RECITALS: WHEREAS, the Board of County Commissianers (Board} of Grant County, Washington, intends to fully comply with the orders of the E�.stern Washington Growth Man�gement Hearings Board; and WHEREAS,theBoard adopted ResolutionNa.9'T-143-CC entitled,"AResalutionAdopting Grant County's Wor1i Plan for Continued Compliance with the Growth Management Act", and Resolution No. 98-25-CC entitled, "Resolution Adc�pting GMA Work I'lanJCritic�l P�ith Schedule, Expressing An Intent to Approve S�,tpplemental Budget to Complete Elements of Approved GMA Work P�an, and Designating Review and Consider�tion of Additional Interim Measures"; and WHEI2CAS, RCW 36,70A,390 empowers the Bo�rd with the authority to renew interi�n of�ici�l controls to protect, inte�aT.icz., the Agricultur�l Zone; and 'WHEREAS, Grant Caunty is currently studying and prep�ring code amendments to its zaning code re�ul�ting its Agriculture Zone, to establish new zonin�; categories ta protect the Agriculture Zone; �nd WHEREAS, the Board finds that interim ofl"icial controls addressing residential uses �nd densities within the Agriculture Zone, previously adopted in OrdinancelResolution No, 98-37-CC, on Apri17, 1998, re-adopted by and through OrdinancelResolutian No. 98-158-CC, on 4ctober 6, 1998, and re-�dopted by and through Ordinance/Resolution No. 99-45 -CC, on April 5, 1999, and as set forth herein, are reasanable and necessary to protect the Agriculture Zone during the period of time required to prepare and adopt a new, updated zoning code and developmental regulations implementing Grant County's GMA Comprehensive Plan,including the adaption and establishment of new zone categaries in the Agriculture Zot1e; and AN ORDINANCE RENEWING INTERIM AGRICULTURAL ZONING CONTROLS - 1 CTVILB\ORDINANC\LAND-USE\AG-ZONE,OR4 , . ,. , . , WHEREAS, the Board adopted Ordinance/Resolution No, 98-37-CC, adopting interim official controls in the Agricultural Zone, containing an amendment to the Grant County Zoning Ordinance providing for a definition of"farm", containing permitted uses, and containing restrictions �nd re-adopted same by and through Ordinance/Resolution No. 98-158-CC; and WHEREAS, the Bo�rd desires to re-adopt the above referenced interim zoning controls, which are reasonable and necessary to further its purpose. NOW,THEREFORE,THE GRANT COUNTY BOARD OF COMMISSIONERS DO HEREBY ORDAIN AND ESTABLISH AS FOLLOWS: Section 1. The aforementioned amendment to Grant County Zoning Ordinance, Section III "Definitions," adopted by Resolution No, 80-39-CC (Ordinance No. 80-39-CC) on April 15, 1980, and amended by and through OrdinancelResolution No. 98-37-CC, on April 7, 1998, re-�dopted by and through Ordinance/Resolution No. 98-158-CC, on October 6, 1998, re-adopted by and through Ordinance/Resolution No. 99-45 -CC, on April 5, 1999, is hereby re-adopted, by renewing the subject new subsection to "Definitions," and by renewing the "farm" definition, to read as follows: Farm; A farm is defined as a parcel of land in wluch�he primary use of ihe parcel is devoted to, and used for, the commercial production of livestock or agricultural commodities, and whereby the residence is ancillary to the primary use. Section 2. The aforementioned amendment to Grant County Zoning Ordinance, Section V "A (Agriculture)", Uses Permitted, subsection (B.)(8), adopted by Resolution No. 80-39-CC (Ordin�nce No. 80-39-CC) on April 15, 1980, amended by Resolution No. 96-147-CC (Ordinance No. 96-147-CC), on November 12, 1996, which was repealed and re-anacted as a new subsection by and through Ordinance/Resolution No. 98-37-CC, on April 7, 1998, re-adopted by and through Ordinance/Resolution No. 98-155-CC, on October 6, 1998, and re-adopted by and through Ordinance/Resolution No. 99-45-CC, on April 5, 1999, is re-adopted, by renewing the subject new subsection, to read as �ollows: 8, Any owner occupied residence loc�.ted on the farm which is located in the Agriculture Zone District may be subdivided once every five (5) years in accordance with the Grant County short plat ordin�nce (An Ordinance Relating To Short Plats And Short Subdivisions), Section 2, Exemptions (7), so long as the subdivision contains no less than one acre and the remainder of the original parcel contains five (5)acres or more. Parcels created pursuant to this exemption may not be further subdivided for a period of five (5) years except for land divisions created pursuant to Section V, subsection (B.)(10), of the Grant County Zoning Ordinance, AN ORDINANCE RENEWING INTERIM AGRICULTURAL ZONING CONTROLS - 2 CIVIL8\ORDINANC\LANQ-USE\AG-ZONE.OR4 Section 3. The aforementioned amendment to Grant County Zoning Ordinance, Sectian V "A{Agriculture)", subsection{B.)Uses Permitted, adopted by ResolutionNo. 80-39-CC(4rdinancG No, 80-39-CC) on April 15, 1980, and amended by OrdinancetResolution No. 98-37-CC, on April 7, 1998, re-adopted by and thraugh OrdinancelResolution No. 9&158-CC, on October 6, 1998, and re-adopted by and thraugh tJrdinance/Resalution No. 99-45-CC, an Apri15, 1999, is re-adopted by renewing the previausly adopted �mendment, to read �s follows: 12. Single famiiy residences and accessary structures. Section 4. The aforementioned amendment ta Grant County Zaning Ordinance, Section V "A (Agriculture)", subsection (C,) Restrictions, �dopted by Resolution No. 80-39-CC {Ordinance Na. 80-39-CG� on April 15, 1980, amended by Ordinance/Resolution Na. 98-37-CC, on April �, 1998,re-adopted by and thraugh OrdinancelResolution No. 98-158-CC,an October 6, 1998, and re- �dopted by and through Ordinance/Resolutian No. 99-45-CC, on April 5, 1999, is re-adopted by renewing the amendment ta read as follaws. C. RESTRICTIONS 1. Lot Area Required: 44 acres unless as pravided u�zdar Section B, 8 and Section B.10,))Forty(4Q)acres, except as otherwise provided for by Section V{B.}{8}, Section V{B.}(10)and Section V(D.)(Canditiotzal Uses by Special Pertnit) of the Grant County Zoning C?rdinance� 2. Yards Required: There shall be a frant yard not less than twenty-five �25) feet deep and two side yards each nat less than five (5} feet wide,}) No building shall be placed closer than twenty-five (2S)feet to any road, street, or public right-of-way. No building sh�ll be placad closer than five (5) faet to any side yard property Iine which does not contain�road, street, ar public rigbt-of-way. A temparary stand for the display and sale of �gricultural products produced on the premises farm m�y be located in the front yard but not closer than ten (10) feet ta any public road, street, or right-of way. 3, There shall be no subdivision of I�nd for housin� purposes other th�n as provided by Section V(8), Section V(B,}(10) �nd Section V(B,)(12) (40 ac��e minirnum lot size), of the Grant County Zoning Oxdinance.
