from
enforcing the provisions of Title 6 of this code".
David Hunt commented that he believed this ordinance needed to be filed with the Auditor's Office per
RCW 36.32.120 so the public could review it ahead of time. Commissioner Carter said no. Barbara
Vasquez, Clerk of the Board, stated the hearing notice had the verbiage "full context of the ordinance
will be mailed upon request" per his suggestion.
A motion was made by Commissioner Jones, seconded by Commissioner Stone, to close the public
comment portion of the hearing. The motion passed unanimously. A motion was made by
Commissioner Jones, seconded by Commissioner Stone to approve the ordinance as presented. The
motion passed unanimously.
