HomeMy WebLinkAboutResolution 93-145-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON In the matter of amending Resolution No. 93 -130 -CC; prescribing the time by which assessments within Road Improvement District No. 92-1 must be paid; fixing the rate RESOLUTION NO. 93 -14s -CC of interest payable on the unpaid assessments; and providing for other matters properly relating thereto BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: WHEREAS, Grant County; Washington (the "County"), is a third-class county duly organized and existing under the Constitution and laws of the State of Washington; WHEREAS, the Board of County Commissioners (the "Board"), by Resolution No. 93 -130 -CC, adopted on November 9, 1993, confirmed the final assessment roll for Road Improvement District No. 92-1 of the County ("RID No. 92-1"), provided that assessments may be paid in whole or in annual installments, fixed the rate of interest on such installments, and provided for the number of years in which such installments could be paid; WHEREAS, at the public hearing on the inial assessment roll, the Board discussed the advisability of allowing installments to be paid over a period of ten years; WHEREAS, Resolution No. 93 -130 -CC provides that the final assessments against property within RID No. 92-1 could be paid in annual installments for a period up to 15 years; WHEREAS, the Board desires to amend Resolution No. 93 -130 -CC to clarify that the final assessments against property within RID No. 92-1 must be paid in equal annual installments for it period of ten years; WHEREAS, Resolution No. 93 -130 -CC fixed the rate of interest to be paid on unpaid assessments at one-half of one percent (0.57c) greater than the average interest rate on the bonds issued for RID No. 92-1; and WHEREAS, the Board desires to amend Resolution No. 93 -130 -CC to reduce the rate of interest payable on unpaid assessments; NOW MERL"FORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: Section Y: Section 4 of Resolution No. 93 -130 -CC is hereby amended to provide as follows: "Section 4: The assessments may be paid in cash within thirty (30) days from the date of first publication by the County Treasurer of notice that the final assessment role is in his hands for collection, without penalty, interest, or cost, or if not then may, at the option of the property owner(s), be paid in ten equal (("-t;r-#i€tc )) annual installments with interest thereon at the rate of six percent (6%) per annum, except that if the average interest rate, without regard to bond discount, of the bonds issued for Grant County Road Improvement District No. 92-1 is other than six. percent (6%) per annum, the interest rate shall be one- ((MW) of one percent (0 (((9:3*))) greater than the average interest rate of those bonds. The first installment of assessments on the final assessment roll for Grant County Road Improvement District No. 92-1 shall become due and payable _ during the first thirty (30) day period succeeding a date one (1) year after the date of first publication by the County Treasurer of notice that the final assessment role is in his hands for collection, and annually thereafter, each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessments remain unpaid after the first thirty (30) day period, interest upon the whole unpaid sum shall be charged at the rate as determined above, and each year thereafter one of the installments, together with interest due upon the whole unpaid balance, shall be collected. Any installment not paid prior to the expiration of that thirty (30) day period, during which such installment is due and payable, shall thereupon become delinquent. Each delinquent installment of principal and interest shall be subject to a charge for interest at the rate as determined above from the date of delinquency until paid, and for an additional penalty charge of twelve percent (12%) per annum levied upon that delinquent installment of principal and interest. The collection of such delinquent installments shall be enforced in the manner provided by law." Section 3: This Resolution shall be in effect from and after the date of its passage. ADOPTED by the Board of County Commissioners of Grant County at a regular meeting of the Board held on November 30, 1993.
