HomeMy WebLinkAboutResolution 06-245-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON ORDINANCE: 06 a�%S-CC An Ordinance relating to the amendment of the Unified Development Code §23.04.800(m) regarding duration of approval for Planned Unit Developments. Recitals: WHEREAS, the Board of County Commissioners of Grant County intends to comply fully with the laws and regulations of the State of Washington, and; WHEREAS, the Board of County Commissioners of Grant County adopted a Growth Management Act compliant Comprehensive Land Use Plan in September of 1999, and; WHEREAS, the Board of County Comrnissioners of Grant County adopted a Uni�ed Development Code implementing the Comprehensive Plan on October 1, 2000, and; WHEREAS, the Unified Development Code Chapter 25.12 "Legislative Action" provides a process for amending the Code, and; WHEREAS, the Grant Count Planning Department initiated an amendment, under Chapter 25.12 to the Unified Development Code by amending Chapter 23.04.800 (m) Duration of Approval, and; WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on Apri15, 2006 and May 3, 2006, on the matter of amending the Grant County Unified Development Code, and; WHEREAS, on May 3, 2006 the Grant County Planning Commission voted unanimously to recommend to the Board of County Commissioners, approval of the UDC Amendment request, and; WHEREAS, the Board of County Commissioners of Grant County held an open record public hearing on June 13, 2006 and October 23, 2006, and; WHEREAS, the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendment was processed in accordance with the requirements of UDC Chapter 25.12 "Legislative Action"; and, WHEREAS, the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendment was processed in accordanee with the requirements of UDC Chapter 24.04 "State Environmental Policy Act"; and, �ln ordinance relating to amencltnent of the tlni�ed Davelopment Code §223.44.84Q{m) WHEREAS, the Baard of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; and, WHEREAS, the Board of County Commissioners has found that, this UDC Amendment will serve the public use and interest. NOW, THEREFORE, the Board of County Cornmissioners of Grant County does hereby ordain amending as outlined in Attachment 1 tlie Grant County Uni�ed Development Code § 23,04,800 (m}. In addition to the administrative extension above and GCC 22.04.260, PUDs may in additioil be �ranted a maxirnum of two (2) additional two (2) vear extensions by the Board of County Cornmissioners in an open record �ublic hearin��rovided the followin� findin�s are made: 1) The landowner or authorized representative has established aod reasons for the extension; and, 2) Projects includin� subdi of one l at a minimum have initi : or construction or operational activities• and 3) The proposal is found to be substantially in compliance with all re�ulations and requirements of the Unified Development Code and Comprehensive Plan policies and �oals at the time of extension• and 4) The extension is found to be in the public's best interest and will not create a serious threat to the �ublic's health, safety or welfare. Knowledge of expiration date and initiation of a petition for extension shall be the responsibility of the applicant. The County will not provide notification prior to expiration.
