HomeMy WebLinkAboutResolution 17-045-CC BOARD OF COUNTY COMMISSIONERS Grant County,Washington IN THE MATTER OF ADOPTIONG A RESOLUTION No. 17- ���-CC POLICY FOR CERTAIN COUNTY ROAD IMPROVEMENTS WHEN ACCEPTING CONTRIBUTIONS FROM THE PUBLIC AND REPEALING RESOLUTION 2007-136-CC - WHEREAS, the County Road�ngineer has requested a new policy be established to provide direction concerning the matter of paving existing gravel county roads as may be requested by the public, and WHEREAS, Chapter 36.75.050 RCW provides that the powers and duties vested in or imposed upon the Board of County Commissioners with respect to establishing, examining, � surveying, constructing, altering, repairing, improving, and maintaining county roads, shall be exercised under the supervision and direction of the County Road Engineer, and WHEREAS, the Board of County Commissioners shall by resolution, and not otherwise, � order the survey, establishment, construction, alteration, or improvement of county roads; the �� County Road�ngineer shall prepare all necessary maps, plans, and specifications therefor, � showing the right of way widths, the alignments, gradients, and standards of construction, and ; � WHEREAS, the Board of County Commissioners finds that it is necessary to establish a j new policy regarding the improvement of county roads when accepting contributions of money i from the public desiring to improve said roadways from a gravel surface to a bituminous surface. � NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners directs � the County Road Engineer to take all actions appropriate to examine, report, and establish I County Road Projects using the following criteria: � I 1. Petitions from the public asking for an existing county gravel roadway be improved with � a bituminous surface must be submitted in writing and the petition must show the name , of the road and the termini of the requested improvement. The County Road Engineer � will assist the public interested in submitting such petitions. I 2. The County Road Engineer shall examina the petition and respond to the petitioner with ' an estimate of cost to be borne by the petitioner. Approval of the petition may be i withheld if one of the following conditions exists: � A. The existing right-of-way is less than sixty feet or otherwise insufficient. � B, The petitioners project termini results in work that is less than one-half mile in I,' length, EXCEPT when the entire gravel roadway length is less than one-half mile. ' � � � Cost-Share Resolution Page�of3 ' i i i i C. The petitioner's gravel roadway does not begin or end at an existing paved county roadway or paved city street. D. The owners of irrigation delivery systems along the proposed improvement are unwilling to modify their operations to prevent water from entering county rights- of-way. E. The cost of preparing the existing gravel road to meet current geometric standards will consume the entire year's budget allocated for the cost share program. F. The roadway is part of a proposed land development or mitigation requirement. G. The petitioner is a city, town, port district, irrigation district, state or federal agency, or other junior taxing district. - - ____ _ _ _ ______H._ __The�un�y�rQad-district�annott-schedule-the-wor-k-due-to-other_commitments,- --- - -_ - _ -__-- time constraints, or equipment failure. I. The petitioner does not contribute tha entire amount estimated to complete the worlc. J. The Board of County Commissioners does not approve the resolution establishing a county road project. 3. The contribution for a Cost Share project shall be 25% of estimated project cost. The estimate project cost shall be the average of the last 5 Year actual costs for Cost Share Projects on a Cost/Mile basis. 4. The worlc shall be completed approximately May 15 to September 30 of each year. 5. Projects will be selected as stated below: • On odd number years Grant County will do a Call for Cost-Share Projects. • The call will select projects for the current year and next year. • The call will be out for a minimum of 10 Calendar Days. • After the Call for Cost-Share Projects closes, Public Works will submit to the Board of County Commissioners a list of all projects received in compliance with the call. o The Board of County Commissioners will have a meeting, with each project written on a slip of paper and placed in a container then will be drawn"out of a hat" and placed in the order of drawing. � This will create a priority list for the proposed projects for the next two years. • All contributions for projects not funded the first year will be returned. • For projects funded in the second year, in order of the priority list, In March of that year Public Works will request the contribution amount and shall receive that �� amount by the date requested (minimum 10 calendar Days), if not received Public � Works will send requests out in order of the priority list. 6. A petitioner's project that may have bean approved may also be cancelled by the County � Road Engineer for any reason and all monies collected from the petitioner shall be returned promptly. , I � i Cost-Share Resolution Page 2 ot'3 I � � . , i I 7. If a petitioner decides to withdraw an approved project bafore it is constructed the County Road Engineer shall return all monies collected from the petitioner in a timely fashion. 8. The county road budget normally sets a limit of$250,000 per year for this program, and the budget may be adjusted from time to time as necessary. DATED this `�� day of , 2017. .
