M., GRANT COUNTY, WASHINGTON RESOLUTION NO. 2000-88-CC RESOLUTION APPROVING MOSES POINTE, PHASE 1, FINAL PUD MAP M. H. MOORE PROPERTIES WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on May 3, 2000 on the matter of Moses Pointe, Phase 1, Final PUD Map, Final Planned Unit Development of Phase l, Moses Pointe Subdivision which includes 186 single-family lots, 36 multi-family lots, I 1.11 acre commercial site, 122.08 acre golf course and associated facilities, The proposal is for the acceptance of Phase 1 of the Moses Pointe Planned Unit Development, Final Development Plan. Phase 1 of the Moses Pointe subdivision includes 186 single-family lots, 36 multi-family lots, an 11,11 acre commercial site and 122.08 acre golf course and associated facilities. WHEREAS, the Grant County Planning Commission made a recommendation to approve the Moses Pointe, Phase 1, Final PUD Map at the open record public hearing on May 3, 2000 with twelve (12) conditions of approval; and, WHEREAS, the Grant County Board of Commissioners held a public meeting on May 22, 2000 at 3:30 P.M. in the Commissioners Hearings Room of the Courthouse in Ephrata, Washington; and, WHEREAS, the Board of County Corrunissioners have made a decision to uphold the recommendation from the Grant County Planning Commission to approve the Moses Pointe, Phase l, Final PUD Map; and, WHEREAS, the Upland Wetlands Mitigation Plan and the Shoreline Mitigation Plan have been reviewed and approved by the Grant County Planning Staff; and, WHEREAS, it is recognized that the Grant County Planning Staff is empowered to make mi.nor adjustments in the Planned Unit Development after its final approval administratively; and, WHEREAS, the Board of County Commissioners have upheld the findings and conclusions of the Grant County Planning Commission; and, WHEREAS, the Board of County Commissioners have found that the Final PUD Map is consistent with the approved Moses Pointe Planned Unit Development concept plan; and, Page 2 of 5 Resoiution Approving Moses Pointe, Phase I, Final Planned Unit Development Map WHEREAs, the Board of County Cornmissioners have found that the Final PUD Map does comply with the conditions of approval of the Findings, Conclusions and Final Decision of the Grant County Baard of Commissioners; and, WHEREAs, the Baard of County Cammissioners have found that Final PUD Map does comply with the cond'ztions of the Mitigated Determination of Non-Significance; and, WHEREAS, the Board of County Cammissioners have faund that Final PUD Map does comply with the canditions af the Substantial Develapment Pernnit; and, WHEREAs, the Board af County Cammissianers have appraved the Mases Pointe, Fhase l, Final PUD Map subject to the follawing twelve (12) conditians af approval as recommended by the Grant County Planning Con�unissio�, CONDITIONS OF APPR(�VAL: 1. The Proposal shall be in compliance with the Grant Caunty Comprehensive Plan, the Growth Management Act, The Washingtan State Environmental Policy Act, the Grant County Zaning Ordinance, the GranC County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulatians, rulings or requirernents. Propasal sha11 comply with all requirements deemed necessary by the Grant County Health District, the Washington State Departrnent of Health, and the W ashington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to, RCW 90.48A80 Discharge of Polluting V�Iatar Prohibited, WAC I73-201, Surface Water Standards; WAC 173-201A, Graund Water Quality Standards; and, WAC 246-272, �n-Site Sewage Systems. 3. Proposal shatl comply with all requirements of the Grant County �ire Marshal and shall compiy with the Gra�t Caunty Fire Flow Guidelines, the Unifarm $uilding Cade, tJniform Fire Code and all other applicable requirements for fire protection/life safety, including, but nat timited to the foliowing: a. All turn-arour►ds must have a 60 ft. radius. 4. Progosal shall comply with all requicements of the Grant Caunty F'ublic Works Department, including, but not limited ta the following: a) Final plat shall not be approved until both the public water and sewer system are installed and aperatianal. Discussians are currently underway with the City of Moses Lake but the lacakion, design and agreement have not bean finalized. b) Westshore Drive to `4' NE and `4' NE westerly from Westshore Drive are currently designated as rnajor County arterials. The rninimum dedicated right of way for these two sections must be increased to70' . c) Although the design far the re-alignment of Westshore Drive has been technically approved, it would be advisable for the proponent to include left turn channelization at `4' NE. The Page 3 of 5 Resolution Approving Moses Pointe, Phase 1, Final Planned Unit Development Map proponent committed to such innprovements and a left turn pocket will be needed for safety if Phase I is approved as presented. Revising the design now would be significantly cheaper. d) Road layout, design, and construction for internal roads must meet current County Standards for urban access. Due to lot sizes proposed the minimum finished width is 36' with curbs or 38' without curbs. Cul-de-sac lengths must be between 150' minimum and 1320' maximum. Minimum horizontal curve length to be 410' for flat areas and 200' for rolling areas. Design speed to be 25 MPH. (Westshore Drive design speed + 35 MPH) e) Utility easements must be provided along all lot lines. � A minimum of 260' of approach sight distance must be available for each lot unless located at a controlled intersection. g) All utilities shall be installed and extended beyond roadway prism before roadway is complete. h) $100 plus $2.00 per lot review fee must be paid before final approval. i) A11 road improvements must be completed or adequate securities provided prior to final approval. j) All roads shall be built to current County standards whether public or private. k) No cul-de-sacs shall exceed 1320' . 1) Agreement between the developer and the Grant County Public Works Director shall be required prior to Grant County accepting final plat for filing specifically in relation to County Road `4' NE between Westshore Drive and the body of water of Moses Lake. 5. Proposal shall comply with all requirements of the Washington State Department of Transportation. 6. If any Native American Grave site(s) or archaeologicaUcultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 7. Preliminary Plat shall comply to the fullest extent possible the recommendations of the Washington State Department of Fish and Wildlife listed below: 8. Development shall comply with all requirements of the Mitigated Determination of Non-Significance dated May 18, 1992. 9, Development shall comply with all requirements of Grant County Resolution #92-80-CC, A resolution approving the Moses Pointe project, entering findings of fact and conclusions of law, and directing a code amendment, dated June 16, 1992. 10. Development shall comply with all requirements of the Compromise and Settlement Agreement dated December 2, 1993 between M. H. Moore Properties, State of Washington Department of Ecology, and Grant County. 11. Development shall comply with all requirements of the Grant County Auditor. 12. Development shall comply with all requirements of the Grant County, Department of Emergency Services including changing the names of the roads as are indicated in the letter from the Department of April 28, 2000.
