WASHINGTON 98823 15091 754.2011 BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF APPROVING THE LAKESHORES WEST MAJOR PLAT IN A PORTION OF SECTION 21, TOWNSHIP 19 N., RANGE 28 EAST, W.M., GRANT COUNTY, WASHINGTON RESOLUTION NO. 96 -15 -CC RESOLUTION APPROVING A PRELIMINARY PLAT GERALD G. SIMON WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that a public hearing was conducted on December 6, 1995 on the matter of approving the LAKESHORES WEST MAJOR PLAT, a 67.66 acre subdivision into 17 lots in a portion of Southwest quarter of Section 21, Township 19 North, Range 28 East, W.M. and ; WHEREAS, the Board of County Commissioners have conditioned approval of the plat on the following items: 1. The development subsequent to approval of the zone change request shall be in compliance with the Growth Management Act, The County Wide Planning Policies, The Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Zoning Ordinance, the Grant County Shorelines Master Program, the Grant County Resource Lands and Critical Areas Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Development shall comply to the fullest extent possible with the recommendations and requirements of the Washington State Department of Fish and Wildlife including the recommendation listed below: a. Consider reducing the proposed housing density along the shoreline portion of the plat. Seven residential developments seems excessive and may be difficult to mitigate impacts to the habitats. b. To minimize encroachment and disturbance into the wetland habitat, establish a building setback of 100 feet or more from the edge of the shoreline. C. If access to the lake for boating is to become a part of this development, establish one community dock designed and placed in such a manner to minimize impacts to the wetland vegetation and disturbance factors to Crest Island. d. Through covenants of the land deeds, advise future residents of the high habitat values of the area and the sensitivity of disturbances particularly on the island. Increased human activity on the island would be very detrimental. e. Through similar covenants, require strict control of pets, particularly of dogs. Free ranging dogs would be very harmful. 3. Development shall comply with all applicable requirements of fist Gant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 4. Development shall comply with all improvements required by the Grant County Public Works Department and the Washington State Department of Transportation. S. Developer shall comply with all applicable requirements of the Grant County Health District, the Washington State Department of Health and the Washington State Department of Ecology concerning water supply system(s) and the sewage disposal system(s). 6. Septic systems should be designed in such a way as to allow the future connection to a community sewer system when on becomes available in this area. If any Native American grave sites or archaeological resources are discovered or excavated the developer shall stop work and notify the Yakama Nation Cultural Resource Program and the Colville Confederated Tribes Cultural Resource Program. 8. Developer shall comply with the request of the Grant County Public Utility District request for each lot to have a 10 foot street perimeter and 5 foot lot line easement along the interior lot lines as well as the back lot lines for future electrical distribution facilities. WHEREAS, the Board of County Commissioners have upheld the findings of the Grant County Planning Commission that the plat is consistent with the Comprehensive plan of Grant County. WHEREAS, the Board of County Commissioners have upheld the findings of the Grant County Planning Commission that the plat is consistent with the Grant County Zoning Ordinance. WHEREAS, the Board of County Commissioners have upheld the findings of the Grant County Planning Commission that the lot sizes are consistent with the current zoning of the r. „r"V. WHEREAS, the Board of County Commissioners have found that a mitigated determination of non -significance has been issued for this proposal. WHEREAS, the Board of County Commissioners have found that the proposal falls within a Critical area as defined by the Grant County Resource Lands and Critical Areas Development Ordinance. The proposal subject to the review and letter submitted from the Washington State Department of Fish and Wildlife and the review and analysis by Applied PaleoSciences does comply with the Critical areas ordinance. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington by this Resolution approve the Preliminary Plat of Lakeshores West Major Plat on the property described below: THAT PORTION OF THE SOUTHWEST QUARTER CF SECTION 21, TOWNSHIP 19 NORTH, RANGE 28 EAST, W.M., GRANT COUNTY, WASHINGTON, DESCRIBED AS FOLLOWS: COMMENCING FROM A UNITED STATES BUREAU OF RECLAMATION BRASS CAP. ACCEPTED AS THE WEST OUARTER CORNER OF SAID SECTION 21, AND A POINT ON CENTERLINE OF VALLEY ROAD; THENCE NORTH 89'36'14" EAST, ALONG THE NORTH LINE OF THE SOUTHWEST QUARTER OF SAID SECTION 21, * DISTANCE OF 608.00 FEET, TO THE TRUE POINT OF BEGINNING; THENCE SOUTH 00'26'50" WEST, A DISTANCE OF 215.00 FEET; THENCE NORTH 89'36'14" WEST, A DISTANCE OF 608.00 FEET, TO THE WEST LINE OF THE SOUTHWEST QUARTER OF SAID SECTION 21, AND SAID CENTERLINE; THENCE SOUTH 00'26'50" WEST, ALONG SAID WEST LINE AND CENTERLINE, A DISTANCE OF 1262.85 FEET; THENCE SOUTH 88'49"10" EAST, A DISTANCE OF 1332.92 FEET, TO THE EAST LINE OF THE WEST HALF OF THE SOUTHWEST QUARTER OF SAID SECTION 21; THENCE NORTH 00'28'30" EAST, ALONG SAID EAST LINE, A DISTANCE OF 582.26 FEET; THENCE SOUTH 89'41'30" EAST, A DISTANCE OF 1205.01 FEET TO THE HIGH WATER LINE OF MOSES LAKE; THENCE NORTHERLY, ALONG SAID HIGH WATER LINE, TO A POINT WHICH BEARS SOUTH 89'36'14" EAST, A DISTANCE OF 1920.51 FEET, FROM THE TRUE POINT OF BEGINNING; THENCE NORTH 89'36'14" WEST, A DISTANCE 1920.51 FEET, TO THE TRUE POINT OF BEGINNING. /CONTAINING 67.66 ACRES MORE -OR -LESS.
