HomeMy WebLinkAboutResolution 98-121-CCGRANT COUNTY BOARD OF COMMISSIONERS Grant County, Washington RESOLUTION NO. 98-12�CC ORDINANCE NO. 98121-CC AMENDING THE GRANT COUNTY ZONING ORDINANCE RELATING TO PERMITTED USES, ADDING A DEFINITION FOR "UTILITY FACILITIES", AND OTHER MATTERS PROPERLY RELATING THERETO. RECITALS: WHEREAS, the Grant County Zoning Ordinance does not expressly permit utility facilities in any zoning district; and WHEREAS, public and private utilities desire to build and maintain utilities in Grant County; and WHEREAS, public and private utilities desire to expand existing utilities in Grant County; and WHEREAS, public and private utilities are essential %r orderly growth and development in Grant County; and WHEREAS, public and private utilities are essential for maintenance of existing commercial and residential development in Grant County; and WHEREAS, the Board of County Commissioners find that a public need exists to permit public and private utility facilities in all zoning districts in Grant County, subject to reasonable development regulations, in a manner consistent with local, state and federal statutes, rules, ordinances and regulations. -1- f:\civil\work\ordinanc�utilitie.ord NOW, THEREFORE, THE GRANT COUNTY BOARD OF COMMISSIONERS DO HEREBY ORDAIN AND ESTABLISH AS FOLLOWS: Section 1. NEW SUBSECTION. Grant County Zoning Ordinance, Section XV "Supplementary Use And Area Regulations," Subsection A., adopted by Resolution No. 80-39- -CC (Ordinance No. gp_39_ -CC) on April 15, 1980, is amended by adding a new subsection to "Uses Permitted", to read as follows: 4. On anv lot in anv district utility facilities shall be permitted uses, subject to the setback and height limitations in the underlving district, subject to local state and federal re�ulations. Section 2. NEW SUBSECTION. Grant County Zoning Ordinance, Section III "Definitions", adopted by Resolution No. go-39- -CC (Ordinance No, g0-39- - CC) on April 15, 1980, is amended by adding a new subsection to "De�initions," by adding a "Utility Facilities" definition, to read as follows: "Utility facilities" means: .� All communication lines, includin� cable TV but not includin� communication towers or relav stations • � All storm water, water and sewer facilities lines ec�uipment hookubs or abpurtenances includin� utilizing or related to lines ei�ht inches or less in diameter• ,� All electric facilities lines equipment or appurtenances not includin� substations, with an associated volta�e of 55 000 volts or less; and the over buildin� of existin� distribution lines (55 000 volts or less) with transmission lines (more than 55 000 volts • and the under�roundin� of all electric facilities lines equipment or appurtenances; -2- f:�civil\work\ordinanc\utilitie.ord � All natural �as distribution (as opposed to transmission lines and necessar��purtenant facilities and hooku�s• �, All developments within the confines of anv existin� electric substation, reservoir, pump station or well: and �f Periodic use of chemical or mechanical means to maintain a utilitv or transportation ri�ht-of-wav in its desi�n condition provided that chemicals used are approved by the Washin�ton State Department of A�riculture and applied bv licensed personnel. NOW THEREFORE, BE IT HEREBY RESOLVED THAT THE GRANT COUNTY COMMISSIONERS adopt this ordinance effective immediately. PASSED this 2 th day of August, 1998.
