HomeMy WebLinkAboutResolution 18-062-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION RELATING TO THE ADOPTION OF THE 2018 GRANT COUNTY COMPREHENSIVE PLAN UPDATE, AND THE ADOPTION OF ASSOCIATED DEVELOPMENT REGULATIONS. Recitals: RESOLUTION No. 18- 00 -CC GRANT COUNTY DEVELOPMENT SERVICES WHEREAS, Grant County adopted its current comprehensive plan in 1999, and updated comprehensive plan in 2006 inclusive of annual site-specific amendments through 2017 and, WHEREAS, RCW 36.70A.130 requires cities and counties planning under RCW 36.70A.040 (fully planning cities and counties) to continually review and evaluate their plans and that Grant County complete a periodic update for its entire comprehensive plan in 2018 and every eight years thereafter; and, WHEREAS, The Planning Commission did conduct a series of public workshops between August 2017 and April 2018 to review draft update materials; and, WHEREAS, Grant County issued a Notice of Application that provided for a 14 -day public comment period from March 22, 2018 to April 26, 2018; and, WHEREAS, Grant County satisfied the requirements of Title 197-11 WAC in issuing an addendum to the Comprehensive Plan Environmental Impact Statement and adoption of existing document on March 22, 2018; and, WHEREAS, the Planning Commission did conduct an open -record public hearing on May 2, 2018 at 7 p.m. in the Board of County Commissioners hearing room to consider the 2018 period update of the Grant County Comprehensive Plan and revised development regulations; and, WHEREAS, the Planning Commission closed the public portion of the hearing, discussed a recommendation and voted unanimously to forward a recommendation of approval to the Board of County Commissioners (Attachment A); and, WHEREAS, the Board of County Commissioners of Grant County held an open record public hearing on June 18, 2018; and, WHEREAS, the Board of County Commissioners have been advised by the Grant County Development Services Department that the proposed Comprehensive Plan and Unified Development Code amendments were processed in accordance with the requirements of UDC Chapter 25.12 "Legislative Action"; and, WHEREAS, the Grant County Board of County Commissioners accepted the recommendation of the Grant County Planning Commission at its public hearing on June 18,_2018,_ __ and; WHEREAS, notice of all public hearings on this matter have been published according to law; and, WHEREAS, the Grant County Board of County Commissioners have established eighteen (18) Findings of Fact attached hereto as "Attachment B"; and, WHEREAS, the Grant County Board of County Commissioners establish five (5) Conclusions attached hereto as "Attachment C". NOW, THEREFORE BE IT RESOLVED that the Grant County Board of County Commissioners does hereby adopt the 2018 Growth Management Act Comprehensive Plan; and, BE IT FURTHER RESOLVED that the Grant County Board of County Commissioners adopt the Official Zoning Map which implements the 2018 Comprehensive Plan; and, BE IT FURTHER RESOLVED that the Grant County Board of County Commissioners also adopt revised Grant County Code Chapters 23.04, 23.12, and 24.08 which are consistent with the 2018 Comprehensive Plan; and, BE IT FURTHER RESOLVED that the Grant County Board of County Commissioners repeal the existing 2006 Comprehensive Plan; and, BE IT FURTHER RESOLVED that the effective date of the 2018 Comprehensive Plan, revised development regulations, and official zoning map shall take effect and be in full force upon its passage and adoption executed by the signing of this resolution. .-A PASSED AND ADOPTED this IF: day of June 2018. Yea Nva Abstain ATTEST; arbara J. cjuez ' MC Clerk of t e ' oa ❑ BOARD OF COUNTY COMMISSIONERS G T COUNTY WASHINGTON Richard Stevens, Chair Tom Taylor, Vi -Chair El AyCa r, Member Constituting the Board of County Commissioners of Grant County, Washington -2- Attachment A — Planning Commission Recommendation In the matter of file number P 18-0079, the periodic update of the Grant County Comprehensive Plan and associated development regulations, the Grant County Planning Commission has conducted a public hearing to consider the draft comprehensive plan and accept public testimony, and unanimously recommended that the Board of County Commissioners approve and adopt the 2018 Comprehensive Plan and associated development regulations subject to eighteen (18) findings of fact. -3- Attachment B — Findings of Fact The Board of County Commissioners make the following findings in their adoption of the 2018 Comprehensive Plan and development regulations: 1. Grant County is required to comply with the requirements of Chapter 36.70A RCW. The County adopted a Comprehensive Plan in 1999, and updated that document as required in 2006. The County is required to update the Comprehensive Plan in 2018 pursuant to