HomeMy WebLinkAboutResolution 11-038-CCBOARD OF COUNTY COIVIIVIISSIONERS Grant County, Washington RESOLUTION No. 11 - Q�°-CC A R�SOLUTION WITII CERTIFICATIONS OI' COMPLIANCE FOR CDBG PUBLIC SERVICES GRANT ONLY WHEItEAS, Grant County is applying to the State Depai�tment of Commerce for fitilding assistance, WI3EREAS, it is necessaiy that certain conditioias be met as part of the applicatioil requirei�lents, WH�ItEAS, Carolann Swartz, Chait• of the Grant County Board of Cotulty Commissioners ("BOCC"), is authorizad to submit this application to the State of Wasl�iilgton on behalf of Grant County. NOW, THEREFORE, be it resolved that Grant County authorizes submissioii of this application to the State Department of Commerce to request Seventy-six Thousai�d Seven Hundred Twenty-two and no/100 Dollars ($76,722.00) and any amended amoui�ts to fu�id public service activities in coordiiaatiozl with the Opportiuuties Industrialization Center of Washi�igto�l, (OIC) and certifies that, if fiulded, iti: • Will comply with applicable provisions of Title I of the Housing aud Commmiity Development Act of 1974, as amended, aild other applicable state and federal laws; and Has provided opportunities for citizen participation comparable to the state's requirements (those described in Section 104(a)(2)(3) of the Housing a�id Comintrnity Developme�it Act of 1974, as amended); has complied with all public hearing requirements and provided citizens, especially low and moderate ii�come persons, with reasonable advance notice o�, and the opportunity to present their views during the assessment of commui�ity development and housii�g needs, during the review of available fii�iding and eligible activities, and o�1 the proposed activities; and • Has provided teclulical assistance to citizens and groups representative of low and moderate income persons that request assistance in developing proposals; and • Will provide opportunitiies for citizens to review and comment on proposed changes in the fiu�ded project and progra�ns performai�ce; and • Will not use assessments against properties owned and occupied by low and moderate income persons or charge user fees to recover the capital costs of CDBG-funded public improvemeilts from low and moderate i�lcome owi�er occupants; aud • Will establish a plan to minimize displacenaent as a result of activities assisted witih CDBG funds; and assist persons actually displaced as a result of such activities, as provided in the Uniform Relocation Assistance azld Real Property Acquisition Policies Act of 1970, as ainended; and • Will conduct and administer its program in conFormance with Title VI of the Civil Rights Act of 1964 and the Fair Housing Act, and will afiirinatively further fair housing, (Title VIII of tlle Civil Rights Act of 1968); and Resolution With Certifications Of Coinpliance Page - 1 Civil 8\Departlnen[s\Resolutions\20I1\CABG\Resolution 4-27-ll Has adopted (or will adopt) and eiiforce a policy prohibiting the use of excessive force by law enforcement agencies witlzin its jurisdiction against any individuals engaged in nozivialent civil �•igl�ts demonstrations; and has adopted (or will adopt) and implement a policy of enforcing applicable state and local laws against physically barring entrance to ox• exit fi�om a facility or location which is the subject of such uoiaviolent civil rights de�nonstration withiil its jurisdiction, in accordance with Section 104(1) of the Title I of the Housing and Coirununity Development Act of 1974, as amended; and • Certifies to meeting the National Enviromnental Policy Act (NEPA) through a determinatioti the CDBG funded public services will �Zot have a physical iinpact or result iil any physical cllanges and are exempt under 24 CFR 58.34(a), and are not applicable to the other requirements unde$• 24 CFR 58,6; and are categorically exempt uilder the State Environmental Policy Act (SEPA) per WAC 197-11-305(2); and Will provide, upon request, and prior to any obligation of funds being �nade, a complete and acctu•ate CDBG Federal Funds Disclosure Report detailing the required applicant/grantee information, and as appropriate other government assistance provided or applied for, interested parties and expected sources, and uses of funds; and. • Co�lfir�ns the Opportunities Industrialization Center of Wasl�ington is not on the federal list of declined or suspended contractors, Grant County designates Commissioner Carolaiul Swartz as the authorized Chief Admulistrative Official and authorized representative to act in all official mattiers in cannection with this application and Grant County's participation in the Washington State CDBG program, This policy shall talce effect on the 17t1i day of May, 2011.
