not transferring Concealed Weapon permit funds to the State. He also stated the REET fund
is doing well.

Personnel Disciplinary Matters, Commissioner Jones called an Executive Session to order at 2:29
p.m. to go until 3:30 p.m. In attendance were Commissioners Carter and Jones, and Del
Anderson, Renew. The session was continued to 2:46 p.m. Commissioner Jones closed the

MISCELLANEOUS ITEMS
The Commissioners approved and signed the Public Works County Payroll Salary Fund for their April 22,
2022 payroll.

Carter to approve the agenda as presented. The motion passed unanimously.

Appreciation (Child Care). This will be placed on the following consent agenda.

6. Consent Agenda- (Items 1 through 26) All items are considered routine and will be enacted by
one motion of the commissioners with no separate discussion. If separate discussion is desired,
that item may be removed and placed under Board Discussion/Decision. A motion was made
by Commissioner Carter, seconded by Commissioner Jones to approve the consent agenda
withdrawing # 10 and 11, changing the verbiage on #12 for the Fire Districts to read "Misc
Fire" for ALL Fire Districts; and move item #13 to discussion (#7). The motion passed
unanimously.
AUDITOR'S OFFICE
1. Payment of vouchers certified by the auditing officer as required by RCW 42.24.080, and
those expense reimbursement claims certified by the auditing officer as required by
RCW 42.24.090, as recorded on a listing and made available to the Board. In the
amounts of $29,085.20, $100,985.07, and $793,,611.78.
2. Cash transfer request from the Healthcare Reserve Fund 525.000 to Interfund
Benefits 505.184 in the amount of $500.,000.00 to maintain a positive balance for April.
A g cash transfer is also being requested from the Other Benefits Fund 508 to
Interfund Benefits 505 in the amount of $21,750.00 for the expense of the wellness
incentive paid to employees.

Washington. This is being proposed under the 2023-2025 Trust Land Transfer Program.
The County intends to maintain its current use of open space for outdoor recreation as
an ATV Park.
10. Funding recommendation from the American Rescue Plan Act (ABPA) Committee to
approve funding for a non-profit entity, the American Legion Post 157 in the amount of
$40,000.00 for lost revenue. This item is being withdrawn.

approve funding for Hospitals/Medical facilities. Funding will be provided to McKay for
lost revenue and new construction in the amount of $1,140.,717.00, Samaritan Hospital

City for development of new medical building in the amount of $1,169,000.00. This item

CORONERS OFFICE:
14. Budget extension request in the amount of $9,.111.21 to fund 001.120 for lighting
installation services on their new Coroner Vehicle, using Day Wireless. This was
approved in their 2021 budget and ARPA funds were also approved for this expense.
The expense did not occur in 2021 so this extension and transfer of ARPA funds must be
approved for 2022. The public hearing was set for May 17, 2022 at 3:25 p.m.

FACILITIES AND MAINTENANCE:
15. Request to proceed with 4H building, RTU 1 Compressor replacement with Basin
Refrigeration in the amount of $7,,042.00 plus tax. This project will be funded from the
Facilities Repair Budget 001.112.
16. Request to proceed with Wheeler Road facility roof wiring to lowest bidder, Farmers
Electric in the amount of $15.,018.85 including tax. This project will be funded from the
Wheeler Road Roof Replacement Project 126.168. If approved, a contract will be
signed.
PHRI IC' WORKS
17. Request to increase ER&R motor pool mileage per diem rate from $.45/mile to
$.585/mile due to inflation and fuel costs.
18. Resolution No. 22 -037 -CC Notice of Hearing for ordinance modifying Chapter 11.36.020
to Grant County code title 11, vehicles and traffic allowing the use of wheeled all -terrain
vehicles upon designated county roads, specifically Desert Aire roads. Hearing is set for
May 24, 2022 at 3:15 p.m.
RENEW
19. Interlocal agreement between Renew and the Wahluke School District regarding
counseling services. Term of agreement is February 1, 2022 through December 31,

