HomeMy WebLinkAboutResolution 22-062-CC9 BOARD OF COUNTY COMMISSIONERS Grant County, Washington IN THE MATTER OF RESOLUTION No. 22 CC REORGANIZING THE GRANT COUNTY BOARD OF HEALTH WHEREAS, pursuant to the Constitution and laws of the State of Washington, Grant County, Washington is a class A county duly organized and existing; and WHEREAS, pursuant to the provisions of RCW 36.01 .030, the powers of Grant County can only be exercised through the Board of County Commissioners of Grant County, Washington ("Board" or "Board of County Commissioners"); and WHEREAS, pursuant to the provisions of RCW 36.32.120(6), the Board of County Commissioners has the care of County property and the management of County funds and business; and WHEREAS, pursuant to the provisions of RCW 70.46.031, not amended by Section 6 of Engrossed Second Substitute House Bill 1152 (E2SHB 1152), having an effective date of July 1, 2022, the Board of County Commissioners may by resolution or ordinance establish a health district to consist of one county and specify the membership, representation on the Grant County Board of Health, or other matters relative to the formation or operation of the health district. The county legislative authority may appoint elected officials from cities and towns and persons other than elected officials as members of the Board of Health so long as persons other than elected officials do not constitute a maj ority; and WHEREAS the Grant County Board of County Commissioners in accordance with the provisions of RCW 70.46.031 did establish a one county health district through a Resolution dated December 4, 1967, and effective January 1, 1968; and WHEREAS, pursuant to RCW 70.46.031, as referenced herein above, the Board of County Commissioners, under Grant County Resolution No. 19 -109 -CC, established a seven (7) seven member Grant County Board of Health. Said board is comprised of one county commissioner (Seat 1) and one elected official from each of the following cities; Moses Lake (Seat 2), Ephrata (Seat 3) and Quincy (Seat 4). The Seat 5 member is selected from elected officials or persons other than elected officials residing in Grand Coulee, Electric City, Coulee City or Hartline. The Seat 6 member is selected from elected officials or persons other than elected officials residing in Soap Lake, Wilson Creek or Krupp. The Seat 7 member is selected from elected officials or persons other than elected officials residing in George, Royal City, Mattawa or Warden; and WHEREAS, the 2021 Washington State Legislature under E2 SHB 1152 enacted legislation addressing the compositions and appointments to local boards of health which will require Grant County as of July 1, 2022 to modify the above referenced resolutions wherein it established a single county health district and later changed the composition of its seven - member Grant County Board of Health; and WHEREAS, Washington State's Governor, the Honorable Jay Inslee, has declared a state of emergency due to the Covid- 19 pandemic and in conjunction therewith signed Proclamation No. 20-78 which prohibited any county in the State of Washington from withdrawing or commencing or advancing legal processes for withdrawal from membership in any health district except under certain conditions; and WHEREAS, Washington State remains under a declared state of emergency due to the Covid-19 pandemic and as such Proclamation No. 20-78 is still effective; and WHEREAS, the Board of Commissioners desires to modify and reconstitute the membership of the Grant County Board of Health, without withdrawing from the Grant County Health District or establishing a health department, with the following membership plan: 1. Establish an eight (8) member Grant County Board of Health consisting of the following voting members, except as provided to the contrary: a. Seat one (1) and Seat two (2), -Two (2) members of the county legislative authority selected by the Board of County Commissioners from among themselves each January; and b. Seat three (3) and Seat four (4) -Two (2) members to be elected officials from two cities/towns within Grant County to be selected by the Grant County Association of Cities and Towns and confirmed by the Grant County Board of County Commissioners who shall serve for a two-year term or so long as the individual holds the elected position, whichever comes first; and seat three (3) begins January of even numbered years and seat four (4) begins January of odd numbered years; and c. Three (3) members selected by the Grant County Board of Health will be referred to the Grant County Board of County Commissioners for consideration of appointment by a majority vote. The successful appointees shall not be otherwise elected to any public office and selected from one of each of the following categories. Provided however, these three (3) members may not participate in any decision related to the setting or modification of permit, licensing, or application fees which shall only be determined by elected members of the Grant County Board of Health. The categories are: i. Seat five (5) - One (1) member representing public health, health care facilities, or providers, who is practicing or employed in Grant County and are a medical ethicist; epidemiologist; experienced in environmental public health, such as a registered sanitarian; community health worker; holder of a master's degree or higher in public health or equivalent; employee of a hospital located within Grant County; or any of the following providers holding an active or retired license in good standing under Title 18 RCW: physician or osteopathic physician, advanced registered nurse practitioner, physician assistant or osteopathic physician assistant, registered nurse, dentist, naturopath, or pharmacists. The seat five (5) member shall serve a two (2) year term to begin January of even numbered years. ii. Seats - One (1) member representing consumers