RESOLUTION REGARDING RCW RESOLUTION No. 16-023-CC
42.56.070(3) OF THE PUBLIC RECORDS
ACT PERTAINING TO MAINTAINING
CURRENT INDEX/INDICES OF
COUNTY RECORDS
WHEREAS, Grant County is a local agency under the Public Records Act codi�ed in
Chapter 42.56 RCW; and
WHER�AS,pursuant to the provisions of RCW 42.56.070(3) of the PLtblic Records Act,
each local agency shall inaintain and make available for public inspection and copying, a current
index providing identifying information as to certain records, issued, adopted or promulgated
after January 1, 1973; and
WIIEREAS,RCW 42.17.260(4) fiirther provides that a local agency need not inaintain
such an index, if the agency finds that maintenance of such index would be unduly burdensome;
and
WHEREAS, Grant County adopts, orders and receives hundreds, if not thousancls, of
memo's, studies, correspondence and other materials which inight be required to be included in
such indices;
NOW,THEREFORE,BE IT RESOLVED,that the Grant County Board of
Coinmissioners hereby finds that:
1. Grant County is comprised of offices for ten different non judicial elected officials
and over twenty additional depai-tinents, their divisions and subdivisions,many of
which are located in numerous locations throughout the County; and
2. Elected officials, County Departments and their divisions maintain separate record
keeping systems; and
3. The County records are diverse, complex and stored in multiple locations and various
recording systems, paper and electronic, which make it physically impossible to
maintain a central index of records; and
SE IT TURTII�R RESOLVED, that the Board of County Commissioners finds that it
would be unduly burdensome to create and maintain an index as required by RCW 42.56.070(3),
as it would interfere with and impair County operations; and
BE IT FURTII�R RESOLVED,by the Board of County Commissioners that,pursuant to
these findings and the provisions of RCW 42.56.070(4), Grant County need not maintain an all-
inclusive index of public records as provided by this RCW; and
BE IT FURTHER RESOLVED, that Grant County employees shall continue to provide
courteous, efficient and helpful assistance to the public reqltesting access to public records and
information.
