HomeMy WebLinkAboutResolution 07-148-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: 1N THE MATTER OF APPROVING A PRELIMINARY SUBDIVISION OF A 22.6- -ACRE PARCEL, LOT 1 OF STACY SHORT PLAT 1NT0 FOUR (4) LOTS LOCATED IN A PORTION OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 3, TOWNSHIP 20 NORTH, RANGE 26 EAST, WM. GRANT COUNTY, WA RESOLUTION No. 2007-��� CC A SUBDIVISION OF LOT 1 OF THE STACY SHORT PLAT UMBARGER & RAY WHEREAS, the Crrant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on September 5, 2007 in the matter of a preliminary plat of a 22.6-acre parcel, Lot 1 of Stacy short plat located in the southwest quarter of the southwest quarter of Section 3, Township 20 North, Range 26 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on September 5, 2007 recommended to the Board of County Commissioners to approve this proposed preliminary plat with nine (9) conditions of approval and twelve (12) findings of fact in the affirmative; and, WHEREAS, the Grant County Board of Corrnnissioners held a closed record public hearing on October 23, 2007; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and a summary of the Planning Commission hearing; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unifed Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat; and, WHEREAS, the proposed plat, subject to the conditions of approval, meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, TWO SISTERS PLAT UMBARGER & RAY WHEREAS, the proposed preliminary plat alteration does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary plat alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat alteration does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners has made a decision to approve the Two Sisters Plat. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with nine (9) conditions of approvallisted below, a preliminary plat of the lot 1 of the Stacy Short Subdivision located in the southwest quarter of the southwest quarter of Section 3, Township 20 North, Range 26 East, Willamette Meridian, Grant County, Washington. Parcel #31-2468-000. CONDITIONS OF APP1tOVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal sha11 comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 3) If any Native American Crrave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) Approval o�the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of May 18, 2007. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress/egress. 6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: TWO SISTERS PLAT UMBARGER & RAY a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage-ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) Development shall coinply with all requirements of the Grant County Public Works; including, but not limited to: a) Provide a plat review fee of $50.00. b) Provide a plat certificate from the title company for all land being dedicated to Grant County. c) An approach permit must be obtained prior to the issuance of a building permit. 8) Development shall comply with all requirements of the Grant County Emergency Services; including, but not limited to: a) Address for each lot needs to be posted at driveway access. 9) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non- Significance issued by Grant County on May 24, 2006. BOARD OF COUNTY COMMISSIONERS FINDINGS OF FACT The Board of County Commissioners may want to consider the following ffndings of fact in making its decisaon to approve, approve with modifications, remand or deny the proposed plat alteration application. (1) The proposed subdivision does / does not meet the applicable requirements of UDC Chapter 22.04 "Subdivisions and Plats"; (2) The proposed subdivision does / does not serve the public use and interest; (3) The proposed subdivision does / does not comply with the Comprehensive Plan, the Shoreline Master 1'rogram, the zoning coda and other land use regulations, and SEPA; (4) The proposed subdivision does / does not coinply with health requirements for sewage disposal and potable water supply; (5) The proposed subdivision does / does not contain an accurate legal description of the lots being created, and the roads and easements therain; (6) The proposed subdivision does / does not comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; (7) The best available science has / has not been considered in the final decision regarding the preliminary plat. TWO SISTERS PLAT UMBARGER & RAY (8) The proposed subdivision does / does not comply with requirements of the U.S. Department of Interior, Bureau of Reclamation and the East-Columbia lrrigation District. (9) The phasing plan does / does not include all land within the preliminary subdivision. (10) Each phase is / is not an independent planning unit with safe and convenient circulation and with facilities and utilities coordinated with the requirements established for the entire subdivision; and, (11) All road improvement requirements are / are not ensured pursuant to GCC § 22.04.450. (12) The proposed subdivision does / does not appropriately identify and protect critical areas pursuant to GCC § 24.08. � "� Dated this � day of ��%'��f`�,� '�, , 2007.
