WASHINGTON 98823 (509) 754.2011 BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF APPROVING THE ZONE CHANGE FROM AGRI- CULTURE TO SUBURBAN -1 IN A PORTION OF SECTION 34, TOWN- SHIP 19 N., RANGE 28 E., W.M., GRANT COUNTY, WASHINGTON RESOLUTION NO. 95 -183 -CC RESOLUTION ADOPTING PLANNING COMMISSION RECOMMENDATION BOB FANCHER (MAIERS DEV. CORP.) WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that a public hearing was conducted on November 1, 1995 on the matter of approving a zone change from AGRICULTURE to SUBURBAN -1 on 28.57 acres in a portion of the South half of Section 34, Township 19 North, Range 28 East, W.M. and; WHEREAS, the Board of County Commissioners have set a public hearing for December 5, 1995. WHEREAS, the Board of County Commissioners have conditioned approval of the preliminary plat on the following conditions: The subdivision shall be in compliance with the Growth Management Act, The County Wide Planning Policies, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Proponent shall meet and comply to the fullest extent possible the recommendations of the Washington State Department of Fish and Wildlife which are listed as follows: a. Through covenants in the land deeds, require strict control of cats and dogs to avoid predation and harassment of the native wildlife. b. Promote strict adherence of the hunting season rules and regulations. Development shall comply with all requirements of the Grant County Fire Flow Guidelines, Uniform Building Code and the Uniform Fire Code. 4. Development shall address the comments from the Washington State Department of Transportation and comply with all required improvements of the department. 5. Development shall comply with all applicable requirements of the Grant County Health District or other agency with jurisdiction to meet current requirements for sewage treatment and potable water requirements. 6. Development shall address and comply to the furthest extent possible the recommendations of the United States Department of Agriculture, Natural Resources Conservation District. 7. Development shall provide a sewer and water system that can be connected to municipal facilities when they become available in the area. 8. Development shall address and comply to the furthest extent possible the recommendations of the Washington State Department of Ecology. 9. Development shall provide 10' street perimeter and 5' perimeter lot line easements for future electrical distribution facilities. WHEREAS, the Board of County Commissioners have upheld the findings of the Grant County Planning Commission that the proposed lot sizes are consistent with the current zoning classification. WHEREAS, the Board of County Commissioners have upheld the findings of the Grant County Plenning Commission that the preliminary plat is within the proposed urban growth boundary area of the City of Moses Lake. WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan. WHEREAS, the Board of County Commissioners have found the proposal is consistent with the Growth Management Act. WHEREAS, the Board of County Commissioners have found that a Determination of Non -Significance has been issued for this proposal. WHEREAS, the Board of County Commissioners have found that the proposal is in compliance with the Grant County Resource Lands and Critical Areas Development Ordinance. WHEREAS, the Board of County Commissioners have found that the proposal is not within the irrigated farm units of the Columbia Basin Project.
