WHEREAS, RCW 36.75.080 stat�s "AI! pub!'tc highways in this state, autside incorporat�d cities
and tawns and nat designated as staie highways, which have been used as public highways €or period
of not less than ten years are county roads, PR4VIDED, That no duty to ma�ntain such pubtic highway
nor any liability far any injury or damage for failure to mai�tain such pubfic highway or any road signs
ihereon shail attach io the coun#y until the same shall hav� been adopted as a part o# the county road
system by resc�lution of the coctnty cammissioners," and
WHE�EAS, the Baard af County Commissioners has received funds from interested parties to
establish and improve tha� certain coun�ty road to curreni standards, and
WHEREAS, it is fhe inteni af the B�ard of County Commissioners #o establish, acquire rights-of
way, reconstruct, and main�ain that certain county road �n accordance with current standards and
practices, and
WH�REAS, the #rue iacation, course, and width of that certain county raad, whict� was prior h�reto
uncertain, has been reported by #he County Raad Engineerfallawing his exarnination and survey thereof,
and
WHEREAS, the Baard af County Commissianers dad consider the County Road Engineer's repart
and any and aiI related evidence related thereto at a publi� hearing held in the Hearing Room of th�
Board o€ Gounty Commissioners af Grant County, Vllashington, �acated in ihe Coc�nty Courthouse,
Ephrata, Washington at '10:3C1 A.1�/!., Tuesday, Novernb�r 18,1997, and al! persans interes#ed did app�ar
�nd were heard at this hearing.

proposed road carnmon(y known as the D.5-NE Road is approximately centered along #he west line o€
the SE 1I4 of Sectit�n 26, Township 20 North, Range 27 East W.M., as reported by the County Road
Engineer, and
BE fT FURTHER RESC��VED, the 8oard of County Commissioners orders an action be fited in
the Supe�iar Court ofi Grant County, Washington, to� the dete�mination af ihe true lacation, caurse, and
width thereof. Al� persons affected by the defermination o#' ihe irue location, caurse, and width shai6 be
made parties defendant in such action and senrice haci and retum made as in the case of civil actians.
