WASHINGTON 9ee23 I5091 754-2011 BOARD OF COUNTY COMIVIISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF CHANGING � � ORDINANCE NO. 97-26—CC THE ZOI�TING FROM GENERAL COMMERCIAL � TO RESIDENTIAL TWO IN LOT 6, BLOCK 5 OF � THE LAKEVIEW PARK PLAT IN A PORTION OF � ORDINANCE APPROVING AN SECTION 25, TOWNSHIP 22 NORTH, � AMENDMENT TO THE RANGE 27 E., W.IVt., GRANT COUNTY, WA � ZONING MAP OF GRANT I COUNTY Bud Harbour WHEREAS, the Board of County Commissioners of Grant County ha�e been advised by the Grant County Planning Commission that a public hearing was conducted on January 22, 1997 on the matter of changing the zoning from GENERAL COMMERCIAL TO RESIDENTIAL TWO in Lot six (6), Block five (5}, Lakeview Park Plat in a portion of Section 25, Township 22 North, Ra�ge 27 East, W.M., Grant County, Washington. WHEREAS, the Grant County Planning Commission anade a recommendatiom to approve the zone change. WHEREAS, the Grant Counry Board of County Commissioners held a public meeting on Febraary 25, 1997 on tlus rezone request. WHEREAS, the Board of County Commissioners found sufficient evidence to uph.old the recommendations of the Grant County Planning Commission for approval. WHEREAS, upon consideration of the applicants written and oral arguments, and upon consideration of the testimony and administrative record in the application of the zone change, the Grant County Board of County Commissioners have made the followiag findings of fact: FINDINGS O� FACT: _ 1. The proposal does not fail within a Critical area as defined by the Grant County Resource Lands and Critical Areas Development Ordinance. 2. The proposal does comply with the Grant County Resource Lands and Critical Areas Development Ordinance. . 3. The proposal is consistent with the Grant County Comprehens�ve Plan and surrounding uses. 4. The proponent has presented sufficient evidence that changed circumstances in the area of the subject property warranted a rezone of the property. 5. The proponent has demonstratecl that this proposai will provide long term benefits to the communiry. CONDITIONS: � VdHEREAS, the Board of County Commissioners have concluded that conditions of approval for this zone change is in the best interest to the health, safety, and general welfare of the residents of Grant County. WHEREAS, the Board of County Commissioners have conditioned this zone change approval on the following stipulations 1. The Proposal shail be in compliance with the Grant County Comprehensive plan, the Growth Management Act, The County Wide Planning Policies, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington Staxe Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, PAGE 2 � IN 'I� MATTER OF APPROVING A ZONE CHANGE FROM GENERAL COMMERCIAL TO RESIDENTIAL TWO IN LOT 6, BLOCK 5 OF THE LAgEVIEW PARK PLAT IN A PORTION OF SECTION 25, TOWNSHIP 22 NORTH, RANGE 27 E., W.M., GRANT COUNTY, WA Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On- Site Sewage Systems. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection. 4. Proposal shall comply with all requirements of the Grant County Public Works Department. 5. Psoposal shall address the comments of submitted and comply with all requirements mf the Washington State Department of Transportation. ' 6. If any Native American Grave site(s) or archaeologicallcultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and I3istoric Preservation. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, a zone change for the following described property. The subject property is Lot 6, Block 5, of the Lakeview Park Plat, located in a portion of Section 25, Township 22 N., Range 26 E., Willamette Meridian, Grant County, Washington. Parcel Number 08-1167-000.
