HomeMy WebLinkAboutResolution 06-263-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington A RESOLUTION RATIFYING THE APPROVAL OF THE SALE OF GRANT COUNTY PERSONAL PROPERTY LOCATED IN MOSES LAI�E, WASH]NGTON, CALLING FOR A PUBLIC AUCTION AND, OTHER MATTERS PROPERLY RELATED THERETO 3 RESOLUTION NO, O6 � -CC A RESOLUTION OF THE BOARD OF COUNTY CONIMISSIONERS OF GRANT COUNTY, WASHINGTON: HAVING FOUND AND DETERMINED THAT IT APPE�RS THAT IT IS FOR THE BEST INTERESTS OF GRANT COUNTY AND THE PEOPLE THEREOF THAT THE GRANT COUNTY PERSONAL PROPERTY AS SET FORTH HERElN SHOULD BE SOLD; SETTING A MNINIU M BID; REQUESTING THAT THE GRANT COUNTY TREASURER HOLD A PUBLIC AUCTION REG�RDING SAME; AND, PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO. WHEREAS, Grant County, Washington (County), is a Class 3 County, duly organized and existing tinder the Constitution and �he laws of i;he State of Washington; and WHEREAS, the Board of County Commissioners (BOCC) is authorized to conduct proceedings and to sell surplus property when it appears that it is for the best interests of the County and the paople thereof that the Coui�ty property should be sold, pursuant to the limitations and restrictions and in the manner provided in chapter 36,34 RCW; and WHEREAS, the County Public Worlcs Department purchased real property located at 4862 Grape Drive NE, Moses Lalce, Grant County, Washington, Lot 1 Pomeroy Park Plat, Grant County Assessor's Parcel No, 61-2569-000, for the acquisition of right of way necessary for the Couniy's road system; and A RESOLUTION APPROVING THE SALE OF COUNTY PERSONAL PROPERTY LOCATED IN MOSES LAKE, WASHINGTON, AND CALLING FOR A PUBLIC AUCTION Page 1 of 4 Y:\Civil 8\Departmants\Treasurer\Surplus Personal Properly\Resolution.doc WHEREAS, said property coi�taii�s a 2000 Champion Oal�land Cottage Manufactured Home, TPO +390791, Serial No, 17005230875, a"double wide" manufactured home (Manufactured Home), with approximately 1,344 square feet of living space, inchtding three bedrooms, two baths, forced electric furnace and air conditioning; and WHEREAS, the improvement on the subject property, i.e., Manufactured Home, is �zot in current use by the County, and is not needed by the County; and WHEREAS, it appears that it is for the best interests of the County and the paople thereof that the Manufactured Home should be sold olf of the real property; and WHEREAS, the statutory notice of intention to sell property requireme�zts regarding the aforementioned public hearing were followed by tihe County, including without limitation, posting and publication; and WHEREAS, the BOCC considered the sale of the subject personal property during the public hearing held pursuant to law on May 2, 2006, at 2; 00 pm, in the BOCC Hearing Room, Grant County Courthouse, 37 C Street NW, Ephrata, Washington; and WHEREAS, during the public hearing, the BOCC considered the proposal to dispose of the subject property and admittad evidence offered for and against the propriety and advisability of the proposed action to sell the subject County property; and WHEREAS, the Assessor's Office (AO) provided a written opinion, establishing th� combined value of the real property and the Manufactured Home at Forty-Five 'Thousand, Three Hundred, Fifty-Five and No/100 Dollars ($45,355.00); and WHEREAS, the AO provided a written opinion, establishing the value of the Manufactured Home removed from the real property at Twenty-Six Thousand, Seven Hundred, Fifty-Five and No/100 Dollars ($26,755.00); and WHEREAS, no objections to the County's sale oF the subject personal �roperty were presented to the BOCC during the aforementioned public hearing; and WHEREAS, the BOCC passed and adopted County Resolution No. 06-155-CC, declaring the �Manufactured Home surplus, setting a minimum bid, directing the County Treasurer to conduct an auction selling same and, other matters properly relating thereto; and A RESOLUTION APPROVING THE SALE OF COUNTY PERSONAL PROPERTY LOCATED 1N MOSES LAKE, WASHINGTON, AND CALLING FOR A PUBLIC AUCTION Page 2 of 4 Y:\Civil 8\Departments\Treasurer\Surplus Personal Property\Resolution,doc WHEREAS, the aforementioned resolution contiains scriveners' errors in need of correction, as set forth herein; and WHEREAS, the BOCC does hereby ratify, confirm and approve its decision of May 2, 2006, to surplus and auction the Manufactured Home, setting a minimum bid and, other matters properly relating thereto; and WHEREAS, County Resolution No, 06-15S-CC is hereby repealed to the extent that it is inconsistent with this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE BOAR.D OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: Section 1: The BOCC has previously found and determined that it is for the best interests of Grant County and the people thereof that the County personal property as set forth herein, i.e,, Manufactured Hoine, is hereby declared surplus. Said decision is ratified, confirmed and approved herein, Section 2: The BOCC intends to offer the subject personal property, i,e., Manufactured Home, for sale for the minimum bid of Twenty-Five Thousand and No/100Dollars ($25,000.00), upon such terms and conditions as to the BOCC inay seem right in the premises. Seetion 3: The Grant County Treasurer is hereby directed to hold and supervise a public auction on the proposition as set forth herein, in accordance with law. Net proceeds of the sale, lass costs of sale, are to be deposited into the Grant County Road Fund. Section 4: All actions heretofore talcen in connection with the proposal to dispose of the subj ect County personal property by the County and its officials, officers and employees that are not inconsistent with the provisions of this Resolution are hereby ratified, confirmed and approved. Seetion 5: All resolutions or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of adoption, Section 6: County staff shall prepare the necessary papers for the sale of the subject County personal property upon such terms and conditions as the BOCC deems just and right in the prexnises as set forth herein, in accordance with law. The successful purchaser of the Manufactured Home shall lawfully remove same from the real property within ninety (90) days following completio�i of the sale to receive title.