SHERIFF'S OFFICE
20. Budget extension request in the amount of $6.,567.29 allocated to account 118.195 to
pay for a 2016 Chevrolet Tahoe that will be utilized as a primary K9 backup vehicle. The
public hearing was set for May 17, 2022 at 3:25 p.m.
21. Budget extension request in the amount of $75.,521.12 for the purchase of Panasonic
Toughbooks. This was approved in their 2021 budget using Law and Justice funds 121.
The expense did not occur until 2022 so a budget extension is needed. The public
hearing was set for May 17, 2022 at 3:25 p.m.
SUPERIOR COURT
22. Out of state travel requests for Peter Hibbard, Darci Alamos, and Brett Hill to attend
training for the Drug Court Program in Nashville, Tennessee July 24-28, 2022. Cost of
travel is $2,.763.86 per person for a total of $8,291.58. This will be funded from the
Department of Justice Grant.
TECHNOLOGY SERVICES
23. Purchase order 411 in the amount of $90,535.16 from CDWGI for the purchase of
computer equipment and scanners for the 2016/2017 QUAD replacements.

AUDITOR'S OFFICE — ELECTIONS
26. Resolution No. 22 -039 -CC approving the altering of certain voting precinct boundaries
as modified by the Grant County Auditor's Office.

Agenda. These items will be acted upon together.)
• Item #13 was moved for discussion/action. A motion was made by Commissioner Carter,
seconded by Commissioner Stone to approve the Spring Festival/Freedom Festival request
for lodging Tax monies. Commissioner Jones abstained due to his involvement. The
motion passed with 2 Commissioners.
• WALK-ONs: A motion was made by Commissioner Carter, seconded by Commissioner
Jones, to approve the 4 walk-on items as presented. The motion passed unanimously.
o Real Estate purchase and sale agreement, Addendum No. 1 which changes the
closing date to "on or before Thursday, June 30, 2022".
o Out of state travel request from the Sheriff's Office for a TBD staff member to travel
to Klamath Falls, OR for an extradition (Date TBD)
o Out of state travel request from the Sheriff's Office for Chris Kottong (INET) to
attend Cellular investigations training (INET registration only) from May 16-20, 2022
in Nampa,. ID.
o Out of state travel request from Public Defense /Drug Court for Dovie Sigle to

3:15 p.m. — 4:00 p.m. Open Record Public Hearing, Adoption of UDC Amendment for Solar
Regulations
The Commissioners held an Open Record Public Hearing to consider the Planning Commission's
recommendation for a Unified Development Code text amendment relating to the
establishment of commercial/utility scale solar power generation standards. Amendments will
be to UDC § 23.04, Zoning, § 23.08, Performance Standards, and § 25.02, Definitions, relating to
solar energy project development regulations.
Tyler Lawrence, Interim Development Services Director stated at the Planning Commission
regularly scheduled public hearing held on April 6, 2022, the Planning Commission considered
the Staff Report and application materials for the subject UDC amendment. There was limited
public comment made at the hearing, there was one public comment in support and no public
comments in opposition to this proposal.

Following the public hearing and discussion, the Commission unanimously voted to recommend
approval of the proposed code amendment with 8 Findings of Fact.
Commissioner Carter stated she reached out to the State about the 7% grade on the slope
requirement for panel placement. Visual impact vs slope impact. Mr. Lawrence stated this
grade was vetted by all involved and it was agreed upon to forward the 7% grade
recommendation.
Discussion ensued.
Sophie Kiepe with JUWI, a proponent for the Roayl Slope Solar Project, stated the proposed
development standards were developed with the Planning Commission and Staff. They feel like
this strikes an appropriate balance with conserving Agriculture and harnessing economic
enhancement.
Ali Weaver, echoed Ms. Kiepe's comments.
Commissioner Carter asked those in attendance about the 7% grade and wanted their opinions.
Ali Weaver stated yes, the 7% grade will work and will achieve the Planning Commissions goal.
10% was brought in because the that would give more variability. 7% strikes the balance the
county is looking for.
Call in user Audrey Lee thanked everyone for their thoughts on this process. (There were 2
other call in users but did not have any comment).
Sam Castro, Public Works Director addressed the landfill and demolition of the windfarm and
noted his concerns about the items going to the landfill.
A motion was made by Commissioner Jones, seconded by Commissioner Carter, to close the
public comment portion of the hearing. The motion passed unanimously.
Commissioner Stone read aloud the 6 actions that the commissioners may vote upon at this
hearing.
Mr. Lawrence clarified what the final actions listed mean.
Commissioner Carter asked again about the 7% grade, if the Board wanted to consider a 10%
grade. Discussion ensued. Mr. Lawrence stated administration would be difficult to put a 10%
grade with stipulations. Mr. Lawrence reiterated that the legwork was done and the 7% was
agreed upon.
A motion was made by Commissioner Carter, seconded by Commissioner Jones to uphold the
Planning Commission's recommendation to approve the amendments. Commissioner Stone
moved to amend the motion and proposed 4 amendments to the motion:
1. In 23.08.357- Solar Energy Facility —_Part E., strike the word "feet" and insert "yards".
There was no second so the motion died.