RCW 36.70A.130; 2. The 2018 Comprehensive Plan is consistent with the Requirements of the Growth management Act — RCW 36.70A including RCW 36.70A.030(5); 3. The 2018 Comprehensive Plan is consistent with the County Wide Planning Policies; 4. The 2018 Grant County Comprehensive Plan and Unified Development Code are consistent; 5. The 2018 Comprehensive Plan update has been consistent with and is in compliance with the public participation requirements in RCW 36.70A.035 and 140; 6. The Grant County Planning Commission considered the September 13, 2017 "Agricultural Resource Land Reclassification memorandum prepared by Anchor QEA and Whitebluffs Consulting regarding the possible redesignation of certain lands within Grant County from Agriculture to Rural Resource. 7. The Agricultural Resource Land Reclassification memorandum provides a comprehensive evaluation of areas that were previously designated Agriculture in the Grant County Comprehensive Plan that do not meet the requirements of RCW 36.70A.030. 8. The Agricultural Resource Land Reclassification memorandum supports the redesignation of identified areas to a new Rural Resource designation. 9. The Rural Resource designation provides for the same residential density (1:40) as the Agriculture designation, and still allows similar uses to the Agriculture designation, however, these areas do not rise to the level of being consider long- term, commercially significant agricultural lands. 10. The 2018 Comprehensive Plan has been updated to reflect the legislation (ESSB 6091) adopted by the State of Washington applicable to groundwater protection;. -4- 11. The 2018 Comprehensive Plan includes a new capital facilities element that was adopted in-December 2017 as_a portion of the County's 2018 budget;_____ _ _ 12. The Planning Commission conducted public workshops to consider draft update materials on September 13, 2017, September 14, 2017, November 1, 2017, December 6, 2017, January 17, 2018, and February 7, 2018; 13. The "Notice of Intent to Adopt" the 2018 Comprehensive Plan and Development Regulations was submitted to the Washington State Department of Commerce on February 26, 2018, Commerce acknowledged the submittal via email on February 27, 2018. The 60-day review was complete on or about April 27, 2018; 14. The requirements of the State Environmental Policy Act have been satisfied. A Notice of Adoption of Existing Environmental Documents and EIS Addendum was issued on March 22, 2018; 15. The Planning Commission conducted an open -record public hearing on May 16, 2018 to accept testimony, review public comments, and consider the 2018 Comprehensive Plan update and unified development code amendments to formulate a recommendation to the Board of County Commissioners; 16. The Planning Commission recognizes the significant quantity of material that was required to be prepared for this update and that occasional scriveners errors and other similar minor errors may exist; and thus authorize Grant County Development Services to correct these minor issues as they are found. No substantive changes may be made unless directed by the Board of County Commissioners upon adoption; 17. The Planning Commission finds that the Planning Department should prepare an official zoning map that reflects the Comprehensive Land Use Plan to reflect the changes made during the 2018 update process as well as resolve any outstanding zoning/comprehensive plan amendments which have not been remedied by site- specific rezone; 18. The Planning Commission finds the comment responses in Appendix B to be appropriately responsive to the commenting agency's concerns, and unless otherwise specified in the recommendation to the Board of County Commissioners, direct that the responses be incorporated into the revised comprehensive plan and development regulations; -5- Attachment C — Conclusions of the Board of County Commissioners 1. The updated Grant County Comprehensive Plan and Development Regulations are consistent with and implement the goals, policies, and requirements of the Washington State Growth Management Act, and Countywide Planning Policies. 2. The Draft Comprehensive Land Use map and the Draft Official Zoning map are consistent with one another and reflect the intent, goals, and policies recommended for approval by the Planning Commission. 3. The proposed goals, policies, and general plan provisions contained in the updated Comprehensive Plan are essential to the protection of the public health, safety, and general welfare of the people of Grant County. 4. Implementation of the public participation plan facilitated early and continuous public participation in drafting the updated Comprehensive Plan and Development Regulations. 5. The procedural and substantive requirements of the State Environmental Policy Act have been complied with. "0
