HomeMy WebLinkAboutResolution 07-142-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PRELIMINARY BINDING SITE PLAN FOR THE DESERT AIRE SHOPPING CENTER LOCATED 1N A PORTION OF SECTION 23, TOWNSHIl' 14 NORTH, RANGE 23 EAST, WM. GRANT CO. WA. RESOLUTION No. 2007-/�Z-CC APPROVING A PRELIMINARY B1NDING SITE PLAN DESERT AIRE SHOPPING CENTER BINDING SITE PLAN WHEREAS, the Grant County Board of County Commissioners have been advised th�t an open record public hearing was conducted, before the Grant County Planning Commission on August 1, 2007, on the matter of a preliminary Binding Site Plan of approximately 8.81 acres approximately 801ots; located in a portion of Section 23, Township 14 North, Range 23 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on August 1, 2007 did approve � motion to recommend to the Board of County Commissioners to approve this proposed preliminary binding site plan with eleven (11) suggested conditions of approval; and, WHEREAS, the Grant County Board of Comrnissioners held a closed record public hearing on October 16, 2007; and, WHEItEAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposal will not �dversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent witl� the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary binding site plan; and, WHEREAS, the proposed preliminary binding site plan meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, IN THE MATTER OF APPROVING A PRELIMINARY BINDING SITE PLAN OF APPROX. 8,81 ACRES 1NT0 80 LOTS DESERT AIRE SHOPPING CNTR. PRELIMINARY BINDING SITE PLAN WHEREAS, the proposed preliminary binding site plan does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary binding site plan does contain an accurate legal description of the lots being created, and the xoads and easements therein; and, WHEI2EAS, the proposed preliminary binding site plan does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other ii�frastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the Desert Aire Shopping Center preliminaxy binding site plan. NOW, THEREFORE, BE IT HEREBY RESOLVED THAT, the Board of County Comrnissioners for Grant County, Washington approve by this Resolution, with the eleven (11) conditions of approval listed below, a preliminary binding site plan of approximately 8.81 acres into 801ots; located in a portion of Section 23, Township 14 North, Range 23 East, Willamette Meridian, Grant County, Washington. CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, �iad all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall iinmediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) Approval of the binding site plan shall be contingent upon conformance with all applicable land use rules and regulations in effect as of April 5, 2007. 5) Dluing road grading and/or construction activities, county roads shall be maintained clear of soil and rocics at the point of ingress and egress. 6) This proposal shall comply with the requirements of GCC 23,12.080 Clearing, Grading and Drainage Standards, including but not limited to: 1N THE MATTER OF APPROVING A PRELIMINARY BINDING SITE PLAN OF APPROX. 8.81 ACRES INTO 80 LOTS DESERT AIRE SHOPPING CNTR. PRELIMINARY B1NDING SITE PLAN �) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage-ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) This propos�l shall comply with the requirements of GCC 23.12.100 Road Standards, including but not limited to: a) Road names shall be approved by the Grant County Emergency Services Department and shall be established using the addressing and grid system delineated in GCC 10.36. 8) Development shall comply with all requirements of the Grant County Health District, including but not limited to: a) An evaluation must be made of the existing community septic system. It has limited capacity and may not be adequate for the flow of waste-water proposed. 9) Developinent shall comply with all requirements of the Grant County Public Works Dep�rtmant, including but not limited to; a) A11 improvements agreed upon by the developer and the Public Works Department shall be completed prior to final approval. 10) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04. b) Comply with a11 requirements listed in the SEPA Mitigated Determination of Non-Significance issued by Grant County on July 13, 2007. c) Add tha following "block" of information to the final plat.