2. In 23.08.357- Solar Energy Facility -Part I., Adding #9 to read —The developer or owner
of the solar energy facility will include in the Development Agreement the plan for
disposal eF rory r,-, RCE of any damaged or decommissioned components. Various solar
energy facility components are considered a form of toxic, hazardous electronic or "e -
waste," therefore disposal of solar energy facility components will not be acceptable
within Grant County. Commissioner Jones seconded and the motion passed by 2
commissioners. Commissioner Carter voted nay.
3. In 23.08.357- Solar Energy Facility -,Part I., Adding #10 to read: The Development
Agreement will also include a site soil testing plan after component damage or following
decommissioning. The developer or owner of the solar energy facility will include plans
for completing necessary soil remediation if toxins are found present from leakage or
leaching of toxic materials into the soil. Discussion ensued. Rebekah Kaylor, Chief Civil
Deputy Prosecuting Attorney stated that if public comment was closed, and then
amendments are being proposed, another public hearing needs to be scheduled.
Before the amendments are adopted into the code, the suggestions need to be made
available for public comment. Mr. Lawrence stated there is another hearing
scheduled for May % 2022 to extend the moratorium if today's code amendment
didn't pass. Commissioner Stone voted yay to add #10, Commissioners Jones and
Carter voted nay.
4. Adding K. — Source Prohibitions: The applicant for any solar energy facility is required to
provide documentation to Grant County Development Servicese-w+ng stating the
materials/components of their proposed facility will comply with the nr;Vigomr-;n�or Of H. R.
6256, the Uyghur Forced Labor Prevention Act (UFLPA). The Act establishes a
rebuttable presumption that the importation of any goods, wares, articles, and
merchandise mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur
Autonomous Region of the People's Republic of China, or produced by an entity on a list
required by clause (i), (ii), (iv) or (v) of section 2(d)(2)(B) of the Act, is prohibited by
Section 307 of the Tariff Act of 1930 and that such goods, wares, articles, and
merchandise are not entitled to entry to the United States. There was no second to the
motion and the motion failed.
Commissioner Stone restated the motion: To approve the Planning Commission
recommendation to approve the UDC amendment and adding 1 amendment as shown in #2
above, that would add language about the disposal of solar panel components. All
commissioners voted in favor of the motion.
Another public hearing will need to be scheduled with the new amendment added to allow
public comment.
Ms. Kaylor stated the Board would need to advertise and hold another hearing. The Clerk of the
Board proposed May 24, 2022 at 3:30 p.m. A motion was made by Commissioner Carter,
seconded by Commissioner Jones to readvertise and hold another public hearing on May 24,
2022 at 3:30 p.m. The motion passed unanimously.

and Technology Services
The Commissioners held an Open Record Public Hearing to consider the following budget
extension requests:
• Sheriff's Office in the amount of $332.,000.00 (001.114) for the purchase of 98
mobile to mobile car radios for entire Sheriff's Office Fleet.
• Technology Services in the amount of $155,,443.51 (501.179) for Microsoft Licensing
Fees
Ryan Rectenwald, Undersheriff discussed their request. The original request was made in 2021
but the expense wasn't made until 2022 and the amount was not carried over into their 2022
budget. Another budget extension is now being needed.
Tom Gaines, Central Services Director, discussed their request. Current Expense funding will be
used.
A motion was made by Commissioner Jones, seconded by Commissioner Carter, to close the
public comment portion of the hearing. The motion passed unanimously. A motion was made
by Commissioner Carter, seconded by Commissioner Jones to approve the budget extensions as
