Commissioners Carter and Stevens were out and excused. As there was no quorum of the Board of
; County Commissioners, all meetings were cancelled. Commission Swartz attended the one meeting
below.

A motion was made by Commissioner Stevens, seconded by Commissioner Swartz,to approve items 3

1. Possible vouchers for Interfund Communications, insurance, legal services,grant administration,
etc.
2. Anticipating: Memorandum of Understanding, School Resource Officer(SRO), Wahluke School
District No. 73, between Grant County, by and through the Grant County Sheriff's Office, and the
Wahluke School District. Term is from date of final signature to the end of the 2019 school year.

The Commissioners held an Open Record Public Hearing to consider changes to the Grant County Code
Chapter 11,04 titled "Maximum Speed Limits". Jeff Tincher, Public Works Director, discussed the
proposed changes:

Commissioner Stevens moved to close the public comment portion of this hearing. Commissioner
Swartz seconded and the motion passed with 2 Commissioners in attendance. Commissioner Stevens
moved to approve the amendments as presented. Commissioner Swartz seconded and the motion

2:15 p.m.—2:25 p.m. Open Record Public Hearing, McAndrews Ave Road/Right of Way
Vacation
The Commissioners held an Open Record Public Hearing to consider a road vacation for
McAndrews Avenue, Jeff Tincher, Public Works Director, read into the record his Engineers
Report:
The Board of County Commissioners of Grant County Washington has received a petition to
vacate that portion of County Road being all that portion of County Road McAndrews Av., Road
Log Number 41615,from Mile Post 0.15 to Mile Post 0.27, lying in Section 8 of Township 19
North, Range 28 East W.M., a/l in Grant County, Washington, as highlighted on the attached
Exhibit A.
The eoard of County Commissioners determined that consideration should be given to the
petition and directed the County Road Engineer to prepare a report on the proposed vacation
and abandonment for a public hearing to be held at 2:15 PM, February 9, 2016. The Notice of
Hearing was published in the County Officia/Newspaper and the Notice o�Hepring was posted at
each termini in compliance with RCW 36.87.050.
The proponents of the petition own the majority of the frontage along the petitioned County
Road. McAndrews Ave has a prescriptive Right-of-Way and is on the active County Road System.
All affected parcels are either owned by the proponents or have frontage on other currently
maintained public roads. Exhibits e—D are site photos from Google Earth. Image
1 find that, this section of County Road is not necessary and useful to the public and the public
would be benefitted by its vacation and abandonment.
Commissioner Swartz read into the record a letter from Larry and Iva Vander Giessen, stating
their oppositinn of the road vacation.

Michael Harris, lives on McAndrews Ave, and stated that he and his wife have personal
healthcare issues and if this road is abandoned, neither a firetruck nor ambulance would be able
to get into the area. He spoke in opposition of this road vacation.
John Doonan discussed his opposition of the vacation. Commissioner Stevens stated the road is
a prescriptive right of way and the County doesn't own the property. It's something that people
drove on for a while and the county came in and suddenly there was a road. He believes the
road may be all on Mr.Jones's property.
Commissioner Swartz asked Mr. Tincher to describe a "prescriptive right of way". Mr.Tincher
said if there is a road that has been maintained by the County for a period of time, and there is
no actual right of way documented, you have 30 feet on the center of the road, the county has
done some maintenance or it's in the road log system, a prescriptive right of way gives the
County the right to have the road there.
Michael Harris understood there was a temporary easement granted to the county when the
property was platted. This road has been maintained by the County.
Mr. Tincher stated Public Works did records research and they couldn't find any documented
public right of way for this road. He also clarified this is in Road District#2.
Rich Royston, discussed his opposition to the road vacation.
Paul Jones with Valley Estates and is the proponent of this road vacation. He discussed his
petition stating one of the property owners decided to put up a fence and the other property
owners in the area were upset. That is when he decided to petition to have this road vacated.
He states there is adequate area for ingress and egress, the others don't want to drive the extra
time to use the other road.
Commissioner Stevens asked about a letter reference by Mr.Jones stating property in question
would be granted back to the subdivision.
Mr. Tincher stated he found a letter to I<nudsen Land Surveying dated 2/10/2002 from the
previous Public Worl<s Director, Derek Pohle, about Montaney Addition#3 which states"road
vacations will be dealt with after approved plat and road design is submitted". Mr. Tincher
stated road vacations must be dealt with via the public process.
Discussion ensued between Jeff Tincher and Paul Jones. Mr.Jones stated he believes there's
and additional letter from Derek Pohle to Vic Jansen about this road vacation issue.
Commissioner Stevens noted that the entire road falls totally on Mr,Jones property. He asked if
the property was surveyed and Mr.Jones stated the stakes are there now. Mr. Tincher stated
he could recommend continuing this hearing until further information is received.
Commissioner Stevens moved to continue this hearing. Commissioner Swartz seconded and
recommended the hearing be continued to March 1, 2016 at 2:00 p.m.

Kendra Oneill,granddaughter of the Harris', stated her concerns for her grandparent's health
care and the ability for emergency services to get to the area. She also asked about the
readdressing of their homes, what is the process? Commissioner Stevens stated the process is
not difficult and they would need to go through the Planning Department.
Commissioner Swartz called for the question and the motion passed unanimously to continue
the hearing to March 1, 2016 at 2:00 pm,
Mr. Doonan asked about public notice process, he was not notified by anyone, Mr.Tincher
stated the RCW requires they post the advertisement in the official paper of record and they
marl<the area. They do not notify the homeowners in the immediate area.
Commissioner Swartz asked Mr.Tincher to send out a reminder letter to those in attendance
today, of the continued hearing,
Yuriy Sorechek(?) stated the access to Mr. Harris' home can be accessed from Caroline Street.
He bought the property 2 years ago and has had his property staked out. The easement wasn't
an issue until he started putting up a fence,
Commissioner Swartz closed and continued the hearing until March 1, 2016 at 2:00 pm.

auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the
auditing officer as required by RCW 42.24.090, in the amounts of$12,247.33, $6,654.46, and
$925,713.86, as recorded on a listing and made available to the Board.

MISCELLANEOUS ITEMS
Commissioner Swartz and Commissioner Stevens approved and signed an amended Current Expense
Levy Certification and Ordinance/Resolution No. 16-012-CC which is proposed 2016 property tax levy
for collection in 2016: $16,681,345.00 levied in 2014 for collection in 2015 plus an increase of
5.05747588%on the maximum tax rate allowed by law which is an estimated increase of$843,655.00.
The original approved certification and ordinance/resolution 15-069-CC were signed November 24,
2015.
