A RESOLUTION ESTABLISHING
DESERT AIRE AIRPORT DISTRICT
RESOLUTION NO. 94 -31 -CC
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT
COUNTY, WASHINGTON, as follows:
WHEREAS, Grant County, Washington (the "County"), is a Class 3 county, duly
organized, existing and operating under and by virtue of the Constitution and the
laws of the State of Washington;
WHEREAS, the County is authorized and empowered to create county airport
districts and conduct proceedings, pursuant to Chapter 14.08 RCW;
WHEREAS, there was filed with the Board of Commissioners (Board) a written
application for the formation of a county airport district in the territory comprising
Desert Aire, more particularly described as: the area in Township 14, Range 23,
Sections 22, 23, 26 and 27 known as Desert Aire and all of Section 15;
WHEREAS, the Grant County Auditor certified that the subject application was
signed by the requisite number of signers;
WHEREAS, the Commissioners passed Resolution No. 93 -153 -CC, placing the
proposition of forming a county airport district upon the ballot for vote of the people
of the proposed district in the next election;

WHEREAS, an election placing the proposition of forming a county airport
district was conducted by the Grant County Auditor on February 8, 1994; and
WHEREAS, the majority of voters on the proposition of establishing a county
airport district voted in favor of said proposition.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as
follows:
Section 1: It is hereby found and declared that the election by the property
owners in the subject district for the formation of the proposed county airport district
is sufficient.
Section 2: Pursuant to the authority granted by RCW 14.08.290, there is
hereby created and established a county airport district, to be known and designated
as Desert Aire Airport District, which said district shall include all territory
comprising Desert Aire, more particularly described as follows: the area in Township
14, Range 23, Sections 22, 23, 26 and 27 known as Desert Aire and all of Section 15.
The legal description of the boundaries of the Desert Aire Airport District are as
follows:
The following described property situate in Township 14
North and Range 23 East of W.M., Grant County,
Washington:
All of Section 15. All of Section 22 lying Easterly of the
Priest Rapids Hydroelectric project area boundary as shown
on the map thereof in the Grant County Auditor's office and
recorded January 9, 1970 under auditor's No. 551978 in Book
66 -RD, page 143. All of Section 23 lying westerly of the
right-of-way for Washington State Route 243. That portion
of Section 26 bound on the east by the westerly right-of-way
of Washington State Route 243 and on the west by the Priest
Rapids Hydroelectric project area boundary as shown on the
map thereof in the Grant County Auditor's office and
recorded January 9, 1970 under auditor's No. 551976 in Book
66 -RD, page 141. All of Section 27 lying northeasterly of the
Priest Rapids Hydroelectric project area boundary as shown
on the map thereof in the Grant County Auditor's office and
recorded January 9, 1970 under auditor's No. 551977 in Book
66 -RD, page 142.

Section 3: That there be and is hereby created in the Grant County Treasurer's
Office a fund of Grant County to be known and designated as "Desert Aire Airport
District," or such other designation conforming to good accounting practices, into
which shall be deposited all taxes to be levied and collected upon their receipt, and
other deposits.
Section 4: No action whatsoever may be maintained challenging the jurisdiction
or authority of Grant County to proceed with the county airport district and creating
Desert Aire Airport District, or in any way challenging the validity thereof or any
proceeding relating thereto, unless that action is served and filed not later than thirty
(30) days after the date of the passage of this resolution.
Section 5: All action (not inconsistent with the provisions of this resolution)
heretofore taken by the Board, Grant County elected officials, department heads and/
or employees in connection with Desert Aire Airport District are hereby ratified,
confirmed and approved.
Section 6: All resolutions or parts thereof in conflict with this resolution are, to
the extent of said conflict, hereby repealed.
PASSED AND ADOPTED by the Board of County Commissioners of Grant County,
