HomeMy WebLinkAboutAgreements/Contracts - Sheriff & Jail/-7 HARTLINE POLICE PROTECTION AND LAW ENFORCEMENT SERVICES AGREEMENT TMs AGREEMENT (""Agreement"") is made and entered into by and between the following: GRANT COUNTY, WASHINGTON (the "COUNTY"), a legal subdivision of the State of Washington, by and through the GRANT COUNTY SHERIFF'S OFFICE, and the TOWN OF HARTLINE (the, "TOWN"'), a municipal corporation of the State of Washington. WHEREAS, the TOWN is desirous of contracting with the COUNTY for the performanceof the hereinafter described law enforcementfunction within its boundaries of the County of Grant through the Sheriff thereof; and WHEREAS, the COUNTY is agreeable to rendering such service on the terms and conditions hereinafter set forft, and WHEREAS, such contract is authorized and provided for by the provisions of Chapter 39. 34, Revised Code of Washington, Inter'local Cooperation Act of 1967, as arnended�,I NOW THEREFORE, IT IS AGREED AS FOLLOWS: I . The COUNTY agrees, by and through its Sheriff" to provide police protection and law enforcernent within the corporate fimits of the'TOWN.- Such services shall encompass the duties and functions of the type coming with,in the jurisdiction of and customarily rendered by the Sheriff of the COUNTY under the laws of the State of Washington, Such services shall include the enforcement of statutes of the State, of Washington. Ordinances and regulations of the TOWN are hereby excluded and not part of this agreement,, 2. The rendition of such services, the standards of performances, and the. discipline of'officers and other matters 'Incident to the performance of such services and the control of personnel employed shall remain, with the COUNTY. All persons, employed in the performance of such services and functions pursuant to this Agreement for said,TOWN shall be County employees, and no TOWN employee, as such, shall be taken over by said COUNTY. 3. The TOWN shall not be liable for compensation or Indemnity to any County employee for injury or sickness arising out of his employment, or by reason of the performance of any of the services provided for herein. The COUNTY indeninifles the TOWN against any loss, of expense by reason of injury or sickness, compensation or indemnity arising out of employment of any County personnel serving the TOWN hereunder. It is further specifically and expressly understood that the indemnification provided herein constitutes the COUNTY's waiver of 'Immunity under Industrial Insurance, Title 51 RC.W,, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties, The provisions of this section shall Survive the expiration or termination of this Agreement. Hartline. All traffic Infraction and misdemeanor offenses covered by RCW'sin TOWN limits of the TOWN of Hartline, should be filed in Grant County District Court and offenders charged in District Court. 5. The term. of this Agreement shall be for a period of one (1) year, expiring, on May 3.1, 2023. 6. Term ioal a This Agreement may be terminated by either party on giving forty-eight (48) hours advance written notice of its intention to do so. 7. Qomlaeo5aligLL The TOWN of Hartline agrees to pay Grant County the annual sum of Three thousand, three hundred dollars ($3,300,00). In the event that this Agreement is terminated under Paragraph 6, the compensation shall be prorated based upon the date of termination. 8. 0 The TOWN shall compensate the COUNTY in quarterly installments on August 31 � 2022, November 30, 2022, February 28, 2023 and May 31, 2023, in the sum of Eight hundred twenty-five dollars ($825.00). 9. Administration/Disposal of Pro pertv. This Agreement 'is executed in accordance with the authority of Chapter 3... CW, the Interlocal Cooperation Act. 4 Pursuant to the provisions of RCW 39.34:.030, the TOWN and the, County shall be responsible for administering thei�r responsibilities under the contract. No real or personal property will be jointly acquired by, the parties under this Agreement. All property, owned by each of the parties shall remain its sole, property to hold and dispose of in its sole discretiom 12., Waiver, of Riq, . 4ts. No waiver of any right under, this Agreement shall be effective unless made in writing by an authorized representative of the party to be bound thereby., Failure to 'Insistu on full performance or failure to enforce breach of this agreement on any occasion , s all not constitute consent, to or waiver of any continuation of nonperformance or any later nonperformance; nor does payment of billing or continued performance after notice of a deficiency in performance constitute an acquiescence thereto. 13. Governinq Law., The parties hereto agree that, except where expressly otherwise provided, the -'I' a , ws and administrative rules and regulations of the State of Washington shall govern In any matter relating to this Agreement. 14. Amendments., This Agreement may be amended, (to add more law enforcement services or otherwise) at any tim e by mutual written agreement of the parties. All Exhibits referenced in this Agreement, including attached Exhibit A, which has been referenced on various pages, are considered part of this agreement. 15, Prior Aqreements Superseded. This Agreement supersedes any previous agreement between the parties regardinci, the same subject matter.
