Re: Representation of Garth Dano in -a matter pending before the WSBA Disciplinary Board
Dear Mr. McCrae,..
I write to confirm my agreement to represent Garth Dano in responding to an i-nvestigation commenced
by the Disciplinary Board of the Washington State Bar Association based on allegations of violation of
Rules of Professional Conduct in his capacity as prosecutor in the case of 'State v.*Za'. rn 6 .'ra. I agree to
advise and 'counsel Mr. Dano in preparing his response to'the complaint, in negotiating on his behalf
with Bar Disciplinary Counsel, and to represent him in a formal disciplinary hearing. Out of deference to
relatively higher fees on "the Coast", I agree to bill my time at $350 per -hour, rather than the $450 1
quoted earlier. It is my understanding Grant County has capped its responsibility for Mr. Dano's lega-1
fees at $20,000.00.
I will try to keep my fees as low as possible, but please keep in mind the matter'invo.lves hundreds of
pages of trial transcript and sensitive legal, ethical, and political issues requiring diplomacy and careful
consideration. MY focus will obviously be on representing Mr. Dano's interests, which appear clearly
consistent with 'those of the Grant County Prosecutor's Office as well. It is my ambition to resolve the
matter as fairly and expeditiously as circumstances and the Bar Association will allow. Within the
constraints imposed on me as Mr. Dano's lawyer,. [invite you to ask any questions ybuor the
Commissioners may have concerning my billing statements during my representation.
