SUBJECT � RESOLUTION APPROVING SITE IS LOCATED 1N A PORTION OF � A PLAT ALTERATION SECTION 32, TOWNSHIl' 19 NORTH, � RANGE 29 EAST, WM, GRANT COLJNTY, � Dale Wallcer WASHINGTON. I WHEREAS, the Board of County Commissioners of Grailt County have Ueen advised by the Grant County Planning Commission that an open record public hearing was conducted on June 7, 2000, on the matter of creating three lots from lots 2& 3 of the Wallcer Industrial Short Plat, which is located in a portion of Section 32, Township 19 North, Range 29 East, Willainette Meridian, Grant County, Washington. The applicant has requested that the three lots be created for eventual development in the Heavy Industrial Zone of Grant County; WHEREAS, the Grant County Planning Commission oii June 7, 2000 inade a recommendation to the Board of County Coinrnissioners to approve this proposed plat alteration; WHEREAS, the Grant County Board o� Commissioners held a closed record public meeting on June 26, 2000; WHEItEAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration request; WHEREAS, the Board of County Commissioners have found that the proposal is consistent with tihe Grant County Comprehansive Plan; WHEREAS, the Board of County Comtnissiollers have found that the public use and interest will apparently be served by the plat alteration; WHEREAS, the Board of County Commissioners have found that the proposal will not adyersely effect the health, safety, and general welfare of the public in the vicinity of the proposal; NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, a plat alteration to create three lots from Lots 2& 3 of the Wallcer Industrial Short Plat, which is located in a portion oF Section 32, Township 19 North, Range 29 East, Willamette Meridian, Grant County, Washington, Page 2 of 4 IN THE MATTER OF CREATING THREE LOTS Dale Wallcer FROM LOTS 2& 3 OF THE WALI�ER INDUSTRIAL SHORT PLAT, CONDITIONS: The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Plat Alteration. 1) The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2) Proposal shall coinply with all requirements deemed necessary by the Grant County Health District, Washington State Departinent of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173� 201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 3) Proposal shall comply with all requiremants of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection/life safety. • 4) Proposal shall comply with all requirements of the Grant County Public Worlcs Department, including, but not limited to the following: a. Provide a complete road plan and profile with all centerline data and drainage facilities. b, Correct distance shown on South line of proposed Lot 3 between L1 and Cl. c. Construction and dedication of access roads as directed by the Public Works Department, including: County platting standards require each lot to be served by a public road and have 50' of frontage on said road. Exceptions are allowed for plats which have fewer than four (4) lotis served by a proposed roadway. However, the exception requires the same dedicated right of way width for future county roads, turn-a-round provisions, frontage width, and a statement that the road must be brought up to current County road standards by the lots owners before acceptance as a County road. If there will be no further land divisions which will utilize the access road it is recommended that Lot 2 as proposed be revised to incorporate all of the access easement From the Frontage Road to the North plat boundary. If there will be other properties in the future utilizing the Page 3 of 4 IN THE MATTER OF CREATING THREE LOTS Dale Wallcer FROM LOTS 2& 3 OF THE WALKER INDUSTRIAL SHORT PLAT. . access road the access dedication needs to extend to the North plat boundary, temporary cul-de-sac provision provided, and an acceptable statement on maintenance and upgrade placed on the face of the plat, d, Access pennit must be obtained prior to a building permit. e. Provide a Re-Plat fee of $100.00. 5) Proponent shall address cominents of the Washington State Department of Transportation and comply with all jurisdictional requirements of that agency, including but not limited to the following: a. Any actual development proposed for the re-plat lots will be accompanied by a traf�'ic study signed by a licensed professional engineer and approved by DOT. 6) Proposal shall comply with all requirements of the Grant County Auditor. 7) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 8) Preliminary Re-plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of December 3, 1999. 9) Prelirninary Re-plat approval shall be contingent upon conformance with all wetland regulations associated with the property including but not limited to the following: a, The wetland area and 10-foot buffer area recommended in the 1999 Geographical Services Wetlands Evaluation shall be protected, by highly visible markers or barriers, during development of the site and during future use of the site, No vehicle traffic, material storage or disturbance of the soils or vegetation should talce place within the wetlands or buffer zones. b. The wetland area and buffer zone should be put into a perrrlanent form of protection such as a conservation easement. a Landscaping, storm-water treatment and commercial activities shall be conducted so as to minimize impacts on the wetlands and buffer zone. Waste materials and cheinicals, including poisons and fertilizers shall be prevented from damaging contact with the wetlands and the Uuffer area. d, Any surface water flow into the wetlands from paved or impervious surfaces must be delivered through installations such as channels or grassed waterways so that state water quality standards are met. e, There should be no free ranging pets or domestic animals allowed in the wetland or the bufFer zone. Dale W�lker f, Failure to prevent impacts to the wetlailds or buffer zone by site development or future use of the site will result in non-compliance with the Grant County Resource Lands and Critical Areas Development Ordinance. 10) Proposal shall comply with all requirements of the United States Department of the Interior, Bureau of Reclamation and the East Columbia Basin Irrigation District, ilicluding but not limited to the following; a. Obtaining a water seivice contract from Reclamation for use of ground water for other than doinestic purposes (5,000 gallons per day / irrigation of %2 acre per dwelling). b, Include on final plat the appropriate mapping and labeling of the EL291ateral canal along the borders of proposed lots 2 and 3. c. Any work that will involve this irrigation facility or the existing right-of —way must be reviewed and approved by Reclamation and the East Columbia lrrigation District prior to proceeding. 11) Proposal shall comply with all requirements of the Grant County Assessor's Office.
