HomeMy WebLinkAboutResolution 07-147-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: 1N THE MATTER OF APPROVING A PLAT ALTERATION OF THE LOT 17 OF THE LARSON SUBDIVISION LOCATED 1N A PORTION OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 4, TOWNSHIP 19 NORTH, RANGE 28 EAST, WM. GRANT COUNTY, WA RESOLUTION No. 2007- ��7-CC A PLAT ALTERATION OF THE LOT 17 OF THE LARSON SUBDIVISION STEVE BRUNS WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on September 5, 2007 in the matter of a preliminary plat alteration of the lot 17 of the Larson Subdivision located in the southwest quarter of the northwest quarter of Section 4, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on September 5, 2007 recommended to the Board o� County Commissioners to approve this proposed preliminary plat alteration with six (6) conditions of approval and six (6) findings of fact in the affirmative; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on October 23, 2007; and, WHEREAS, the Board of County Commissioners, have reviewed the application inaterial, staff report and a summary of the Planning Commission hearing; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; and, WHEREAS, the proposed plat alteration, subject to the conditions of approval, meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, A PLAT ALTERA.TION OF LOT 17 OF THE LARSON SUBDIVISION STEVE BRUNS WHEREAS, tlie praposed prelizninary plat alteration does comply with the Health District's requirements far sewage dispasal and potable water supply; and, WHEREAS, the prapased prelimi��ary plat alteration does contain an accurate legal description of the lots bein�; created, and the roads and easements therein; and, WHEREAS, the praposed preliininary plat altaration does cornply with Grant County regulations pertaining to roads, utilities, drainage, acoess far emergency vehicles, and ather infrastructure improvements; and, WHEREAS, the Baard of County Comrnissianers have made a decision to approve the preliminary plat alteration of the lat 17 of the Larsox� Subdivision. NOW, THEREFORE, $E IT RESOLVED, that the Board of County Coinmissioners for Crrant County, Washington approve by this Resolution, with six (6) con�litions of approval listed below, a preliminary plat alteration of the lat 17 of the Larson Subdivision located in the southwest quarter of the northwest quarter of Section 4, Townsllip 19 Nor�h, Range 28 East, Willamette Meridian, Grant Courlty, Washington. Parcel #31-0017-000. CONDITIONS OF APPROVAL: 1) Developrnent shall be in compliance with the Washington State E1lvironmental Policy Act, the Gxant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable 1oca1, state, and federal regulatians, rulings or requirements. 2) Proposal sha11 camply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecolagy regarding dornestic water supply, sewage systems and storn7 water control and treatnlent ii�cludin�, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 3) Tf any Native American Grave site(s) or archaeologicallcultural resources (Indian Artifacts) are found all construction activity shall stap and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washingtar� Siate Office of .Archaeology and Histaric Preservatian. 4} Approval of the plat shall be contingent upon co�lfonnance with all applicable land use rules and regt�lations in effect as af Augus� 13, 2007. S) This propasal shall coxnp�y with all the requirements of the Grant County Public Worlcs Departinent; including but not limited to, provide a plat xeview fee af $50.00. 6) Develapment shall camply with a11 requircments of the Grant County Flanning Department, including but not limited ta: a) All pertinent requirements listed in UDC Chapter 22.Q4 Article V Final Subdivisions. b) Tha Grant County Code 22.04.2EiQ Time Limitations. A PLAT ALTERATION OF LOT 17 OF THE LARSON SUBDIVISION c) d) STEVE BRUNS On the final map the parcel #17-0145-000 shall be identified as the lift station "D" conveyed to the City of Moses Lake. Additionally, an easement for ingress and egress 20.00 Feet in width centered on the following described line shall be shown: "Beginning at a point S 15°06'48" E 26.00 feet from the point of beginning; thence N 70°04' 12" E 29.87 feet to the westerly right-of-way of a county road lcnown as Patton Blvd." In the zoning information blocic (sheet 1 of 2) "Max DU Density: 8/acre" shall be changed to "Density: 4-8 DUs/acre." BOARD OF COUNTY COMMISSIONERS FINDINGS OF FACT The Board of County Commissioners may want to consider the following findings of fact in making its decision to approve, approve with modifications, remand or deny the proposed plat alteration application. (1) Does / Does not meet the applicable requirements of UDC Chapter 22.04 "Subdivisions and Plats"; (2) Does / Does not seive the public use and interest; (3) Does/ Does not comply with the Comprehensive Plan, the Shoreline Master Program, the zoning code and other land use regulations, and SEPA; (4) Does /Does not comply with health requirements for sewage disposal and potable water supply; (5) Does /Does not contain an accurate 1ega1 description of the lots being created, and the roads and easements therein; (6) Does / Does not comply with Crrant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure iinprovements.
