BOCC Action Pursuant to RCW 42.30.110(1)(i) Commissioner Carter called an Executive Session to order at 9;08 a.m. to go until 9:13 a.m. regarding Potential Litigation. In attendance were Commissioners Stevens, Carter, Swartz, Lee Pence, Civil Deputy Prosecuting Attorney, and June Strickler, Administrative Services Coordinator. The session was then continued to 9:20 a.m. Commissioner Carter closed the session at 9:20 a.m. A motion was made by Commissioner Swartz, seconded by Commissioner Stevens, to approve item 1 on the ASC Agenda as presented. The Chair of the Board was authorized to sign the Ram Farms, LLC— Ricl< Mianecki (R. Mianecki Short Plat) File #12-5698-01, Final Plat Submission and Review. The Commissioners approved and signed the Grant Public Works County Payroll Salary Fund for May 3, 2013, TUESDAY, MAY 7, 2013 7:00 a.m. — 9:00 a.m. C Swartz at 20t" Annual Grant County Mayor's Prayer Breakfast (ATEC, BBCC) 9:00 a.m. — 9:20 a.m. Open Record Public Hearing, Ordinance Adopting a New Title to Ch. 6 of the Grant County Code Defining Fire Hazards, Prohibiting Sky Lanterns, and Regulating Open Burning The Commissioners held an Open Record Public Hearing to consider an Ordinance adopting a new chapter to Title 5 of the Grant County Code defining Fire Hazards, Prohibiting the Use of Sky Lanterns, and Regulating Open Burning, Dave Nelson, Fire Marshal and Director of Community Development, discussed how he was approached by the Grant County Fire Chiefs and Fire Commissioners look into the possibility of adopting an Ordinance that would ban sky lanterns as they have been causing forest fires, brush fires, etc. The addition is a new title to Chapter 6(Peace, Safety and Morals) of the Grant County Code to define what a fire hazard is and gives the Fire Marshal or designated representative to define or determine if a fire hazard exists on some premise or property. Also to define open burning, which is a burning of natural vegetation which the Department of Ecology implements but there is not an enforcement for Grant County to enforce this. This also defines recreational fires (camp fires, cooking fires) allowing them within the unincorporated areas within Grant County unless there is a burn ban implemented. Commissioner Stevens asked about "open burning" and asked for clarification. Mr. Nelson stated that Open Burning is regulated under state law and enforced by the Department of Ecology and we are now adopting it locally. Open burning burn piles have to be a minimum of 5 feet in diameter and 5 feet high. Agriculture burning is an entirely different subject and is not being addressed in this Ordinance. Discussion ensued, Burn barrels have been banned since the 1970's, Tom Taylor, Moses Lake Fire Chief, spoke in favor of this Ordinance. Jeremy Burns, Ephrata Fire Chief and Chair of the Grant County Fire Chiefs and Commissioners, spoke in favor of this Ordinance and stated that all Chiefs and Commissioners throughout Grant County are in favor of this Ordinance. Cornmissioner Stevens moved to close the public comment portion of the hearing. Commissioner Carter seconded and the motion passed with 2 Commissioners in attendance. Commissioner Stevens moved to adopt the Ordinance as presented making the effective date June 1, 2013. Commissioner Carter seconded and the motion passed with 2 Commissioners in attendance.
