HomeMy WebLinkAboutResolution 93-080-CC; BEFORE THE BOARD OF GRANT COUNTY COMMISSIONERS IN THE MATTER OF GRANT COUNTY ) PUBLIC TRANSPORTATION BENEFIT ) AREA AUTHORITY TREASURER AND ) AUDITOR ) } RESOLUTION NO. 93 -80 -CC ORDER DESIGNATING GRANT COUNTY TREASURER AS PTBAA TREASURER AND GRANT COUNTY AUDITOR AS PTBAA AUDITOR BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: WHEREAS, Grant County, Washington (the "County"), is a duly organized and existing municipal corporation operating under and by virtue of the Constitution and the laws of the State of Washington; WHEREAS, the Grant County Public Transportation Benefit Area Authority (the "PTBAA"), is an existing public transportation benefit area authority in Grant County, Washington, duly established pursuant to Chapter 36.57A RCW; WHEREAS, the PTBAA is composed of the following ,jurisdictions: the County, and the cities of: Coulee City, Coulee Dam, Electric City, Ephrata, George, Grand Coulee, Hartline, Krupp, Mattawa, Moses Lake, Royal City, Soap Lake, Warden and Wilson Creek; WHEREAS, the PTBAA is empowered by statute to designate some person other than the County Treasurer as the treasurer of the PTBAA; WHEREAS, the PTBAA is empowered by statute to designate some person other than the County Auditor as the auditor of the PTBAA; and WHEREAS, the Board of Directors of the PTBAA have determined that they desire the County Treasurer serve as the ex officio treasurer of the PTBAA, as set forth in Resolution No. 1993-2-PTBA, attached hereto as Exhibit A, and incorporated by referenced herein as if fully set forth hereto, and that the County Auditor serve as the ex officio auditor of the PTBAA, as set forth in Resolution No. 1993-5-PTBA, attached hereto as Exhibit B, and incorporated by reference herein as if fully set forth hereto. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: RESOLUTION DESIGNATING GRANT COUNTY PTBAA TREASURER AND AUDITOR - 1 RESOLUTION N0. q3-2pTBA A RESOLUTION OF THE BOARD OF THE GRANT COUNTY PUBLIC TRANSIT AUTHORITY DESIGNATING A TREASURER WHEREAS, the Grant County Public Transit Authority, hereinafter "Authority" having been created pursuant to the requirements of RCW 36.57A; and WHEREAS, the board of said Authority having been selected and taken office, the Authority has received a grant to develop a comprehensive transit plan for the service area of the Authority; and WHEREAS, the funds have been received from the state and are required to be deposited with a treasurer; and WHEREAS, the provisions of RCW 36.57A.130 require the Grant County Treasurer to serve as the treasurer for the Authority unless an alternate is designated by the Authority; and WHEREAS, the Authority does not desire to appoint an alternate treasurer, NOW, THEREFORE, THE GRANT COUNTY PUBLIC TRANSPORTATION AUTHORITY, ACTING BY AND THROUGH THE BOARD, DO RESOLVE AS FOLLOWS: SECTION 1. The Grant County Treasurer is designated as the treasurer for the Authority and shall serve as set forth in RCW 36.57A.130. SECTION 2. This resolution shall take effect upon adoption and signature by the Chair of the Board. Dated this � day of r , 1993. The Grant County Public Transit Authority, hereinafter "Authority", having been created pursuant to the requirements of RCW 36.57A; and WHEREAS, the board of said Authority having been selected and taken office, the Authority has received a grant to develop a comprehensive transit plan for the service area of the Authority; and WHEREAS, the funds have been received from the state and are required to be deposited with a treasurer; and WHEREAS, the provisions of RCW 36.57A.130 require the Grant County Auditor to serve as the auditor for the Authority and to issue warrants to be paid by the treasurer for the Authority unless an alternate auditor is designated by the Authority; and WHEREAS, the Authority does not desire to appoint an alternate auditor, NOW THEREFORE, THE GRANT COUNTY PUBLIC TRANSPORTATION AUTHORITY, ACTING BY AND THROUGH THE BOARD, DO RESOLVE AS FOLLOWS: SECTION 1. CHAIR ATTEST: ,BOARD. jStCRETARY APPROVED AS TO FORM: BOARD COUNSEL EXHIBIT -B Section 1: The County Treasurer is hereby authorized to serve as the ex officio treasurer of the PTBAA, and shall possess all of the powers, duties, and responsibilities as set forth in Chapter 36.57A RCW, including, but not limited to, the powers, duties, and responsibilities related to investing surplus PTBAA funds. All PTBAA funds shall be paid to the PTBAA Treasurer and shall be disbursed only on warrants issued by the PTBAA Auditor, upon orders or vouchers approved by the PTBAA; Section 2: The County Auditor is hereby authorized to serve as the ex officio auditor of the PTBAA, and shall possess all of the powers, duties, and responsibilities as set forth in Chapter 36.57A RCW, including, but not limited to, all of the powers, duties, and responsibilities for a public transportation benefit area authority related to creating and maintaining funds, issuing warrants, and maintaining a record or receipts and disbursements. Section 3: There is hereby created and established in the Office of the Grant County Treasurer, a special transportation fund designated as the PTBAA Fund, into which shall be paid all PTBAA funds, and the PTBAA Treasurer shall maintain such special accounts as may be created by the PTBAA into which shall be placed all money as the PTBAA may, by resolution, direct. Section 4: The PTBAA fund shall be funded upon receipt of monies from the PTBAA, and/or other sources on their behalf. All PTBAA funds shall be deposited with the County depositary under the same restrictions, contracts, and security as provided for the County depositaries.