of public health who is a Grant County resident who has self -identified as having faced significant health inequities or having lived experiences with public health-related programs such as: the special supplemental nutrition program for women, infants, and children; the supplemental nutrition program, home visiting, or treatment services. Individuals from historically marginalized and underrepresented communities may be given preference. Provided, this member may not be an elected official and may not have any fiduciary obligation to a health care facilityor other health agency and may not have a material financial interest in the rendering of health services. The seat six (6) member shall serve a two (2) year term to begin January of odd numbered years. iii. Seat seven Q -One (1) member representing community stakeholders who represents the following types of organizations located in Grant County: community-based organization or nonprofit that works with populations experiencing health inequities in Grant County; the business community; or the environmental public health regulated community. The seat seven (7) member shall serve a two (2) year term to begin January of even numbered years. d. Seat eijzht (8), -One (1) tribal member selected by the American Indian Health Commission who is not an elected official if a federally recognized Indian tribe holds reservation, trust lands, or has usual and accustomed areas within Grant County, or if a 501(c)(3) organization registered in Washington serves American Indian or Alaska Native people that provides services within Grant County. Provided however, this member may not participate in any decision related to the setting or modification of permit, licensing, or application fees which shall only be determined by elected o f f i c i a I s w h o a r e members of the Grant County Board of Health. If the American Indian Health Commission does not select a tribal member to serve on the Grant County Board of Health, the Grant County Board of Health will select an additional applicant, who represents one of the previously mentioned non -elected categories, for referral to the Grant County Board of County Commissioners for their consideration for appointment. The seat eight (8) member shall serve a two (2) year term to begin January of odd numbered years. ii. The selection process for the Grant County Board of Health seats 5-7 will follow the process outlined in appendix A, "Process for Selecting Non -Elected Officials Grant County Board of Health Seats 5-7." iii. Members appointed to the Grant County Board of Health shall serve without compensation but may be reimbursed for necessary expenses including but not limited to parking and mileage. iv. The Chair of the Grant County Board of Health shall appoint, at the direction of the majority of the board, the Health District Administrator and the Health Officer. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, STATE OF WASHINGTON, that the provisions of this Resolution are hereby enacted and establish the organization of the Grant County Board of Health. The board of health application will list which local boards or commissions the applicant has serviced on, current or past, on other. This information will be confirmed during the interview. The board of health application will list the applicant's background that meets the qualifications of the category or categories as defined in WAC. The board of health application will list the applicant's potential conflict of interest. This information will also be collected on an annual basis by the board clerk. The board of health application and the interview process will verify the applicant's demonstrated commitment to public health. The board of health application and the interview process will demonstrate how the applicant represents a diversity of expertise and lived experience. The board of health application will indicate where the applicant resides to ensure the community members on the board represents the geographic diversity of the community. The board of health application and the interview process will determine whether the applicant identifies with a historically underrepresented community. Board Member Selection Process • Applications are available online or at the GCHD office. The application is available in three languages, English, Spanish and Russian. • Advertisement will be done by news release, social media boosted posts, shared broadly with community partners and groups across Grant County. Advertisement placed in Quincy Post Register and Columbia Basin Herald. • Applicants will be interviewed by a subcommittee of the board of health. The applicants will be asked a standard set of questions. Follow up questions are permissible. Committee members will make their recommendation to the full board of health. Board of health members will motion and approve the committee's recommendations for referral to the Board of County Commissioners. • Board of Grant County Commissioners will appoint the final selected appointees. The appointment must be consistent with applicable provisions of chapter 42.30 RCW. Important considerations for the Grant County Board of Health and Grant County Board of Commissioners when selecting non -elected officials board members. • Local board of health membership must include a balanced representation of elected officials and nonelected people with a diversity of expertise and lived experience. • Persons with a fiduciary obligation to a health facility or other health agency, or a material financial interest in the rendering of health services, may not be selected as a nonelected member of a local board of health representing consumers of public health. • If the local board of health demonstrates that it attempted to recruit members from all three categories and was unable to do so, the board of health may select members only from the other two categories.
