RESGLLTTIUN NO. 97-19—CC RESOLUTION AP'PROVING A PRELI.MINARY PLAT OF.6 LOTS STEVE MARTIN Wf�REAS, the Board of County Commi�.sioners of Grant Ca�anty have been advised by the Grant County Planning Commission that a public hearing was conducted on 7anuary 8, 1997 on the matter m� agproving the Prelinunary Plat of Neppel Acres in a portion of the Southeast quarter of the Sonthwest quaarter of Section 9, Township 20 North, Range 27 East, W.M., Grant County, Wasirington. W.t-�REAS, the Grant Caunty Planning Com�nission was unable to make a recommendation for approval or deniai due to a lack of quorum at the January 8, 2997 public hearing. WHEREAS, the Graut County Bnard of Caunty Commissianers held a public meeting an �ebn�ary 1Q 1997. W:HEREAS, the Board of County Commissioners have found that appropriate provisions have been made for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, schooi sites, grounds, and ather public and private facilities and improvements as required by all applicable l�ai, state aud federai cades and reqnzrements. W HEREAS, the Board of County Commissioners have faund that the groposed snbclivisian dt�es conform ta the general purpose of the Comprehensive Plan and public use and interest will be served by the proposal. WI�:REAS, the Board of County Commissioners have £ound that the proposed 2ot sizes are consistent with t3xe current wning of the property. Wf�REAS, the Board of County Gou�nissioners have fo�nd that the proposal do�s nat fall within a Crirical Area as defined by the Grant Connty Resource Lands and Critical Areas Ordinance. WF�REAS, the Board of Caunty Cammissioners have fouud that the proposal does comply with the Grant County Zoning Ordinance. WHEREAS, the Board of Caunty Cam�issioners have found that a mitigated Determination of Non-Significance bas been iss�aeci for ihis proposal. NOW, THEREFORE, BE IT RESOLVED, that tlie Board of County Cammissioners for Grant County, Washington approve by this ResoIution, the six (6) lot subdivision of Neppel Acres on the following described property subject to the following conditions of approval. The final plat shall be in compliance with the Growth Management Act, The County Wide Planning Policies, The Washington Siate Environmentat Policy Act, the Gratit County Comprehensive Plan, the Grant County Zoning Ordinance, the Grant County Shorelines Master Pragram, the Grant County itesource Lands and Criticai Areas Ordinance, and all applicable local, state and federal environmental standards, regulations, rulings or requirements. 2. The final plat shall comply with all applicable requirements of the Uniform Building Code and Uniform Fire Code. 3. The final plat shall comply with all permits, approvals and improvements required by the Grant County Public Works Department. 4. The final plat shail comply with all permits, approvals, and improvements required by the Washington State Department of Transportation. 5. The final plat shall comply with all applicable requirements of the Grant County Heatth District, the Washington State Deparnnent of Health, the Washington State Department of Ecology, and the Washington State Department of Natural Resources. 6. The final plat shall comply with all requirements of the Washington State Department of Fish and Wildlife, the Washington State Department of Ecology and the Washington State Department of Health regarding sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards and WAC 246-272, On-site Sewage Systems. 7. If any Native American Grave site(s) or archaeoiogical/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. The final plat shall comply to the fullest extent possible the recommendations stated in the Washington State Department of Fish and Wildlife letter dated November 27, 1995 and listed below: a) Specify a low housing density with the individual building lots no greater than 5 acres. b) Allow no housing developinent below the crest of upper bench; allow no construction of any nature on steep bench face. c) Allow no road construction or vehicle access to the shoreline area. d} Designate the steep bench-face and bottoan shoreline/wetland area as open space for wildlife habitat; consider habitat improvement projects i.e. shrub plantings and winter bi�d feeders. e) Disturb the natural up�and vegetation only the extent necessary for construction of the roads, utility service and building sites; place the building sites near the access roads to further minimize disturbance and to maximize the amount of open space. fl Encourage individual lot owners to incorporate the natural vegetation into their landscaping and land management schemes to further reduce disturbance. g) Develop fire prevention and control programs to reduce the risk of fire damage to native shrub cover and wetland vegetation; (this may include, among other things, green belts planted with fire resistant vegetation, or other means to reduce fuel buildup i.e. mowing around the perimeter of the development). h) Establish weed control programs to prevent no�ous weeds from sgreading outside from tlie development into the adjacent native habitats. i) Through covenants in the land deeds, require strict control of cats and dogs to avoid predation and harassment of the native wildlife; control of dogs is particularly crucial with the year round population of nesting, brooding, migrating nn� winiering wiiciiife. 9. Final plat shall comply with the Indian Graves and Records Act (27.44 RCV� and shall comply with those recommendations stated in the letter from Applied PaleoSciences (7ames C. Chatters, Ph.D.) and dated July 17, 1996 and listed below: a) The cobble feature should be treated as a grave site. b) The Colville Tribe should be notified of this fmd and asked to participate in developing a treatment plan for the feature. c) i recoinmend a covenant be placed on Io�s in this group that either limits development af the escarpment edge or require,s monituring by a professional archa�Iogist if land disturbance is pianned there. �one this �� c3ay of �� , 1995.
