SUBJ�CT SITE IS LOCATED 1N A PORTION OF SECTION 22, TOWNSHIP 14 NORTH, RANGE 23 EAST, W.M., GRANT COUNTY, WASHINGTON RESOLUTION NO. 2000-106—CC RESOLUTION APPROVING A PLAT ALTERATTON THOMAS & VIlZGINIA CLARK WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on August 2, 2000, on the matter of altering Lots 214 & 215 of Desert Aire No. 1 into (1) one lot approximately 0.500 acres in size,located in a portion of Section 22, Township 14 North, Range 23 East, Willamette Meridian, Grant County, Washington; WHEREAS, the Grant County Planning Commission on August 2, 2000 made a recoirunendation to the Board of County Commissioners to approve this proposed plat alteration with the (10) ten suggested conditions of approval and (3) Findings of Fact; WHEREAS, a DNS was issued on July 17, 2000 and the requirements of SEPA have been met; WHEREAS, the Grant County Board of Commissioners held a closed record public meeting on August 28, 2000 at 2:30 p.m. in the Commissioners Hearing Room of the Courthouse; WHEREAS, the Board of County Commissioners have made a decision to uphold the Planning Commission's recommendation to approve the proposed plat alteration request; WHEREAS, the Board of County Commissioners have found that the proposal does conform to the general purpose of the Grant County Comprehensive Plan; WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; WHEREAS, the Board of County Commissioners have found that appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites and grounds and other public and private facilities and iinprovements have been inade; Page 2 of 3 Thomas & Virginia Clarlc Replat Resolution �0 ,.1 n(,p .. L► C WI�ItEAS, the Board of County Commissioners have approved the Plat Alteration of Lots 214 & 215, Desert Aire No. 1 into one (1) lot approximately 0.500 acres in size subject to the following ten (10) Conditions of Approval and three (3) Findings of Fact as recoininended by the Planning Department: CONDITIONS OF APPROVAL: The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Plat Alteration. Development shall be in compliance with the Growth Management Act, The County- Wide Planning Policies, The Washington State Environment Policy Act, the Grant County Comprehensive Plan, the Grant County Zoning Ordinance, and all applicable local, state, and federal regulations, rulings or requirements. 2. Developmenti shall comply with all applicable requirements of the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. Development shall comply with all conditions imposed by the Grant County Public Worlcs Department including but not limited to: 1. Provide Re-Plat checic fee of $100.00 2. Conform to the basic plat requirements including: a. Provide a proper legal description b. Provide U.S.B.R data c. North Arrow d. Provide seal, signature and statement of surveyor e, Scale 1" to 100' nunimum f. Provide all boundary lines, existing easements and dedications with Auditor File Numbers and all proposed easeinents and dedications g. Provide a 5' utility easement along all lot lines and county roads h. Access permit shall be obtained prior to a building permit 4, Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic watar supply, sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards and WAC 246-272, On-Site Sewage Systems. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. Proposal shall comply with all requirements of the Grant County Auditor. Preliminary Plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of July 17, 2000. 9. The Re-Plat shall be surveyed by, or under the supervision of a registered land surveyor. 10. The preparation of the final Re-Plat shall be certified on the Re-plat by said registered land surveyor that it is a true and correct presentation of the lands actually surveyed. FINDINGS OF FACT: The following are (3) three Findings of Fact, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Plat Alteration. 1) The Grant County Board of County Commissioners has concluded that appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parlcs, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements have been made 2) The proposed subdivision does conform to the General Purpose of the Comprehensive Plan in effect at the time the proposal was deemed technically complete, and public use and interest will apparently be served by the proposal. 3) A Determination of Non-Significance (DNS) was issued on July 17, 2000 and the requirements of SEPA have been met. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Conunissioners for Grant County, Washington approve by this Resolution the Plat Alteration of Lots 214 & 215, of Desert Aire No. 1 into (1) one lot approximately 0.500 acres in size located in a portion of Section 22, Township 14 North, Range 23 East, Willamette Meridian, Grant County, Washington.
