RESOLUTION NO. 200o-98=cc RESOLUTION APPROVING A PLAT ALTERATION Paul McConlcie WHEI2EAS, the Board of County Commissioners of Grant County have been advised Uy the Grant County Planning Cominission that an open record public hearing was conducted on August 2, 2000, on the matter oi a plat alteration of a portion of Farm Unit 116, Blocic 41, creating one 5.92 acre parcel located in Section 25, Township 19 North, Range 28 East Willamatte Maridian, Grailt County, Washington. The applicant requesting that the lot be created for eventual development in the Suburban 1 Zone of Grant Cotulty; WHEI2EAS, the Grant Couizty Pl�nning Commission on August 2, 2000 made a recommendation to the Board of County Commissioners to approve, with conditions, this proposed plat alteration; WHEREAS, the Grant County Board of Commissioners held a closed record public meeting on August 21, 2000; WHEREAS, the Board of County Commissioners has made a decision to uphold the recommeildation to approve, with conditions, the proposed plat alteratioiz request; WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; WHEREAS, the Board of County Conunissioners h�ve found that the public use and interest will apparently be served by the plat alter�tion; WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, a plat alteration of a portion of Farm Unit 116, Block 41, creating one 5.92 acre parcel located in Section 25, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington. CONDITIONS: The following are conditions of approval, used in the Grant County Board of County Commissioner's closed record public meeting to approve the Plat Alteration. L The Proposal shall be in compliance with the Grailt County Comprehensive Plan, the Growth Managament Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Gxant County Resource L�nds and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic w�ter supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 3. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection/life safety. 4. Proposal shall comply with all requirements of the Grant County Public Worlcs Department. 5. Proposal shall coinply with all requirements of the Grant County Auditor. 6. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all constr-uction activity shall stop and the owner/developer shall immediately notify t1�e Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 7. Approval of the pl�t alteration shall be contingent upon conforinance with all applicable land use rules and regulations in effect as of June 29, 2000. 8. Proposal shall coinply with all requirements of the United States Department of the Interior, Bureau of Reclaination and the East-Columbia Basin Irrigation District, Including, but not limited to: a) Rights-ol way for the EL20, EL20Y and EL20Z Canals have not been properly indicated. EL20Yis 75 feet; yet , the proposed replat only shows 19 feet and 45 feet respectively. This will need to be corrected prior to Reclamation's approval of the final plat. b) Since this proposal involves the developinent of a portion of Fann Unit 116, Irrigation Block 41, as a separate and individu�l site, it is recommended that the agricultural water supply be released for the portion under 10 acres. c) Reclamation has revised the language previously required on formal docusnents involving ColumUia Basin Project lands and water interests. Accordingly, the following language will be required on the final plat prior to approval. Revised Lan uage Bureau of Reclamation concurrence for this plat is limited to the extent of the plat's coinpliance with the requirements of RCW 58.17.310. Drain Construction: Rising ground water tablas are common in irrigation proj ects. Federal drain construction funds are not available for draining subdivisions and other areas not in a commercial agriculture land use, unless such drain is incidental to the required drainage of adj acent agricultural land and meets Federal technical and economic feasibility requirements. This land is included within the Columbia Basin Trrigation District and is subject to the laws of the United States and the State of Washington relative to the Columbia Basin Project and is liable for further assessments, if any, levied by said District. It is also understood and agreed that when this pl�t is served by county roads all irrigable lands within the road right-of way or isolated by said dedication will not become a charga assessable to County and payable to the Columbia Basin Irrigation District for construction operation and maintenance of the Project. District Secretary-Manager Bureau of Reclamatiozl IRRIGATION APPROVAL: Water Supply: Concurrence by the Bureau of Reclamation %r this plat does not assure the availaUility of a water supply, nor does it bind the United States to issue a permanent right for a Federal water supply. A supply of Fedaral project water to this land is assured only upon full compliance with corollary Federal and State legislation. Paul McConkie d) Where as, this proposal is bordered on the west and north by Project facilities it is recoinmended that the proponent contact the District to attain written authorization to cross these facilities and rights-of-way prior to the start of construction. e) Discharges from urban areas have the potential of degrading downstream Project water supplies with sediments, oils, greases, chemicals, and other pollutants. Therefore, all discharge proposals need to be reviewed and approved by Reclamation. 9. Proposal shall coinply with all requirements of the Grant County Assessor's Office.
