HomeMy WebLinkAboutResolution 00-160-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON 1N THE MATTER OF APPROVING THE ) MODIFICATIONS TO THE MOSES LAICE ) ESTATES PLANNED UNIT DEVELOPMENT ) PHASE I MAP TO INCLUDE ) 141 SINGLE-FAMILY LOTS, WATER FRONT ) PARK, SHORELINE HABITAT AREA, ) WII,DLIFE HABITAT AREA, CENTRAL PARK ) AREA USES ON 250 ACRES IN A PORTION OF ) SECTION 3, 4, 9, TOWNSHIP 18 NORTH, RANGE) 28 EAST, WILLAMETTE MERIDIAN, GRANT ) COUNTY WASHINGTON ) RESOLUTION NO, 2000-160-CC RESOLUTION APPROVING MODIFICATIONS TO TH� MOSES LAKE ESTATES PHASE I FINAL PLANNED UNIT DEVELOPMENT MAP LAWRENCE AND SHERI JACOBSEN WHEREAS, the Board of County Cominissioners of Grant County have been advised by the Grant County Plamiing Commission that an open record public hearing was conducted on November 1, 2000 on the inatter of modifications to the Moses Lalce Estates Final Plaiuled Unit Development Map, Phase I Dune Lake Farms, which includes 141 single-family lots, a water front parlc area, shoreline habitat area, wildlife habitat area, central community park area and associated facilities and infrastructure on approximately 250 acres. The proposal is for the acceptance of the modification to the original concept plan layout; and, WHEREAS, the Grant County Plaiming Commission made a recommendation to approve the modifications to the Moses Lalce Estates Final Plaruled Unit Development Map at the open record public hearing on November 1, 2000; and, WHEREAS, the Grant Cotuity Board of Coirunissioners held a public meeting on November 20, 2000 in the Commissioners Hearuigs Room of the Courthouse in Ephrata, Washington; aiid, Wx�1tEAS, the Board of County Coimnissioners set a closed record public hearing in regards to the approval of the Final PUD Map for Phase I of Moses Lake Estates to take place on December 11, 2000, and; WHEREAS, the Board of County Commissioners have approved the Final PUD map for Phase I of Moses Lake Estates subject to all conditions of approval and �ndings of fact as presented by staff, and; NOW THEREFORE, BE IT RESOLVED, that the Board of County Commissioneis for Grant County, Washington approve by this Resohrtion, the modificatioi�s to the Moses Lake Estates Final Planned Unit Development Map which includes 141 single-family lots, water front park, shoreline habitat area, wildlife habitat area, central park atld associated facilities and infrastructure. CONDITIONS OF APPROVAL 1) The, Proposal shall be in compliance with all applicable codes in effect of the time of approval of this proposal, including but not limited to: Grant County Comprehensive Plan, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands ai�d Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-2.01, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 3) Development shall comply with all t•equirements of the Grant County Health District, including but not limited to the following: a) A site evaluation must be recorded with the Health District for each proposed building site. The work must be done by a licensed engineer or certified designer. Test holes must be available for review of site evaluation reports by the Health District staff. The Page 3 of 4 Resolution Approving Moses Lake Estates, Phase 1, Ainendments Washington State Dept. of Health inust authorize the expansion of the Pelican Point Water System for the number of lots proposed. 4) Development shall be in compliance with all requirements of the Grant County Building and Fire Maishal's Office, including but not limited to the following: a) I'ire Department access and water supply shall be in accordance with Uniform Fire Code Article 9 and nationally recognized standat•ds (NFPA). Fire water supply systeins shall be engineered and plans and inspections of the same are required. 5) Development shall implement all requirements and mitigation measures as specified in the Cultural Resources Survey fi•om Western Heritage, Inc. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6) Development shall comply with all requirements of Grant County Resolution #90-142-CC, A resolution approving the Moses Lake Estates project, entering findings of fact and conclusions of law, and directing a code amendment, dated December 3, 2000. 7) All mitigation measures identified in the Fuial Environmental Iinpact Statement (September 5, 2000) shall be deemed to be conditions of approval. 8) Development shall comply with all requirements of the approved Shoreline Substantial Development Permit. 9) Development shall be in compliance with all requirements of the Grant County Public Worlcs Department, including but not limited to the followillg: a) Grant County does not allow end to end curves of different radii. b) A tangent section is needed between all curves. c) Reverse curves are not allowed for Grant County Roads d) A temporary cul-de-sac or an acceptable turn around provision is needed for the dead-end road at the Water Front Parlc. e) A 20-foot radius is needed for the access road to the Future Equestrian Center. 10) Development subject to any other conditions deemed necessary by the Grant County Planning Commission with concurrence of the Grant County Board of County Commissioners. 11) Development subject to any other conditions as deemed necessary and final approval from the Grant County Board of County Commissioners. II. FINDINGS OF FACT A. The Final PUD Map (is) consistent with the approved Moses Lake Estates Planned Unit Development conceptplan. The Final PUD Map (does) comply with the conditions of approval of the Findings of Fact, Conclusions of Law, and final decision of the Grant Cotulty Board of County Commissioners. C. The Final PUD Map (does) comply with the conditions and mitigation measures as established in the Final Enviromnental Impact Statement dated September 5, 2000. D. The Final PUD Map (does) comply with the conditions of the approved Shoreline Substantial Development permit. III. DECISION The application by Lawrence and Sheri Jacobse�l for amendments to the Moses Lake Estates Planned Unit Development is approved by a vote of the majority. Done this � �" day of ��� , 2000.
