Waslzz.ri�toxi IN THE MATTER OF SURETY BONDS FOR INTERCOUNTY WEED DISTRICT NO. 52 RESOLUTION NO. 94 -89 -CC ORDER CREATING ACCOUNT TO FULFILL BOND REQUIREMENTS BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: WHEREAS, Grant County, Washington, is a duly organized and existing municipal corporation operating under and by virtue of the Washington Constitution, and the laws of the State of Washington; WHEREAS, Grant County Weed District No. 52, is a weed district existing jointly in Grant County and Adams County, Washington, duly organized pursuant to Chapter 17.06 RCW; WHEREAS, the Board of Directors for Intercounty Weed District No. 52, are required by statute, to file a bond in the amount of One Thousand and no/ 100 dollars ($1,000.00) for each director, with the Grant County Board of Commissioners, conditioned for the faithful discharge of their duties; WHEREAS, the Board of Directors for Intercounty Weed District No. 52, are required by statute, to require a bond in the amount of One Thousand and no/100 Dollars ($1,000.00) from the weed inspector for Intercounty Weed District No. 52, for the faithful discharge of his/her duties; WHEREAS, by Chapter 17.06 RCW, the Board of Directors for Intercounty Weed District No. 52 is authorized and empowered to pay the costs of the subject bonds with funds from Intercounty Weed District No. 52; WHEREAS, the Board of Directors for Intercounty Weed District No. 52 desire to furnish a cash bond, as set forth in a resolution, attached hereto as Exhibit A, and incorporated by reference herein, to save the annual expense of purchasing four (4) bonds, as required by statute; WHEREAS, the Board of Directors for Intercounty Weed District No. 52 have the necessary cash reserves to furnish the required cash bonds, and have authorized same in the aforementioned resolution; and WHEREAS, Chapter 17.06 RCW requires that the Grant County Board of Commissioners approve the bonds furnished by Intercounty Weed District No. 52; e:/wp51/work/weed52.res NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: Section 1: There is created and established in the office of the Grant County Treasurer, a special fund designated as the Surety Bond Fund, referred to as County Trust Fund in the subject resolution, conditioned for the faithful discharge of the duties of the directors and the weed inspector of Intercounty Weed District No. 52. Accrued interest on the Surety Bond Fund, if any, shall be paid into the Weed District Na. 52's General Fund. Section 2: The Surety Bond Fund shall be funded upon receipt of One Thousand and no/100 Dollars ($1,000.00) per director and weed inspector, from Intercounty Weed District No. 52. Box 29 Royal City, Washington 9935577 In accordance with paragraph nine of RCW 17.06.050 that each director shall furnish a bond in the sum of one thousand dollars, which may be a surety company bond or property bond approved by the principal board of county commissioners, which bond shall be filed with the same board and shall be conditioned for the faithful discharge of his duties. The cost of such bond shall be paid by the district the same as other expenses of the district. We the directors of Weed District No. 52, in order to comply with the aforementioned RCW 17.06.050, hereby authorize the transfer of the sum of $4,000.00 (four thousand dollars) to the County Trust Fund in lieu of purchasing the yearly bond from an insurance carrier.
